<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6fe36e19-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535"><num value="1535">§ 1535.</num><heading> Agency agreements</heading><subsection style="-uslm-lc:I11" class="indent0" id="id6fe36e1a-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/a"><num value="a">(a)</num><chapeau> The head of an agency or major organizational unit within an agency may place an order with a major organizational unit within the same agency or another agency for goods or services if—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6fe3942b-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/a/1"><num value="1">(1)</num><content> amounts are available;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fe3942c-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/a/2"><num value="2">(2)</num><content> the head of the ordering agency or unit decides the order is in the best interest of the United States Government;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fe3942d-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/a/3"><num value="3">(3)</num><content> the agency or unit to fill the order is able to provide or get by contract the ordered goods or services; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fe3942e-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/a/4"><num value="4">(4)</num><content> the head of the agency decides ordered goods or services cannot be provided by contract as conveniently or cheaply by a commercial enterprise.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6fe3942f-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/b"><num value="b">(b)</num><content> Payment shall be made promptly by check on the written request of the agency or unit filling the order. Payment may be in advance or on providing the goods or services ordered and shall be for any part of the estimated or actual cost as determined by the agency or unit filling the order. A bill submitted or a request for payment is not subject to audit or certification in advance of payment. Proper adjustment of amounts paid in advance shall be made as agreed to by the heads of the agencies or units on the basis of the actual cost of goods or services provided.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6fe39430-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/c"><num value="c">(c)</num><content> A condition or limitation applicable to amounts for procurement of an agency or unit placing an order or making a contract under this section applies to the placing of the order or the making of the contract.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6fe39431-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/d"><num value="d">(d)</num><chapeau> An order placed or agreement made under this section obligates an appropriation of the ordering agency or unit. The amount obligated is deobligated to the extent that the agency or unit filling the order has not incurred obligations, before the end of the period of availability of the appropriation, in—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6fe39432-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/d/1"><num value="1">(1)</num><content> providing goods or services; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fe39433-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/d/2"><num value="2">(2)</num><content> making an authorized contract with another person to provide the requested goods or services.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6fe39434-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/e"><num value="e">(e)</num><chapeau> This section does not—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6fe39435-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/e/1"><num value="1">(1)</num><content> authorize orders to be placed for goods or services to be provided by convict labor; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fe39436-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s1535/e/2"><num value="2">(2)</num><content> affect other laws about working funds.</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Office of Management and Budget Policy Guidance.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Report and guidelines</inline>.—</heading><chapeau>Not later than one year after the date of the enactment of this Act [<date date="2008-10-14">Oct. 14, 2008</date>], the Director of the Office of Management and Budget shall—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> submit to Congress a comprehensive report on interagency acquisitions, including their frequency of use, management controls, cost-effectiveness, and savings generated; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> issue guidelines to assist the heads of executive agencies in improving the management of interagency acquisitions.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Matters covered by guidelines</inline>.—</heading><chapeau>For purposes of paragraph (1)(B), the Director shall include guidelines on the following matters:</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> Procedures for the use of interagency acquisitions to maximize competition, deliver best value to executive agencies, and minimize waste, fraud, and abuse.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> Categories of contracting inappropriate for interagency acquisition.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> Requirements for training acquisition workforce personnel in the proper use of interagency acquisitions.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Regulations Required.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><chapeau>Not later than one year after the date of the enactment of this Act [<date date="2008-10-14">Oct. 14, 2008</date>], the Federal Acquisition Regulation shall be revised to require that—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> all interagency assisted acquisitions include a written agreement between the requesting agency and the servicing agency assigning responsibility for the administration and management of the contract; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> all interagency assisted acquisitions include sufficient documentation to ensure an adequate audit.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Multi-agency contracts</inline>.—</heading><content>Not later than one year after the date of the enactment of this Act, the Federal Acquisition Regulation shall be revised to require any multi-agency contract entered into by an executive agency after the effective date of such regulations to be supported by a business case analysis detailing the administration of such contract, including an analysis of all direct and indirect costs to the Federal Government of awarding and administering such contract and the impact such contract will have on the ability of the Federal Government to leverage its purchasing power.