L. 97–258, Sept. 13, 1982, 96 Stat. 964.)","seq_in_title":236,"parent_identifier":"/us/usc/t31/stIII/ch35/schIII","ancestors":[{"identifier":"/us/usc/t31","level":"title","num":"Title 31—","heading":"MONEY AND FINANCE","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII","level":"subtitle","num":"SUBTITLE III—","heading":"FINANCIAL MANAGEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII/ch35","level":"chapter","num":"CHAPTER 35—","heading":"ACCOUNTING AND COLLECTION","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII/ch35/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"AUDITING AND SETTLING ACCOUNTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id227e375c-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526\"><num value=\"3526\">§ 3526.</num><heading> Settlement of accounts</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id227e375d-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/a\"><num value=\"a\">(a)</num><content> The Comptroller General shall settle all accounts of the United States Government and supervise the recovery of all debts finally certified by the Comptroller General as due the Government.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id227e375e-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/b\"><num value=\"b\">(b)</num><content> A decision of the Comptroller General under <ref href=\"/us/usc/t31/s3529\">section 3529 of this title</ref> is conclusive on the Comptroller General when settling the account containing the payment.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id227e375f-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/c\"><num value=\"c\">(c)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id227e3760-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/c/1\"><num value=\"1\">(1)</num><content> The Comptroller General shall settle an account of an accountable official within 3 years after the date the Comptroller General receives the account. A copy of the certificate of settlement shall be provided the official.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id227e3761-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/c/2\"><num value=\"2\">(2)</num><content> The settlement of an account is conclusive on the Comptroller General after 3 years after the account is received by the Comptroller General. However, an amount may be charged against the account after the 3-year period when the Government has or may have lost money because the official acted fraudulently or criminally.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id227e3762-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/c/3\"><num value=\"3\">(3)</num><content> A 3-year period under this subsection is suspended during a war.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id227e3763-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/c/4\"><num value=\"4\">(4)</num><chapeau> This subsection does not prohibit—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id227e3764-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/c/4/A\"><num value=\"A\">(A)</num><content> recovery of public money illegally or erroneously paid;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id227e3765-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/c/4/B\"><num value=\"B\">(B)</num><content> recovery from an official of a balance due the Government under a settlement within the 3-year period; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id227e3766-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/c/4/C\"><num value=\"C\">(C)</num><content> an official from clearing an account of questioned items as prescribed by law.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id227e3767-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/d\"><num value=\"d\">(d)</num><content> On settling an account of the Government, the balance certified by the Comptroller General is conclusive on the executive branch of the Government. On the initiative of the Comptroller General or on request of an individual whose accounts are settled or the head of the agency to which the account relates, the Comptroller General may change the account within a year after settlement. The decision of the Comptroller General to change the account is conclusive on the executive branch.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id227e3768-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/e\"><num value=\"e\">(e)</num><chapeau> When an amount of money is expended under law for a treaty or relations with a foreign country, the President may—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id227e3769-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/e/1\"><num value=\"1\">(1)</num><content> authorize the amount to be accounted for each year specifically by settlement of the Comptroller General when the President decides the amount expended may be made public; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id227e376a-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/e/2\"><num value=\"2\">(2)</num><content> make, or have the Secretary of State make, a certificate of the amount expended if the President decides the amount is not to be accounted for specifically. The certificate is a sufficient voucher for the amount stated in the certificate.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id2280815b-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/f\"><num value=\"f\">(f)</num><content> The Comptroller General shall keep all settled accounts, vouchers, certificates, and related papers until they are disposed of as prescribed by law.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id2280815c-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3526/g\"><num value=\"g\">(g)</num><content> This subchapter does not prohibit the Comptroller General from suspending an item in an account to get additional evidence or explanations needed to settle an account.</content>\n</subsection>\n<sourceCredit id=\"id2280815d-3bf5-11e3-9fd0-985dd9cd422a\">(<ref href=\"/us/pl/97/258\">Pub.
