L. 97–258, Sept. 13, 1982, 96 Stat. 967.)","seq_in_title":240,"parent_identifier":"/us/usc/t31/stIII/ch35/schIII","ancestors":[{"identifier":"/us/usc/t31","level":"title","num":"Title 31—","heading":"MONEY AND FINANCE","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII","level":"subtitle","num":"SUBTITLE III—","heading":"FINANCIAL MANAGEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII/ch35","level":"chapter","num":"CHAPTER 35—","heading":"ACCOUNTING AND COLLECTION","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII/ch35/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"AUDITING AND SETTLING ACCOUNTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id2282f1a6-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3530\"><num value=\"3530\">§ 3530.</num><heading> Adjusting accounts</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id2282f1a7-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3530/a\"><num value=\"a\">(a)</num><chapeau> An appropriation or fund currently available for the expense of an accountable function shall be charged with an amount necessary to adjust an account of an accountable official or agent when—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2282f1a8-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3530/a/1\"><num value=\"1\">(1)</num><content> necessary to adjust the account for a loss to the United States Government resulting from the fault or negligence of the official or agent; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2282f1a9-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3530/a/2\"><num value=\"2\">(2)</num><content> the head of the agency decides the loss is uncollectable.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id2282f1aa-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3530/b\"><num value=\"b\">(b)</num><content> An adjustment does not affect the personal financial liability of an official or agent for the loss.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id2282f1ab-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3530/c\"><num value=\"c\">(c)</num><content> The Comptroller General shall prescribe regulations to carry out subsection (a) of this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id2282f1ac-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s3530/d\"><num value=\"d\">(d)</num><content> Under procedures prescribed by the Comptroller General, the head of an agency may charge the net amount of unpaid and overpaid balances in individual pay accounts against the appropriation for the fiscal year in which the balances occurred and from which the accounts were payable.
