and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6ffbfe57-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/a/1/B\"><num value=\"B\">(B)</num><content> the loss or deficiency was not the result of fault or negligence by the official or agent;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ffbfe58-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/a/2\"><num value=\"2\">(2)</num><content> the loss or deficiency was not the result of an illegal or incorrect payment; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ffbfe59-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/a/3\"><num value=\"3\">(3)</num><content> the Comptroller General agrees with the decision of the head of the agency.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ffbfe5a-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/b\"><num value=\"b\">(b)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ffbfe5b-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/b/1\"><num value=\"1\">(1)</num><chapeau> The Comptroller General shall relieve an official of the armed forces referred to in subsection (a) responsible for the physical loss or deficiency of public money, vouchers, or records, or a payment described in <ref href=\"/us/usc/t31/s3528/a/4/A\">section 3528(a)(4)(A) of this title</ref>, or shall authorize reimbursement, from an appropriation or fund available for reimbursement, of the amount of the loss or deficiency paid by or for the official as restitution, when—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ffbfe5c-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/b/1/A\"><num value=\"A\">(A)</num><chapeau> in the case of a physical loss or deficiency—</chapeau><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6ffbfe5d-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/b/1/A/i\"><num value=\"i\">(i)</num><content> the Secretary of Defense or the appropriate Secretary of the military department of the Department of Defense (or the Secretary of Homeland Security, in the case of a disbursing official of the Coast Guard when the Coast Guard is not operating as a service in the Navy) decides that the official was carrying out official duties when the loss or deficiency occurred;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6ffc256e-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> the loss or deficiency was not the result of an illegal or incorrect payment; and</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id6ffc256f-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/b/1/A/iii\"><num value=\"iii\">(iii)</num><content> the loss or deficiency was not the result of fault or negligence by the official; or</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ffc2570-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/b/1/B\"><num value=\"B\">(B)</num><content> in the case of a payment described in <ref href=\"/us/usc/t31/s3528/a/4/A\">section 3528(a)(4)(A) of this title</ref>, the Secretary of Defense or the Secretary of the appropriate military department (or the Secretary of Homeland Security, in the case of a disbursing official of the Coast Guard when the Coast Guard is not operating as a service in the Navy), after taking a diligent collection action, finds that the criteria of <ref href=\"/us/usc/t31/s3528/b/1\">section 3528(b)(1) of this title</ref> are satisfied.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ffc2571-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/b/2\"><num value=\"2\">(2)</num><content> The finding of the Secretary involved is conclusive on the Comptroller General.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ffc2572-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/c\"><num value=\"c\">(c)</num><content> On the initiative of the Comptroller General or written recommendation of the head of an agency, the Comptroller General may relieve a present or former disbursing official of the agency responsible for a deficiency in an account because of an illegal, improper, or incorrect payment, and credit the account for the deficiency, when the Comptroller General decides that the payment was not the result of bad faith or lack of reasonable care by the official. However, the Comptroller General may deny relief when the Comptroller General decides the head of the agency did not carry out diligently collection action under procedures prescribed by the Comptroller General.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ffc2573-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/d\"><num value=\"d\">(d)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ffc2574-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/d/1\"><num value=\"1\">(1)</num><chapeau> When the Comptroller General decides it is necessary to adjust the account of an official or agent granted relief under subsection (a) or (c) of this section, the amount of the relief shall be charged—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ffc2575-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/d/1/A\"><num value=\"A\">(A)</num><content> to an appropriation specifically provided to be charged; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ffc2576-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/d/1/B\"><num value=\"B\">(B)</num><content> if no specific appropriation, to the appropriation or fund available for the expense of the accountable function when the adjustment is carried out.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ffc2577-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/d/2\"><num value=\"2\">(2)</num><chapeau> Subsection (c) of this section does not—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ffc2578-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/d/2/A\"><num value=\"A\">(A)</num><content> affect the liability, or authorize the relief, of a payee, beneficiary, or recipient of an illegal, improper, or incorrect payment; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id6ffc2579-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/d/2/B\"><num value=\"B\">(B)</num><content> relieve an accountable official, the head of an agency, or the Comptroller General of responsibility in carrying out collection action against a payee, beneficiary, or recipient.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id6ffc257a-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3527/e\"><num value=\"e\">(e)</num><content> Relief provided under this section is in addition to relief provided under another law.</content>\n</subsection>\n<sourceCredit id=\"id6ffc257b-b854-11e9-b72c-a5fb66e51517\">(<ref href=\"/us/pl/97/258\">Pub.
