and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6ff3e8cb-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/a/1/B\"><num value=\"B\">(B)</num><content> the Secretary shall not be required to pay a Treasury check issued before the effective date of this section unless it is negotiated to a financial institution within 12 months after such effective date.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ff3e8cc-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/a/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Deferral pending settlement</inline>.—</heading><content>Notwithstanding the time limitations imposed by paragraph (1), if the Secretary is on notice of a question of law or fact about whether a Treasury check is properly payable when the check is presented for payment, the Secretary may defer payment on such check until the question is settled.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ff40fdd-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/a/3\"><num value=\"3\">(3)</num><content> Nothing in this subsection shall be construed to affect the underlying obligation of the United States, or any agency thereof, for which a Treasury check was issued.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ff40fde-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/b\"><num value=\"b\">(b)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ff40fdf-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/b/1\"><num value=\"1\">(1)</num><chapeau> If a check issued by a disbursing official and drawn on a designated depositary is not paid by the last day of the fiscal year after the fiscal year in which the check was issued, the amount of the check is—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ff40fe0-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/b/1/A\"><num value=\"A\">(A)</num><content> withdrawn from the account with the depositary; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ff40fe1-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/b/1/B\"><num value=\"B\">(B)</num><content> deposited in the Treasury for credit to a consolidated account of the Treasury.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ff40fe2-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/b/2\"><num value=\"2\">(2)</num><content> A claim for the proceeds of an unpaid check under this subsection may be paid from a consolidated account by a check drawn on the Treasury.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ff40fe3-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/c\"><num value=\"c\">(c)</num><content> A limitation imposed on a claim against the United States Government under <ref href=\"/us/usc/t31/s3702\">section 3702 of this title</ref> does not apply to an unpaid check drawn on the Treasury or a designated depositary.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ff40fe4-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/d\"><num value=\"d\">(d)</num><content> The Secretary may prescribe regulations the Secretary decides are necessary to carry out subsections (a)–(c) of this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ff40fe5-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/e\"><num value=\"e\">(e)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ff40fe6-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/e/1\"><num value=\"1\">(1)</num><chapeau> The Secretary shall prescribe regulations on—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ff40fe7-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/e/1/A\"><num value=\"A\">(A)</num><content> enforcing the speedy presentation of Government drafts;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ff40fe8-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/e/1/B\"><num value=\"B\">(B)</num><content> paying drafts, including the place of payment; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ff40fe9-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/e/1/C\"><num value=\"C\">(C)</num><content> paying drafts if presentment is not made as required.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ff40fea-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/e/2\"><num value=\"2\">(2)</num><content> Regulations prescribed under paragraph (1) of this subsection shall prevent, as far as may be practicable, Government drafts from being used or placed in circulation as paper currency or a medium of exchange.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ff40feb-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3328/f\"><num value=\"f\">(f)</num><heading> <inline class=\"small-caps\">Authority To Decline Payment</inline>.—</heading><content>Nothing in this section limits the authority of the Secretary to decline payment of a Treasury check after first examination thereof at the Treasury.</content>\n</subsection>\n<sourceCredit id=\"id6ff40fec-b854-11e9-b72c-a5fb66e51517\">(<ref href=\"/us/pl/97/258\">Pub.
