L. 116–103, § 4(a), Dec. 30, 2019, 133 Stat. 3268.)","seq_in_title":402,"parent_identifier":"/us/usc/t31/stV/ch64","ancestors":[{"identifier":"/us/usc/t31","level":"title","num":"Title 31—","heading":"MONEY AND FINANCE","status":null,"is_section":false},{"identifier":"/us/usc/t31/stV","level":"subtitle","num":"SUBTITLE V—","heading":"GENERAL ASSISTANCE ADMINISTRATION","status":null,"is_section":false},{"identifier":"/us/usc/t31/stV/ch64","level":"chapter","num":"CHAPTER 64—","heading":"DATA STANDARDS FOR GRANT REPORTING","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"idad1a33fb-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402\"><num value=\"6402\">§ 6402.</num><heading> Data standards for grant reporting</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad1a33fc-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">In General.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a33fd-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/a/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">Designation of standard-setting agency</inline>.—</heading><content>The Director shall designate the Executive department that administers the greatest number of programs under which Federal awards are issued in a calendar year as the standard-setting agency.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a5b0e-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/a/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Establishment of standards</inline>.—</heading><content>Not later than 2 years after the date of enactment of this chapter, the Secretary and the Director shall establish Governmentwide data standards for information reported by recipients of Federal awards.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a5b0f-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/a/3\"><num value=\"3\">(3)</num><heading> <inline class=\"small-caps\">Data elements</inline>.—</heading><chapeau>The data standards established under paragraph (2) shall include, at a minimum—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad1a5b10-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/a/3/A\"><num value=\"A\">(A)</num><content> standard definitions for data elements required for managing Federal awards; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"idad1a5b11-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/a/3/B\"><num value=\"B\">(B)</num><content> unique identifiers for Federal awards and recipients of Federal awards that can be consistently applied Governmentwide.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad1a5b12-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Scope</inline>.—</heading><chapeau>The data standards established under subsection (a)—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a5b13-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/b/1\"><num value=\"1\">(1)</num><content> shall include core data elements;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a5b14-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/b/2\"><num value=\"2\">(2)</num><content> may cover information required by law to be reported to any agency by recipients of Federal awards, including audit-related information reported under chapter 75 of this title; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a5b15-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/b/3\"><num value=\"3\">(3)</num><content> may not be used by the Director or any agency to require the collection of any data not otherwise required under Federal law.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad1a5b16-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Requirements</inline>.—</heading><chapeau>The data standards established under subsection (a) shall, to the extent reasonable and practicable—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a5b17-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/c/1\"><num value=\"1\">(1)</num><content> render information reported by recipients of Federal awards fully searchable and machine-readable;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a5b18-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/c/2\"><num value=\"2\">(2)</num><content> be nonproprietary;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a5b19-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/c/3\"><num value=\"3\">(3)</num><content> incorporate standards developed and maintained by voluntary consensus standards bodies;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a5b1a-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/c/4\"><num value=\"4\">(4)</num><content> be consistent with and implement applicable accounting and reporting principles; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a5b1b-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/c/5\"><num value=\"5\">(5)</num><content> incorporate the data standards established under the Federal Funding Accountability and Transparency Act of 2006 (<ref href=\"/us/usc/t31/s6101\">31 U.S.C. 6101</ref> note).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"idad1a5b1c-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Consultation</inline>.