and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id21fb4b3f-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s733/a/3/B\"><num value=\"B\">(B)</num><content> adjusted annually by the Comptroller General after taking into consideration the factors listed under <ref href=\"/us/usc/t31/s732/c/3\">section 732(c)(3) of this title</ref>, except that an adjustment under this subparagraph shall not be applied in the case of any officer or employee whose performance is not at a satisfactory level, as determined by the Comptroller General for purposes of such adjustment;</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id21fb4b40-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s733/a/4\"><num value=\"4\">(4)</num><content> providing a performance appraisal system consistent with subchapter II of chapter 43 of title 5;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id21fb4b41-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s733/a/5\"><num value=\"5\">(5)</num><content> allowing the Comptroller General to award ranks to officers and employees in the Office Senior Executive Service consistent with <ref href=\"/us/usc/t5/s4507\">section 4507 of title 5</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id21fd9532-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s733/a/6\"><num value=\"6\">(6)</num><content> providing for removal consistent with <ref href=\"/us/usc/t5/s3592\">section 3592 of title 5</ref>, and for removal or suspension consistent with <ref href=\"/us/usc/t5/s7543\">section 7543 of title 5</ref>;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id21fd9533-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s733/a/7\"><num value=\"7\">(7)</num><content> allowing the Comptroller General to reassign an officer or employee in the Office Senior Executive Service to any senior-level position established under <ref href=\"/us/usc/t31/s732a\">section 732a of this title</ref>, as the Comptroller General determines necessary and appropriate; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id21fd9534-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s733/a/8\"><num value=\"8\">(8)</num><content> allowing the Comptroller General to pay performance awards to officers and employees of the Office Senior Executive Service consistent with <ref href=\"/us/usc/t5/s5384\">section 5384 of title 5</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id21fd9535-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s733/b\"><num value=\"b\">(b)</num><content> Except as provided in subsection (a), the Comptroller General may apply any part of title 5 that applies to an applicant for or officer or employee in the Senior Executive Service under title 5 to the Office Senior Executive Service.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id21fd9536-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s733/c\"><num value=\"c\">(c)</num><content> The Office Senior Executive Service may include positions referred to in section 731(c), (e)(1), or (e)(2) of this title.</content>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id21fd9537-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s733/d\"><num value=\"d\">(d)</num><content> Section 732(b)(6), (c), (d)(1)–(4), and (e) of this title does not apply to the Office Senior Executive Service.</content>\n</subsection>\n<sourceCredit id=\"id21fd9538-3bf5-11e3-9fd0-985dd9cd422a\">(<ref href=\"/us/pl/97/258\">Pub.
