<chapeau style="-uslm-lc:I11" class="indent0">An executive agency shall use a procurement contract as the legal instrument reflecting a relationship between the United States Government and a State, a local government, or other recipient when—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2305ddf9-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s6303/1"><num value="1">(1)</num><content> the principal purpose of the instrument is to acquire (by purchase, lease, or barter) property or services for the direct benefit or use of the United States Government; or</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id2305ddfa-3bf5-11e3-9fd0-985dd9cd422a" identifier="/us/usc/t31/s6303/2"><num value="2">(2)</num><content> the agency decides in a specific instance that the use of a procurement contract is appropriate.</content>
