L. 110–409, § 10, Oct. 14, 2008, 122 Stat. 4314.)","seq_in_title":288,"parent_identifier":"/us/usc/t31/stIII/ch38","ancestors":[{"identifier":"/us/usc/t31","level":"title","num":"Title 31—","heading":"MONEY AND FINANCE","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII","level":"subtitle","num":"SUBTITLE III—","heading":"FINANCIAL MANAGEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII/ch38","level":"chapter","num":"CHAPTER 38—","heading":"ADMINISTRATIVE REMEDIES FOR FALSE CLAIMS AND STATEMENTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id4080c4e0-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801\"><num value=\"3801\">§ 3801.</num><heading> Definitions</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id4080c4e1-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a\"><num value=\"a\">(a)</num><chapeau> For purposes of this chapter—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4080c4e2-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/1\"><num value=\"1\">(1)</num><chapeau> “authority” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080c4e3-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/1/A\"><num value=\"A\">(A)</num><content> an executive department;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080c4e4-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/1/B\"><num value=\"B\">(B)</num><content> a military department;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080c4e5-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/1/C\"><num value=\"C\">(C)</num><content> an establishment (as such term is defined in section 11(2) <ref class=\"footnoteRef\" idref=\"fn002069\">1</ref><note type=\"footnote\" id=\"fn002069\"><num>1</num> See References in Text note below.</note> of the Inspector General Act of 1978) which is not an executive department;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080c4e6-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/1/D\"><num value=\"D\">(D)</num><content> the United States Postal Service;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080c4e7-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/1/E\"><num value=\"E\">(E)</num><content> the National Science Foundation; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080c4e8-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/1/F\"><num value=\"F\">(F)</num><content> a designated Federal entity (as such term is defined under section 8G(a)(2) of the Inspector General Act of 1978);</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4080c4e9-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/2\"><num value=\"2\">(2)</num><chapeau> “authority head” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080c4ea-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/2/A\"><num value=\"A\">(A)</num><content> the head of an authority; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080c4eb-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/2/B\"><num value=\"B\">(B)</num><content> an official or employee of the authority designated, in regulations promulgated by the head of the authority, to act on behalf of the head of the authority;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4080c4ec-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/3\"><num value=\"3\">(3)</num><chapeau> “claim” means any request, demand, or submission—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080c4ed-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/3/A\"><num value=\"A\">(A)</num><content> made to an authority for property, services, or money (including money representing grants, loans, insurance, or benefits);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080c4ee-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/3/B\"><num value=\"B\">(B)</num><chapeau> made to a recipient of property, services, or money from an authority or to a party to a contract with an authority—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4080c4ef-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/3/B/i\"><num value=\"i\">(i)</num><chapeau> for property or services if the United States—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id4080c4f0-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/3/B/i/I\"><num value=\"I\">(I)</num><content> provided such property or services;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id4080c4f1-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/3/B/i/II\"><num value=\"II\">(II)</num><content> provided any portion of the funds for the purchase of such property or services; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id4080c4f2-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/3/B/i/III\"><num value=\"III\">(III)</num><content> will reimburse such recipient or party for the purchase of such property or services; or</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4080c4f3-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/3/B/ii\"><num value=\"ii\">(ii)</num><chapeau> for the payment of money (including money representing grants, loans, insurance, or benefits) if the United States—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id4080c4f4-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/3/B/ii/I\"><num value=\"I\">(I)</num><content> provided any portion of the money requested or demanded; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id4080c4f5-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/3/B/ii/II\"><num value=\"II\">(II)</num><content> will reimburse such recipient or party for any portion of the money paid on such request or demand; or</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080ec06-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/3/C\"><num value=\"C\">(C)</num><content> made to an authority which has the effect of decreasing an obligation to pay or account for property, services, or money,</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">except that such term does not include any claim made in any return of tax imposed by the Internal Revenue Code of 1986;</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4080ec07-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/4\"><num value=\"4\">(4)</num><chapeau> “investigating official” means an individual who—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080ec08-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/4/A\"><num value=\"A\">(A)</num><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080ec09-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/4/A/i\"><num value=\"i\">(i)</num><content> in the case of an authority in which an Office of Inspector General is established by the Inspector General Act of 1978 or by any other Federal law, is the Inspector General of that authority or an officer or employee of such Office designated by the Inspector General;</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080ec0a-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/4/A/ii\"><num value=\"ii\">(ii)</num><content> in the case of an authority in which an Office of Inspector General is not established by the Inspector General Act of 1978 or by any other Federal law, is an officer or employee of the authority designated by the authority head to conduct investigations under <ref href=\"/us/usc/t31/s3803/a/1\">section 3803(a)(1) of this title</ref>; or</content>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080ec0b-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/4/A/iii\"><num value=\"iii\">(iii)</num><content> in the case of a military department, is the Inspector General of the Department of Defense or an officer or employee of the Office of Inspector General of the Department of Defense who is designated by the Inspector General; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080ec0c-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/4/B\"><num value=\"B\">(B)</num><content> who, if a member of the Armed Forces of the United States on active duty, is serving in grade O–7 or above or, if a civilian employee, is serving in a position for which the rate of basic pay is not less than the minimum rate of basic pay for grade GS–16 under the General Schedule;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4080ec0d-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/5\"><num value=\"5\">(5)</num><chapeau> “knows or has reason to know”, for purposes of establishing liability under section 3802, means that a person, with