L. 103–322, title III, § 31001(a), Sept. 13, 1994, 108 Stat. 1874.)","seq_in_title":423,"parent_identifier":"/us/usc/t31/stV/ch67","ancestors":[{"identifier":"/us/usc/t31","level":"title","num":"Title 31—","heading":"MONEY AND FINANCE","status":null,"is_section":false},{"identifier":"/us/usc/t31/stV","level":"subtitle","num":"SUBTITLE V—","heading":"GENERAL ASSISTANCE ADMINISTRATION","status":null,"is_section":false},{"identifier":"/us/usc/t31/stV/ch67","level":"chapter","num":"CHAPTER 67—","heading":"FEDERAL PAYMENTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id7036bdd7-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s6711\"><num value=\"6711\">§ 6711.</num><heading> Prohibited discrimination</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7036bdd8-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s6711/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">General Prohibition</inline>.—</heading><content>No person in the United States shall be excluded from participating in, be denied the benefits of, or be subject to discrimination under, a program or activity of a unit of general local government because of race, color, national origin, or sex if the government receives a payment under this chapter.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7036bdd9-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s6711/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Additional Prohibitions</inline>.—</heading><chapeau>The following prohibitions and exemptions also apply to a program or activity of a unit of general local government if the government receives a payment under this chapter:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7036bdda-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s6711/b/1\"><num value=\"1\">(1)</num><content> A prohibition against discrimination because of age under the Age Discrimination Act of 1975.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7036bddb-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s6711/b/2\"><num value=\"2\">(2)</num><content> A prohibition against discrimination against an otherwise qualified handicapped individual under section 504 of the Rehabilitation Act of 1973.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7036bddc-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s6711/b/3\"><num value=\"3\">(3)</num><content> A prohibition against discrimination because of religion, or an exemption from that prohibition, under the Civil Rights Act of 1964 or title VIII of the Act of <date date=\"1968-04-11\">April 11, 1968</date> (popularly known as the Civil Rights Act of 1968).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7036bddd-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s6711/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Limitations on Applicability of Prohibitions</inline>.—</heading><content>Subsections (a) and (b) do not apply if the government shows, by clear and convincing evidence, that a payment received under this chapter is not used to pay for any part of the program or activity with respect to which the allegation of discrimination is made.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id7036e4ee-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s6711/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Investigation Agreements</inline>.—</heading><chapeau>The Secretary shall try to make agreements with heads of agencies of the United States Government and State agencies to investigate noncompliance with this section. An agreement shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7036e4ef-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s6711/d/1\"><num value=\"1\">(1)</num><content> describe the cooperative efforts to be taken (including sharing civil rights enforcement personnel and resources) to obtain compliance with this section; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id7036e4f0-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s6711/d/2\"><num value=\"2\">(2)</num><content> provide for notifying immediately the Secretary of actions brought by the United States Government or State agencies against a unit of general local government alleging a violation of a civil rights law or a regulation prescribed under a civil rights law.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id7036e4f1-b854-11e9-b72c-a5fb66e51517\">(Added <ref href=\"/us/pl/103/322/tIII/s31001/a\">Pub.
