L. 102–572, title IX, § 902(b)(1), Oct. 29, 1992, 106 Stat. 4516.)","seq_in_title":293,"parent_identifier":"/us/usc/t31/stIII/ch38","ancestors":[{"identifier":"/us/usc/t31","level":"title","num":"Title 31—","heading":"MONEY AND FINANCE","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII","level":"subtitle","num":"SUBTITLE III—","heading":"FINANCIAL MANAGEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIII/ch38","level":"chapter","num":"CHAPTER 38—","heading":"ADMINISTRATIVE REMEDIES FOR FALSE CLAIMS AND STATEMENTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id70102271-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806\"><num value=\"3806\">§ 3806.</num><heading> Collection of civil penalties and assessments</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id70102272-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/a\"><num value=\"a\">(a)</num><content> The Attorney General shall be responsible for judicial enforcement of any civil penalty or assessment imposed pursuant to the provisions of this chapter.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id70102273-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/b\"><num value=\"b\">(b)</num><content> Any penalty or assessment imposed in a determination which has become final pursuant to this chapter may be recovered in a civil action brought by the Attorney General. In any such action, no matter that was raised or that could have been raised in a hearing conducted under <ref href=\"/us/usc/t31/s3803/f\">section 3803(f) of this title</ref> or pursuant to judicial review under <ref href=\"/us/usc/t31/s3805\">section 3805 of this title</ref> may be raised as a defense, and the determination of liability and the determination of amounts of penalties and assessments shall not be subject to review.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id70102274-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/c\"><num value=\"c\">(c)</num><content> The district courts of the United States shall have jurisdiction of any action commenced by the United States under subsection (b) of this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id70102275-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/d\"><num value=\"d\">(d)</num><content> Any action under subsection (b) of this section may, without regard to venue requirements, be joined and consolidated with or asserted as a counterclaim, cross-claim, or setoff by the United States in any other civil action which includes as parties the United States and the person against whom such action may be brought.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id70102276-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/e\"><num value=\"e\">(e)</num><content> The United States Court of Federal Claims shall have jurisdiction of any action under subsection (b) of this section to recover any penalty or assessment if the cause of action is asserted by the United States as a counterclaim in a matter pending in such court.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id70102277-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/f\"><num value=\"f\">(f)</num><content> The Attorney General shall have exclusive authority to compromise or settle any penalty or assessment the determination of which is the subject of a pending petition pursuant to <ref href=\"/us/usc/t31/s3805\">section 3805 of this title</ref> or a pending action to recover such penalty or assessment pursuant to this section.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id70102278-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/g\"><num value=\"g\">(g)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id70102279-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/g/1\"><num value=\"1\">(1)</num><content> Except as provided in paragraph (2) of this subsection, any amount of penalty or assessment collected under this chapter shall be deposited as miscellaneous receipts in the Treasury of the United States.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7010227a-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/g/2\"><num value=\"2\">(2)</num><subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7010227b-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/g/2/A\"><num value=\"A\">(A)</num><content> Any amount of a penalty or assessment imposed by the United States Postal Service under this chapter shall be deposited in the Postal Service Fund established by <ref href=\"/us/usc/t39/s2003\">section 2003 of title 39</ref>.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7010498c-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/g/2/B\"><num value=\"B\">(B)</num><content> Any amount of a penalty or assessment imposed by the Secretary of Health and Human Services under this chapter with respect to a claim or statement made in connection with old age and survivors benefits under title II of the Social Security Act shall be deposited in the Federal Old-Age and Survivors Insurance Trust Fund.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7010498d-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/g/2/C\"><num value=\"C\">(C)</num><content> Any amount of a penalty or assessment imposed by the Secretary of Health and Human Services under this chapter with respect to a claim or statement made in connection with disability benefits under title II of the Social Security Act shall be deposited in the Federal Disability Insurance Trust Fund.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7010498e-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/g/2/D\"><num value=\"D\">(D)</num><content> Any amount of a penalty or assessment imposed by the Secretary of Health and Human Services under this chapter with respect to a claim or statement made in connection with benefits under part A of title XVIII of the Social Security Act shall be deposited in the Federal Hospital Insurance Trust Fund.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7010498f-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s3806/g/2/E\"><num value=\"E\">(E)</num><content> Any amount of a penalty or assessment imposed by the Secretary of Health and Human Services under this chapter with respect to a claim or statement made in connection with benefits under part B of title XVIII of the Social Security Act shall be deposited in the Federal Supplementary Medical Insurance Trust