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Agency Reporting Requirement</inline>.—</heading><content>The senior procurement executive for each executive agency shall, as directed by the Director of the Office of Management and Budget, submit to the Director annual reports on the actions taken by the executive agency pursuant to the guidelines issued under subsection (a).</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> The term ‘executive agency’ has the meaning given such term in section 4(1) of the Office of Federal Procurement Policy Act ([former] <ref href="/us/usc/t41/s403/1">41 U.S.C. 403(1)</ref>) [see <ref href="/us/usc/t41/s133">41 U.S.C. 133</ref>], except that, in the case of a military department, it means the Department of Defense.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> The term ‘head of executive agency’ means the head of an executive agency except that, in the case of a military department, the term means the Secretary of Defense.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> The term ‘interagency acquisition’ means a procedure by which an executive agency needing supplies or services (the requesting agency) obtains them from another executive agency (the servicing agency). The term includes acquisitions under <ref href="/us/usc/t31/s1535">section 1535 of title 31</ref>, United States Code (commonly referred to as the ‘Economy Act’), Federal Supply Schedules above $500,000, and Governmentwide acquisition contracts.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> The term ‘multi-agency contract’ means a task or delivery order contract established for use by more than one executive agency to obtain supplies and services, consistent with <ref href="/us/usc/t31/s1535">section 1535 of title 31</ref>, United States Code (commonly referred to as the ‘Economy Act’).”</content>
</paragraph>

L. 108–136, div. A, title X, § 1058</ref>, <date date="2003-11-24">Nov. 24, 2003</date>, <ref href="/us/stat/117/1619">117 Stat. 1619</ref>, provided that:<quotedContent origin="/us/pl/108/136/dA/tX/s1058">
<subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Review Required</inline>.—</heading><chapeau>The Director of the Office of Management and Budget shall conduct a review of existing authorities regarding the use of Air Force and Air National Guard Modular Airborne Fire-Fighting Systems units and other Department of Defense assets to fight wildfires to ensure that, in accordance with applicable legal requirements, such assets are available in the most expeditious manner to fight wildfires on Federal lands or non-Federal lands at the request of a Federal agency or State government. In conducting the review, the Director shall specifically consider—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> any adverse impact caused by the restrictions contained in <ref href="/us/usc/t31/s1535/a/4">section 1535(a)(4) of title 31</ref>, United States Code, or caused by the interpretation of such restrictions, on the ability of the Forest Service and other Federal agencies to procure such firefighting services; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> whether the authorities under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5121">42 U.S.C. 5121</ref> et seq.), including section 403(c) of such Act (<ref href="/us/usc/t42/s5170b">42 U.S.C. 5170b</ref>), are being properly utilized to facilitate an expeditious Department of Defense response to State requests under, and consistent with, such Act for firefighting services.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Determination Required</inline>.—</heading><content>On the basis of the review, the Director shall make a determination regarding whether existing authorities are being used in a manner consistent with using the available capabilities of Department of Defense assets to fight wildfires in the most expeditious and efficacious way to minimize the risk to public safety.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Expedited Economy Act Review Process</inline>.—</heading><content>If the Director determines under subsection (b) that existing authorities are adequate for the deployment of Department of Defense assets to fight wildfires, the Director shall develop and implement, subject to subsection (f), such modifications to the process for conducting the cost comparison required by <ref href="/us/usc/t31/s1535/a/4">section 1535(a)(4) of title 31</ref>, United States Code, as the Director considers appropriate to further expedite the procurement of such firefighting services.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Development and Implementation of Revised Policies</inline>.—</heading><content>If the Director determines under subsection (b) that the existing authorities or their use is inadequate or can be improved, the Director shall develop and implement, subject to subsection (f), such regulations, policies, and interagency procedures as may be necessary to improve the ability of the Department of Defense to respond to a request by a Federal agency or State government to assist in fighting wildfires on Federal lands or non-Federal lands under <ref href="/us/usc/t31/s1535/a">section 1535(a) of title 31</ref>, United States Code, or the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<ref href="/us/usc/t42/s5121">42 U.S.C. 5121</ref> et seq.), or both.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Reporting Requirement</inline>.—</heading><chapeau>Not later than 120 days after the date of the enactment of this Act [<date date="2003-11-24">Nov. 24, 2003</date>], the Director shall transmit to Congress a report—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> containing the results of the review conducted under subsection (a) and the determination made under subsection (b); and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> based on such determination, describing the modifications proposed to be made to existing authorities under subsection (c) or (d), including whether there is a need for legislative changes to further improve the procedures for using Department of Defense assets to fight wildfires.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Delayed Implementation</inline>.—</heading><content>The modifications described in the report prepared under subsection (e) to be made to existing authorities under subsection (c) or (d) shall not take effect until the end of the 30-day period beginning on the date on which the report is transmitted to Congress.”</content>
