<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6fc4e8d7-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s773"><num value="773">§ 773.</num><heading> Election of survivor benefits</heading><subsection style="-uslm-lc:I11" class="indent0" id="id6fc4e8d8-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s773/a"><num value="a">(a)</num><content> To provide survivor benefits, a Comptroller General may elect in writing to reduce the pay and annuity of the Comptroller General. An election shall be made within 6 months of taking office or, if an election is made under <ref href="/us/usc/t31/s772/c">section 772(c) of this title</ref>, by the 60th day after making an election under section 772(c).</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6fc4e8d9-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s773/b"><num value="b">(b)</num><chapeau> A Comptroller General electing to provide survivor benefits shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6fc4e8da-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s773/b/1"><num value="1">(1)</num><content> have 4.5 percent of the pay received as Comptroller General and 5 percent of the annuity of the Comptroller General deducted; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fc4e8db-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s773/b/2"><num value="2">(2)</num><chapeau> deposit with the Government Accountability Office for redeposit in the Treasury as miscellaneous receipts—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6fc4e8dc-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s773/b/2/A"><num value="A">(A)</num><content> 4.5 percent of the pay and annuity received as Comptroller General before the deductions begin;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6fc4e8dd-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s773/b/2/B"><num value="B">(B)</num><content> 4.5 percent of basic pay received as a member of Congress or for other civilian service on which a surviving spouse’s annuity is computed under <ref href="/us/usc/t31/s774/d">section 774(d) of this title</ref>; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6fc4e8de-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s773/b/2/C"><num value="C">(C)</num><content> 4 percent interest before <date date="1948-01-01">January 1, 1948</date>, and 3 percent interest after <date date="1947-12-31">December 31, 1947</date>, compounded every December 31, on amounts deposited.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6fc4e8df-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s773/c"><num value="c">(c)</num><content> This subchapter does not prevent a surviving spouse or dependent child from receiving another annuity while receiving an annuity under <ref href="/us/usc/t31/s774">section 774 of this title</ref>. However, service used in computing an annuity under section 774 may not be used in computing the other annuity.</content>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6fc4e8e0-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s773/d"><num value="d">(d)</num><content> The reduction in the Comptroller General’s annuity under subsection (b)(1) for the purpose of providing survivor benefits shall be terminated for each full month after the death of the spouse.</content>
