<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idedd480e2-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126"><num value="1126">§ 1126.</num><heading> Program Management Improvement Officers and Program Management Policy Council</heading><subsection style="-uslm-lc:I11" class="indent0" id="idedd480e3-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a"><num value="a">(a)</num><heading> <inline class="small-caps">Program Management Improvement Officers.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idedd480e4-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/1"><num value="1">(1)</num><heading> <inline class="small-caps">Designation</inline>.—</heading><content>The head of each agency described in section 901(b) shall designate a senior executive of the agency as the Program Management Improvement Officer of the agency.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idedd480e5-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/2"><num value="2">(2)</num><heading> <inline class="small-caps">Functions</inline>.—</heading><chapeau>The Program Management Improvement Officer of an agency designated under paragraph (1) shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idedd480e6-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/2/A"><num value="A">(A)</num><content> implement program management policies established by the agency under section 503(c); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idedd480e7-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/2/B"><num value="B">(B)</num><chapeau> develop a strategy for enhancing the role of program managers within the agency that includes the following:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idedd480e8-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/2/B/i"><num value="i">(i)</num><chapeau> Enhanced training and educational opportunities for program managers that shall include—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idedd480e9-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/2/B/i/I"><num value="I">(I)</num><content> training in the relevant competencies encompassed with program and project manager within the private sector for program managers; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idedd480ea-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/2/B/i/II"><num value="II">(II)</num><content> training that emphasizes cost containment for large projects and programs.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idedd480eb-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/2/B/ii"><num value="ii">(ii)</num><content> Mentoring of current and future program managers by experienced senior executives and program managers within the agency.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idedd480ec-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/2/B/iii"><num value="iii">(iii)</num><content> Improved career paths and career opportunities for program managers.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idedd480ed-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/2/B/iv"><num value="iv">(iv)</num><content> A plan to encourage the recruitment and retention of highly qualified individuals to serve as program managers.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idedd480ee-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/2/B/v"><num value="v">(v)</num><content> Improved means of collecting and disseminating best practices and lessons learned to enhance program management across the agency.</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idedd480ef-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/2/B/vi"><num value="vi">(vi)</num><content> Common templates and tools to support improved data gathering and analysis for program management and oversight purposes.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idedd480f0-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/a/3"><num value="3">(3)</num><heading> <inline class="small-caps">Application to department of defense</inline>.—</heading><content>This subsection shall not apply to the Department of Defense to the extent that the provisions of this subsection are substantially similar to or duplicative of the provisions of chapter 87 of title 10. For purposes of paragraph (1), the Under Secretary of Defense for Acquisition and Sustainment (or a designee of the Under Secretary) shall be considered the Program Management Improvement Officer.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="idedd480f1-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b"><num value="b">(b)</num><heading> <inline class="small-caps">Program Management Policy Council.—</inline></heading><paragraph style="-uslm-lc:I12" class="indent1" id="idedd4a802-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/1"><num value="1">(1)</num><heading> <inline class="small-caps">Establishment</inline>.—</heading><content>There is established in the Office of Management and Budget a council to be known as the “Program Management Policy Council” (in this subsection referred to as the “Council”).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idedd4a803-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/2"><num value="2">(2)</num><heading> <inline class="small-caps">Purpose and functions</inline>.—</heading><chapeau>The Council shall act as the principal interagency forum for improving agency practices related to program and project management. The Council shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="idedd4a804-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/2/A"><num value="A">(A)</num><content> advise and assist the Deputy Director for Management of the Office of Management and Budget;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idedd4a805-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/2/B"><num value="B">(B)</num><content> review programs identified as high risk by the Government Accountability Office and make recommendations for actions to be taken by the Deputy Director for Management of the Office of Management and Budget or a designee;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idedd4a806-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/2/C"><num value="C">(C)</num><chapeau> discuss topics of importance to the workforce, including—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idedd4a807-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/2/C/i"><num value="i">(i)</num><content> career development and workforce development needs;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idedd4a808-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/2/C/ii"><num value="ii">(ii)</num><content> policy to support continuous improvement in program and project management; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idedd4a809-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/2/C/iii"><num value="iii">(iii)</num><content> major challenges across agencies in managing programs;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idedd4a80a-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/2/D"><num value="D">(D)</num><content> advise on the development and applicability of standards governmentwide for program management transparency; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idedd4a80b-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/2/E"><num value="E">(E)</num><content> review the information published on the website of the Office of Management and Budget pursuant to section 1122.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idedd4a80c-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3"><num value="3">(3)</num><heading> <inline class="small-caps">Membership.—</inline></heading><subparagraph style="-uslm-lc:I13" class="indent2" id="idedd4a80d-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/A"><num value="A">(A)</num><heading> <inline class="small-caps">Composition</inline>.—</heading><chapeau>The Council shall be composed of the following members:</chapeau><clause style="-uslm-lc:I14" class="indent3" id="idedd4a80e-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/A/i"><num value="i">(i)</num><chapeau> Five members from the Office of Management and Budget as follows:</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="idedd4a80f-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/A/i/I"><num value="I">(I)</num><content> The Deputy Director for Management.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idedd4a810-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/A/i/II"><num value="II">(II)</num><content> The Administrator of the Office of Electronic Government.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idedd4a811-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/A/i/III"><num value="III">(III)</num><content> The Administrator of Federal Procurement Policy.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idedd4a812-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/A/i/IV"><num value="IV">(IV)</num><content> The Controller of the Office of Federal Financial Management.</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="idedd4a813-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/A/i/V"><num value="V">(V)</num><content> The Director of the Office of Performance and Personnel Management.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idedd4a814-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/A/ii"><num value="ii">(ii)</num><content> The Program Management Improvement Officer from each agency described in section 901(b).</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="idedd4a815-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/A/iii"><num value="iii">(iii)</num><content> Any other full-time or permanent part-time officer or employee of the Federal Government or member of the Armed Forces designated by the Chairperson.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="idedd4a816-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/B"><num value="B">(B)</num><heading> <inline class="small-caps">Chairperson and vice chairperson.—</inline></heading><clause style="-uslm-lc:I14" class="indent3" id="idedd4a817-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/B/i"><num value="i">(i)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Deputy Director for Management of the Office of Management and Budget shall be the Chairperson of the Council. A Vice Chairperson shall be elected by the members and shall serve a term of not more than 1 year.</content>

<clause style="-uslm-lc:I14" class="indent3" id="idedd4a818-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/3/B/ii"><num value="ii">(ii)</num><heading> <inline class="small-caps">Duties</inline>.—</heading><content>The Chairperson shall preside at the meetings of the Council, determine the agenda of the Council, direct the work of the Council, and establish and direct subgroups of the Council as appropriate.</content>

</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idedd4cf29-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/4"><num value="4">(4)</num><heading> <inline class="small-caps">Meetings</inline>.—</heading><content>The Council shall meet not less than twice per fiscal year and may meet at the call of the Chairperson or a majority of the members of the Council.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="idedd4cf2a-6f68-11ea-8e81-d8fa1c0939e8" identifier="/us/usc/t31/s1126/b/5"><num value="5">(5)</num><heading> <inline class="small-caps">Support</inline>.—</heading><content>The head of each agency with a Project Management Improvement Officer serving on the Council shall provide administrative support to the Council, as appropriate, at the request of the Chairperson.</content>
