<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id22914a4f-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s3713"><num value="3713">§ 3713.</num><heading> Priority of Government claims</heading><subsection style="-uslm-lc:I11" class="indent0" id="id22914a50-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s3713/a"><num value="a">(a)</num><paragraph style="-uslm-lc:I11" class="indent0" id="id22914a51-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s3713/a/1"><num value="1">(1)</num><chapeau> A claim of the United States Government shall be paid first when—</chapeau><subparagraph style="-uslm-lc:I12" class="indent1" id="id22914a52-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s3713/a/1/A"><num value="A">(A)</num><chapeau> a person indebted to the Government is insolvent and—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id22914a53-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s3713/a/1/A/i"><num value="i">(i)</num><content> the debtor without enough property to pay all debts makes a voluntary assignment of property;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id22914a54-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s3713/a/1/A/ii"><num value="ii">(ii)</num><content> property of the debtor, if absent, is attached; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id22914a55-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s3713/a/1/A/iii"><num value="iii">(iii)</num><content> an act of bankruptcy is committed; or</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id22914a56-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s3713/a/1/B"><num value="B">(B)</num><content> the estate of a deceased debtor, in the custody of the executor or administrator, is not enough to pay all debts of the debtor.</content>

<paragraph style="-uslm-lc:I11" class="indent0" id="id22914a57-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s3713/a/2"><num value="2">(2)</num><content> This subsection does not apply to a case under title 11.</content>

<subsection style="-uslm-lc:I11" class="indent0" id="id22914a58-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s3713/b"><num value="b">(b)</num><content> A representative of a person or an estate (except a trustee acting under title 11) paying any part of a debt of the person or estate before paying a claim of the Government is liable to the extent of the payment for unpaid claims of the Government.</content>
