L. 99–570, title I, § 1358, title III, § 3153, Oct. 27, 1986, 100 Stat. 3207–26, 3207–94.)","seq_in_title":346,"parent_identifier":"/us/usc/t31/stIV/ch53/schII","ancestors":[{"identifier":"/us/usc/t31","level":"title","num":"Title 31—","heading":"MONEY AND FINANCE","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIV","level":"subtitle","num":"SUBTITLE IV—","heading":"MONEY","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIV/ch53","level":"chapter","num":"CHAPTER 53—","heading":"MONETARY TRANSACTIONS","status":null,"is_section":false},{"identifier":"/us/usc/t31/stIV/ch53/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"RECORDS AND REPORTS ON MONETARY INSTRUMENTS TRANSACTIONS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id7024957d-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316\"><num value=\"5316\">§ 5316.</num><heading> Reports on exporting and importing monetary instruments</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7024957e-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/a\"><num value=\"a\">(a)</num><chapeau> Except as provided in subsection (c) of this section, a person or an agent or bailee of the person shall file a report under subsection (b) of this section when the person, agent, or bailee knowingly—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7024bc8f-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/a/1\"><num value=\"1\">(1)</num><chapeau> transports, is about to transport, or has transported, monetary instruments of more than $10,000 at one time—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7024bc90-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/a/1/A\"><num value=\"A\">(A)</num><content> from a place in the United States to or through a place outside the United States; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id7024bc91-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/a/1/B\"><num value=\"B\">(B)</num><content> to a place in the United States from or through a place outside the United States; or</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7024bc92-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/a/2\"><num value=\"2\">(2)</num><content> receives monetary instruments of more than $10,000 at one time transported into the United States from or through a place outside the United States.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7024bc93-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/b\"><num value=\"b\">(b)</num><chapeau> A report under this section shall be filed at the time and place the Secretary of the Treasury prescribes. The report shall contain the following information to the extent the Secretary prescribes:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7024bc94-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/b/1\"><num value=\"1\">(1)</num><content> the legal capacity in which the person filing the report is acting.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7024bc95-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/b/2\"><num value=\"2\">(2)</num><content> the origin, destination, and route of the monetary instruments.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7024bc96-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/b/3\"><num value=\"3\">(3)</num><content> when the monetary instruments are not legally and beneficially owned by the person transporting the instruments, or if the person transporting the instruments personally is not going to use them, the identity of the person that gave the instruments to the person transporting them, the identity of the person who is to receive them, or both.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7024bc97-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/b/4\"><num value=\"4\">(4)</num><content> the amount and kind of monetary instruments transported.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7024bc98-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/b/5\"><num value=\"5\">(5)</num><content> additional information.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7024bc99-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/c\"><num value=\"c\">(c)</num><content> This section or a regulation under this section does not apply to a common carrier of passengers when a passenger possesses a monetary instrument, or to a common carrier of goods if the shipper does not declare the instrument.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7024bc9a-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s5316/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Cumulation of Closely Related Events</inline>.—</heading><content>The Secretary of the Treasury may prescribe regulations under this section defining the term “at one time” for purposes of subsection (a).
