L. 104–316, title II, § 202(p), Oct. 19, 1996, 110 Stat. 3844.)","seq_in_title":282,"parent_identifier":"/us/usc/t31/stIII/ch37/schIII","ancestors":[{"identifier":"/us/usc/t31","level":"title","num":"Title 31—","heading":"MONEY AND FINANCE","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII","level":"subtitle","num":"SUBTITLE III—","heading":"FINANCIAL MANAGEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII/ch37","level":"chapter","num":"CHAPTER 37—","heading":"CLAIMS","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII/ch37/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"CLAIMS AGAINST THE UNITED STATES GOVERNMENT","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id700aa452-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3728\"><num value=\"3728\">§ 3728.</num><heading> Setoff against judgment</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id700aa453-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3728/a\"><num value=\"a\">(a)</num><content> The Secretary of the Treasury shall withhold paying that part of a judgment against the United States Government presented to the Secretary that is equal to a debt the plaintiff owes the Government.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id700aa454-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3728/b\"><num value=\"b\">(b)</num><chapeau> The Secretary shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id700aa455-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3728/b/1\"><num value=\"1\">(1)</num><content> discharge the debt if the plaintiff agrees to the setoff and discharges a part of the judgment equal to the debt; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id700aa456-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3728/b/2\"><num value=\"2\">(2)</num><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id700aa457-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3728/b/2/A\"><num value=\"A\">(A)</num><content> withhold payment of an additional amount the Secretary decides will cover legal costs of bringing a civil action for the debt if the plaintiff denies the debt or does not agree to the setoff; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id700acb68-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3728/b/2/B\"><num value=\"B\">(B)</num><content> have a civil action brought if one has not already been brought.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id700acb69-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3728/c\"><num value=\"c\">(c)</num><content> If the Government loses a civil action to recover a debt or recovers less than the amount the Secretary withholds under this section, the Secretary shall pay the plaintiff the balance and interest of 6 percent for the time the money is withheld.</content>\n</subsection>\n<sourceCredit id=\"id700acb6a-b854-11e9-b72c-a5fb66e51517\">(<ref href=\"/us/pl/97/258\">Pub.
