<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6ff6cef2-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343"><num value="3343">§ 3343.</num><heading> Check forgery insurance fund</heading><subsection style="-uslm-lc:I11" class="indent0" id="id6ff6cef3-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/a"><num value="a">(a)</num><chapeau> The Department of the Treasury has a special deposit revolving fund, the “Check Forgery Insurance Fund”. Necessary amounts are hereafter appropriated to the Fund out of any moneys in the Treasury not otherwise appropriated, and shall remain available until expended to make the payments required or authorized under this section. The Fund consists of amounts—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6ff6f604-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/a/1"><num value="1">(1)</num><content> appropriated to the Fund; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6ff6f605-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/a/2"><num value="2">(2)</num><content> received under subsection (d) of this section.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6ff6f606-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/b"><num value="b">(b)</num><chapeau> The Secretary of the Treasury shall pay from the Fund to a payee or special endorsee of a check drawn on the Treasury or a depositary designated by the Secretary the amount of the check without interest if in the determination of the Secretary the payee or special endorse <ref class="footnoteRef" idref="fn002046">1</ref><note type="footnote" id="fn002046"><num>1</num> So in original. Probably should be “endorsee”.</note> establishes that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6ff6f607-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/b/1"><num value="1">(1)</num><content> the check was lost or stolen without the fault of the payee or a holder that is a special endorsee and whose endorsement is necessary for further negotiation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6ff6f608-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/b/2"><num value="2">(2)</num><content> the check was negotiated later and paid by the Secretary or a depositary on a forged endorsement of the payee’s or special endorsee’s name; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6ff6f609-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/b/3"><num value="3">(3)</num><content> the payee or special endorsee has not participated in any part of the proceeds of the negotiation or payment.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6ff6f60a-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/c"><num value="c">(c)</num><content> Notwithstanding <ref href="/us/usc/t31/s1306">section 1306 of this title</ref>, a check drawn on a designated depositary may be paid in the currency of a foreign country when the appropriate accountable official authorizes payment in that currency.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6ff6f60b-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/d"><num value="d">(d)</num><content> The Secretary shall deposit immediately to the credit of the Fund an amount recovered from a forger or a transferee or party on the check. The Secretary may use amounts in the Fund to reimburse payment certifying or authorizing agencies for any payment that the Secretary determines would otherwise have been payable from the Fund, and may reimburse certifying or authorizing agencies with amounts recovered because of payee nonentitlement. However, currency of a foreign country recovered because of a forged check drawn on a designated depositary shall be credited to the Fund or to the foreign currency fund that was charged when payment was made under subsection (b) of this section to the payee or special endorsee.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6ff6f60c-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/e"><num value="e">(e)</num><content> The Secretary may waive any provision of this section as may be necessary to ensure that claimants receive timely payments.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6ff6f60d-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/f"><num value="f">(f)</num><content> Under such conditions as the Secretary may prescribe, the Secretary may delegate duties and powers of the Secretary under this section to the head of an agency. Consistent with a delegation from the Secretary under this subsection, the head of an agency may redelegate those duties and powers to officers or employees of the agency.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6ff6f60e-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/g"><num value="g">(g)</num><chapeau> This section does not relieve—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6ff6f60f-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/g/1"><num value="1">(1)</num><content> a forger from civil or criminal liability; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6ff6f610-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/g/2"><num value="2">(2)</num><chapeau> a transferee or party on a check after the forgery from liability—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6ff6f611-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/g/2/A"><num value="A">(A)</num><content> on the express or implied warranty of prior endorsements of the transferee or party; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6ff6f612-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s3343/g/2/B"><num value="B">(B)</num><content> to refund amounts to the Secretary.</content>