respect to a claim or statement—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080ec0e-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/5/A\"><num value=\"A\">(A)</num><content> has actual knowledge that the claim or statement is false, fictitious, or fraudulent;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080ec0f-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/5/B\"><num value=\"B\">(B)</num><content> acts in deliberate ignorance of the truth or falsity of the claim or statement; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080ec10-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/5/C\"><num value=\"C\">(C)</num><content> acts in reckless disregard of the truth or falsity of the claim or statement,</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">and no proof of specific intent to defraud is required;</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4080ec11-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/6\"><num value=\"6\">(6)</num><content> “person” means any individual, partnership, corporation, association, or private organization;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4080ec12-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/7\"><num value=\"7\">(7)</num><chapeau> “presiding officer” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080ec13-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/7/A\"><num value=\"A\">(A)</num><content> in the case of an authority to which the provisions of subchapter II of chapter 5 of title 5 apply, an administrative law judge appointed in the authority pursuant to section 3105 of such title or detailed to the authority pursuant to section 3344 of such title; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4080ec14-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/7/B\"><num value=\"B\">(B)</num><chapeau> in the case of an authority to which the provisions of such subchapter do not apply, an officer or employee of the authority who—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4080ec15-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/7/B/i\"><num value=\"i\">(i)</num><content> is selected under chapter 33 of title 5 pursuant to the competitive examination process applicable to administrative law judges;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4080ec16-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/7/B/ii\"><num value=\"ii\">(ii)</num><content> is appointed by the authority head to conduct hearings under <ref href=\"/us/usc/t31/s3803\">section 3803 of this title</ref>;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4080ec17-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/7/B/iii\"><num value=\"iii\">(iii)</num><content> is assigned to cases in rotation so far as practicable;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4080ec18-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/7/B/iv\"><num value=\"iv\">(iv)</num><content> may not perform duties inconsistent with the duties and responsibilities of a presiding officer;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id40811329-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/7/B/v\"><num value=\"v\">(v)</num><content> is entitled to pay prescribed by the Office of Personnel Management independently of ratings and recommendations made by the authority and in accordance with chapter 51 of such title and subchapter III of chapter 53 of such title;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4081132a-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/7/B/vi\"><num value=\"vi\">(vi)</num><content> is not subject to performance appraisal pursuant to chapter 43 of such title; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id4081132b-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/7/B/vii\"><num value=\"vii\">(vii)</num><content> may be removed, suspended, furloughed, or reduced in grade or pay only for good cause established and determined by the Merit Systems Protection Board on the record after opportunity for hearing by such Board;</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id4081132c-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/8\"><num value=\"8\">(8)</num><chapeau> “reviewing official” means any officer or employee of an authority—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4081132d-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/8/A\"><num value=\"A\">(A)</num><content> who is designated by the authority head to make the determination required under <ref href=\"/us/usc/t31/s3803/a/2\">section 3803(a)(2) of this title</ref>;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4081132e-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/8/B\"><num value=\"B\">(B)</num><content> who, if a member of the Armed Forces of the United States on active duty, is serving in grade O–7 or above or, if a civilian employee, is serving in a position for which the rate of basic pay is not less than the minimum rate of basic pay for grade GS–16 under the General Schedule; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id4081132f-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/8/C\"><num value=\"C\">(C)</num><chapeau> who is—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id40811330-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/8/C/i\"><num value=\"i\">(i)</num><content> not subject to supervision by, or required to report to, the investigating official; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id40811331-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/8/C/ii\"><num value=\"ii\">(ii)</num><content> not employed in the organizational unit of the authority in which the investigating official is employed; and</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id40811332-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/9\"><num value=\"9\">(9)</num><chapeau> “statement” means any representation, certification, affirmation, document, record, or accounting or bookkeeping entry made—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id40811333-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/9/A\"><num value=\"A\">(A)</num><content> with respect to a claim or to obtain the approval or payment of a claim (including relating to eligibility to make a claim); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id40811334-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/9/B\"><num value=\"B\">(B)</num><chapeau> with respect to (including relating to eligibility for)—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id40811335-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/9/B/i\"><num value=\"i\">(i)</num><content> a contract with, or a bid or proposal for a contract with; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id40811336-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/a/9/B/ii\"><num value=\"ii\">(ii)</num><content> a grant, loan, or benefit from,</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I32\" class=\"indent2 firstIndent0\">an authority, or any State, political subdivision of a State, or other party, if the United States Government provides any portion of the money or property under such contract or for such grant, loan, or benefit, or if the Government will reimburse such State, political subdivision, or party for any portion of the money or property under such contract or for such grant, loan, or benefit,</continuation>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">except that such term does not include any statement made in any return of tax imposed by the Internal Revenue Code of 1986.</continuation>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id40811337-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/b\"><num value=\"b\">(b)</num><chapeau> For purposes of paragraph (3) of subsection (a)—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id40811338-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/b/1\"><num value=\"1\">(1)</num><content> each voucher, invoice, claim form, or other individual request or demand for property, services, or money constitutes a separate claim;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id40811339-7414-11ea-9c1e-8f32f99f466a\" identifier=\"/us/usc/t31/s3801/b/2\"><num value=\"2\">(2)</num><content> each claim for property, services, or money is subject to this chapter regardless of whether such property, services, or money is actually delivered or paid;
