L. 104–325, § 2(3), Oct. 19, 1996, 110 Stat. 3998.)","seq_in_title":641,"parent_identifier":"/us/usc/t30/ch31","ancestors":[{"identifier":"/us/usc/t30","level":"title","num":"Title 30—","heading":"MINERAL LANDS AND MINING","status":null,"is_section":false},{"identifier":"/us/usc/t30/ch31","level":"chapter","num":"CHAPTER 31—","heading":"MARINE MINERAL RESOURCES RESEARCH","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id1d50fe7f-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904\"><num value=\"1904\">§ 1904.</num><heading> Marine mineral research centers</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1d50fe80-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">No later than 90 days after <date date=\"1996-10-19\">October 19, 1996</date>, the Secretary shall designate 3 centers for marine mineral research and related activities.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1d50fe81-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Concentration</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">One center shall concentrate primarily on research in the continental shelf regions of the United States, 1 center shall concentrate primarily on research in deep seabed and near-shore environments of islands, and 1 center shall concentrate primarily on research in arctic and cold water regions.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1d50fe82-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Criteria</heading><chapeau>In designating a center under this section, the Secretary shall give priority to a university that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1d50fe83-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/c/1\"><num value=\"1\">(1)</num><content> administers a federally funded center for marine minerals research;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1d50fe84-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/c/2\"><num value=\"2\">(2)</num><content> matriculates students for advanced degrees in marine geological sciences, nonenergy natural resources, and related fields of science and engineering;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1d50fe85-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/c/3\"><num value=\"3\">(3)</num><content> is a United States university with established programs and facilities that primarily focus on marine mineral resources;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1d50fe86-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/c/4\"><num value=\"4\">(4)</num><content> has engaged in collaboration and cooperation with industry, governmental agencies, and other universities in the field of marine mineral resources;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1d50fe87-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/c/5\"><num value=\"5\">(5)</num><chapeau> has demonstrated significant engineering, development, and design experience in two or more of the following areas; <ref class=\"footnoteRef\" idref=\"fn002110\">1</ref><note type=\"footnote\" id=\"fn002110\"><num>1</num> So in original. The semicolon probably should be a colon.</note></chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1d50fe88-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/c/5/A\"><num value=\"A\">(A)</num><content> seabed exploration systems;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1d50fe89-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/c/5/B\"><num value=\"B\">(B)</num><content> marine mining systems; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id1d50fe8a-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/c/5/C\"><num value=\"C\">(C)</num><content> marine mineral processing systems; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1d50fe8b-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/c/6\"><num value=\"6\">(6)</num><content> has been designated by the Secretary as a State Mining and Mineral Resources Research Institute.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1d50fe8c-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Center activities</heading><chapeau>A center shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1d50fe8d-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/d/1\"><num value=\"1\">(1)</num><content> provide technical assistance to the Secretary concerning marine mineral resources;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1d50fe8e-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/d/2\"><num value=\"2\">(2)</num><content> advise the Secretary on pertinent international activities in marine mineral resources development;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1d50fe8f-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/d/3\"><num value=\"3\">(3)</num><content> engage in research, training, and education transfer associated with the characterization and utilization of marine mineral resources; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id1d50fe90-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/d/4\"><num value=\"4\">(4)</num><content> promote the efficient identification, assessment, exploration, and management of marine mineral resources in an environmentally sound manner.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1d50fe91-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Allocation of funds</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In distributing funds to the centers designated under subsection (a), the Secretary shall, to the extent practicable, allocate an equal amount to each center.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id1d50fe92-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Limitations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id1d50fe93-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Administrative expenses</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Not more than 5 percent of the amount made available to carry out this section during a fiscal year may be used by the Secretary for expenses associated with administration of the program authorized by this section.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id1d50fe94-f67d-11e5-b269-d86a50255f99\" identifier=\"/us/usc/t30/s1904/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Construction costs</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">None of the funds made available under this section may be used for the construction of a new building or the acquisition, expansion, remodeling, or alteration of an existing building (including site grading and improvement and architect fees).</p>\n</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id1d50fe95-f67d-11e5-b269-d86a50255f99\">(<ref href=\"/us/pl/91/631/tII\">Pub.