—</heading><chapeau>In establishing the data standards under subsection (a), the Secretary and the Director shall consult with—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a5b1d-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/d/1\"><num value=\"1\">(1)</num><content> the Secretary of the Treasury to ensure that the data standards established under subsection (a) incorporate the data standards established under the Federal Funding Accountability and Transparency Act of 2006 (<ref href=\"/us/usc/t31/s6101\">31 U.S.C. 6101</ref> note);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a822e-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/d/2\"><num value=\"2\">(2)</num><content> the head of each agency that issues Federal awards;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a822f-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/d/3\"><num value=\"3\">(3)</num><content> recipients of Federal awards and organizations representing recipients of Federal awards;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a8230-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/d/4\"><num value=\"4\">(4)</num><content> private sector experts;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a8231-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/d/5\"><num value=\"5\">(5)</num><content> members of the public, including privacy experts, privacy advocates, auditors, and industry stakeholders; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"idad1a8232-4f43-11ea-949e-c0bdc5fe71e7\" identifier=\"/us/usc/t31/s6402/d/6\"><num value=\"6\">(6)</num><content> State and local governments.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"idad1a8233-4f43-11ea-949e-c0bdc5fe71e7\">(Added <ref href=\"/us/pl/116/103/s4/a\">Pub. L. 116–103, § 6</ref>, <date date=\"2019-12-30\">Dec. 30, 2019</date>, <ref href=\"/us/stat/133/3270\">133 Stat. 3270</ref>, provided that:<quotedContent origin=\"/us/pl/116/103/s6\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Collection of Information</inline>.—</heading><content>Not later than 5 years after the date of enactment of this Act [<date date=\"2019-12-30\">Dec. 30, 2019</date>], the Secretary and the Director shall, using the data standards established under chapter 64 of title 31, United States Code, as added by section 4(a) of this Act, enable the collection, public display, and maintenance of Federal award information as a Governmentwide data set, subject to reasonable restrictions established by the Director to ensure protection of personally identifiable information and otherwise sensitive information.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Publication of Information</inline>.—</heading><content>The Secretary and the Director shall require the publication of data reported by recipients of Federal awards that is collected from all agencies on a single public portal, which may be an existing Governmentwide website, as determined appropriate by the Director.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">FOIA</inline>.—</heading><content>Nothing in this section shall require the disclosure to the public of information that would be exempt from disclosure under <ref href=\"/us/usc/t5/s552\">section 552 of title 5</ref>, United States Code (commonly known as the ‘Freedom of Information Act’).”</content>\n</subsection>\n</quotedContent>\n</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">[For definitions of terms used in <ref href=\"/us/pl/116/103/s6\">section 6 of Pub. L. 116–103, § 7</ref>, <date date=\"2019-12-30\">Dec. 30, 2019</date>, <ref href=\"/us/stat/133/3270\">133 Stat. 3270</ref>, provided that:<quotedContent origin=\"/us/pl/116/103/s7\">\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"a\">“(a)</num><heading> <inline class=\"small-caps\">Determination Required</inline>.—</heading><content>The Director and the Secretary shall determine whether to use nonproprietary identifiers described in <ref href=\"/us/usc/t31/s6402/a/3/B\">section 6402(a)(3)(B) of title 31</ref>, United States Code, as added by section 4(a) of this Act.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"b\">“(b)</num><heading> <inline class=\"small-caps\">Factors to Be Considered</inline>.—</heading><content>In making the determination under subsection (a), the Director and the Secretary shall consider factors such as accessibility and cost to recipients of Federal awards, agencies that issue Federal awards, private sector experts, and members of the public, including privacy experts, privacy advocates, transparency experts, and transparency advocates.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I21\" class=\"indent0\"><num value=\"c\">“(c)</num><heading> <inline class=\"small-caps\">Publication and Report on Determination</inline>.—</heading><content>Not later than the earlier of 1 year after the date of enactment of this Act [<date date=\"2019-12-30\">Dec. 30, 2019</date>] or the date on which the Director and the Secretary establish data standards under <ref href=\"/us/usc/t31/s6402/a/2\">section 6402(a)(2) of title 31</ref>, United States Code, as added by section 4(a) of this Act, the Director and the Secretary shall publish and submit to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives a report explaining the reasoning for the determination made under subsection (a).”</content>\n</subsection>\n</quotedContent>\n</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">[For definitions of terms used in <ref href=\"/us/pl/116/103/s7\">section 7 of Pub.
