L. 103–322, title III, § 31001(a), Sept. 13, 1994, 108 Stat. 1876.)","seq_in_title":425,"parent_identifier":"/us/usc/t31/stV/ch67","ancestors":[{"identifier":"/us/usc/t31","level":"title","num":"Title 31—","heading":"MONEY AND FINANCE","status":null,"is_section":false},{"identifier":"/us/usc/t31/stV","level":"subtitle","num":"SUBTITLE V—","heading":"GENERAL ASSISTANCE ADMINISTRATION","status":null,"is_section":false},{"identifier":"/us/usc/t31/stV/ch67","level":"chapter","num":"CHAPTER 67—","heading":"FEDERAL PAYMENTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id2d526767-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713\"><num value=\"6713\">§ 6713.</num><heading> Suspension and termination of payments in discrimination proceedings</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id2d526768-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/a\"><num value=\"a\">(a)</num><heading> <inline class=\"small-caps\">Imposition and Continuation of Suspensions.—</inline></heading><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2d526769-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/a/1\"><num value=\"1\">(1)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><chapeau>The Secretary shall suspend payment under this chapter to a unit of general local government—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2d52676a-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/a/1/A\"><num value=\"A\">(A)</num><content> if an administrative law judge appointed under <ref href=\"/us/usc/t5/s3105\">section 3105 of title 5</ref>, United States Code, issues a preliminary decision in a proceeding under section 6712(d)(1) that the government is not likely to prevail in showing compliance with section 6711(a) and (b);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2d52676b-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/a/1/B\"><num value=\"B\">(B)</num><content> if the administrative law judge decides at the end of the proceeding that the government has not complied with section 6711(a) or (b), unless the government makes a compliance agreement under section 6714 by the 30th day after the decision; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2d52676c-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/a/1/C\"><num value=\"C\">(C)</num><content> if required under section 6712(c).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2d52676d-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/a/2\"><num value=\"2\">(2)</num><heading> <inline class=\"small-caps\">Effectiveness</inline>.—</heading><content>A suspension already ordered under paragraph (1)(A) continues in effect if the administrative law judge makes a decision under paragraph (1)(B).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id2d52676e-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/b\"><num value=\"b\">(b)</num><heading> <inline class=\"small-caps\">Lifting of Suspensions and Terminations</inline>.—</heading><content>If a holding of discrimination is reversed by an appellate court, a suspension or termination of payments in a proceeding based on the holding shall be discontinued.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id2d52676f-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/c\"><num value=\"c\">(c)</num><heading> <inline class=\"small-caps\">Resumption of Payments Upon Attaining Compliance</inline>.—</heading><chapeau>The Secretary may resume payment to a unit of general local government of payments suspended by the Secretary only—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2d526770-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/c/1\"><num value=\"1\">(1)</num><chapeau> as of the time of, and under the conditions stated in—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2d526771-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/c/1/A\"><num value=\"A\">(A)</num><content> the approval by the Secretary of a compliance agreement under section 6714(a)(1); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2d526772-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/c/1/B\"><num value=\"B\">(B)</num><content> a compliance agreement entered into by the Secretary under section 6714(a)(2);</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2d526773-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/c/2\"><num value=\"2\">(2)</num><content> if the government complies completely with an order of a United States court, a State court, or administrative law judge that covers all matters raised in a notice of noncompliance submitted by the Secretary under section 6712(a);</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2d526774-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/c/3\"><num value=\"3\">(3)</num><content> if a United States court, a State court, or an administrative law judge decides (including a judge in a proceeding under section 6712(d)(1)), that the government has complied with sections <ref class=\"footnoteRef\" idref=\"fn002111\">1</ref><note type=\"footnote\" id=\"fn002111\"><num>1</num> So in original. Probably should be “section”.</note> 6711(a) and (b); or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2d528e85-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/c/4\"><num value=\"4\">(4)</num><content> if a suspension is discontinued under subsection (b).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id2d528e86-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/d\"><num value=\"d\">(d)</num><heading> <inline class=\"small-caps\">Payment of Damages as Compliance</inline>.—</heading><content>For purposes of subsection (c)(2), compliance by a government may consist of the payment of restitution to a person injured because the government did not comply with section 6711(a) or (b).</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id2d528e87-ec4e-11e9-b838-e2441a12bb26\" identifier=\"/us/usc/t31/s6713/e\"><num value=\"e\">(e)</num><heading> <inline class=\"small-caps\">Resumption of Payments Upon Reversal by Court</inline>.—</heading><content>The Secretary may resume payment to a unit of general local government of payments terminated under section 6712(d)(2)(A) only if the decision resulting in the termination is reversed by an appellate court.</content>\n</subsection>\n<sourceCredit id=\"id2d528e88-ec4e-11e9-b838-e2441a12bb26\">(Added <ref href=\"/us/pl/103/322/tIII/s31001/a\">Pub.
