<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id7031b42b-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501"><num value="6501">§ 6501.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In this chapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id7031b42c-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/1"><num value="1">(1)</num><chapeau> “assistance” means the transfer of anything of value for a public purpose of support or stimulation that is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7031b42d-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/1/A"><num value="A">(A)</num><content> authorized by a law of the United States;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7031b42e-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/1/B"><num value="B">(B)</num><content> provided by the United States Government through grant or contractual arrangements (including technical assistance programs providing assistance by loan, loan guarantee, or insurance); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7031b42f-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/1/C"><num value="C">(C)</num><content> not an annual payment by the United States Government to the District of Columbia government under section 502 of the District of Columbia Home Rule Act (<ref href="/us/pl/93/198">Public Law 93–198</ref>, <ref href="/us/stat/87/813">87 Stat. 813</ref>, D.C. Code, § 47–3406).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7031b430-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/2"><num value="2">(2)</num><chapeau> “comprehensive planning” includes, to the extent directly related to area needs or needs of a unit of general local government—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id7031b431-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/2/A"><num value="A">(A)</num><chapeau> preparation, as a guide for governmental policies and action, of general plans on—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id7031b432-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/2/A/i"><num value="i">(i)</num><content> the pattern and intensity of land use;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7031b433-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/2/A/ii"><num value="ii">(ii)</num><content> providing public facilities (including transportation facilities) and other governmental services; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id7031b434-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/2/A/iii"><num value="iii">(iii)</num><content> the effective development and use of human and natural resources;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7031b435-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/2/B"><num value="B">(B)</num><content> long-range physical and fiscal plans for an action referred to in subparagraph (A);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7031b436-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/2/C"><num value="C">(C)</num><content> a program for capital improvements and other major expenditures based on their relative urgency, and definitive financing plans for the expenditures in the earlier years of the program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7031b437-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/2/D"><num value="D">(D)</num><content> coordination of related plans and activities of States and local governments and agencies concerned; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id7031b438-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/2/E"><num value="E">(E)</num><content> preparation of regulatory and administrative measures to support the items referred to in subparagraphs (A), (B), (C), and (D).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7031b439-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/3"><num value="3">(3)</num><content> “executive agency” does not include a mixed-ownership Government corporation.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7031b43a-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4"><num value="4">(4)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id7031b43b-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/A"><num value="A">(A)</num><chapeau> “grant” (except as provided in subparagraph (C)) means money, or property provided instead of money, that is paid or provided by the United States Government under a fixed annual or total authorization, to a State, to a local government, or to a beneficiary under a plan or program administered by a State or a local government that is subject to approval by an executive agency, if the authorization—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id7031b43c-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/A/i"><num value="i">(i)</num><content> requires the State or local government to expend non-Government money as a condition of receiving money or property from the United States Government; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id7031b43d-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/A/ii"><num value="ii">(ii)</num><content> specifies directly, or establishes by means of a formula, the amount that may be provided to the State or local government, or the amount to be allotted for use in each State by the State, local government, and beneficiaries.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id7031b43e-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/B"><num value="B">(B)</num><content> “grant” (except as provided in subparagraph (C)) also means money, or property provided instead of money, that is paid or provided by the United States Government to a private, nonprofit community organization eligible to receive amounts under the Community Services Block Grant Act (<ref href="/us/usc/t42/s9901">42 U.S.C. 9901</ref> et seq.).</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id7031b43f-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/C"><num value="C">(C)</num><chapeau> “grant” does not include—</chapeau><clause style="-uslm-lc:I13" class="indent2" id="id7031db50-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/C/i"><num value="i">(i)</num><content> shared revenue;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id7031db51-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/C/ii"><num value="ii">(ii)</num><content> payment of taxes;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id7031db52-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/C/iii"><num value="iii">(iii)</num><content> payment instead of taxes;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id7031db53-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/C/iv"><num value="iv">(iv)</num><content> a loan or repayable advance;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id7031db54-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/C/v"><num value="v">(v)</num><content> surplus property or surplus agricultural commodities provided as surplus property;</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id7031db55-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/C/vi"><num value="vi">(vi)</num><content> a payment under a research and development procurement contract or grant awarded directly and on similar terms to all qualifying organizations; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id7031db56-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/4/C/vii"><num value="vii">(vii)</num><content> a payment to a State or local government as complete reimbursement for costs incurred in paying benefits or providing services to persons entitled to them under a law of the United States.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7031db57-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/5"><num value="5">(5)</num><content> “head of a State agency” includes the designated delegate of the head of the agency.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7031db58-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/6"><num value="6">(6)</num><content> “local government” means a unit of general local government, a school district, or other special district established under State law.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7031db59-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/7"><num value="7">(7)</num><content> “Secretary” means the Secretary of the Treasury.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id7031db5a-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/8"><num value="8">(8)</num><content> “special-purpose unit of local government” means a special district, public-purpose local government of a State except a school district.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id7031db5b-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/9"><num value="9">(9)</num><content> “State” means a State of the United States, the District of Columbia, a territory or possession of the United States, and an agency, instrumentality, or fiscal agent of a State but does not mean a local government of a State.</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id7031db5c-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s6501/10"><num value="10">(10)</num><content> “unit of general local government” means a county, city, town, village, or other general purpose political subdivision of a State.</content>
