<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id6fc50ff7-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774"><num value="774">§ 774.</num><heading> Survivor annuities</heading><subsection style="-uslm-lc:I11" class="indent0" id="id6fc50ff8-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/a"><num value="a">(a)</num><chapeau> In this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6fc50ff9-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/a/1"><num value="1">(1)</num><content> “allowable military service” means honorable active service of not more than 5 years in an armed force (including service in the National Guard when ordered to active duty for the United States Government), when the service is not creditable in computing another annuity.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fc50ffa-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/a/2"><num value="2">(2)</num><content> “other prior allowable service” means civilian service as an officer or employee of the Government or District of Columbia government not covered by subsection (d)(1) of this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fc5370b-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/a/3"><num value="3">(3)</num><content> “congressional employee” has the same meaning given that term in <ref href="/us/usc/t5/s2107">section 2107 of title 5</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6fc5370c-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/b"><num value="b">(b)</num><chapeau> A survivor annuity shall be paid under this subchapter when a Comptroller General—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6fc5370d-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/b/1"><num value="1">(1)</num><content> makes an election under <ref href="/us/usc/t31/s773">section 773 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fc5370e-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/b/2"><num value="2">(2)</num><content> dies in office or while receiving an annuity under <ref href="/us/usc/t31/s772">section 772 of this title</ref>;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fc5370f-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/b/3"><num value="3">(3)</num><content> had at least 18 months of civilian service at death computed under subsections (a) and (d) of this section; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fc53710-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/b/4"><num value="4">(4)</num><content> had deductions or deposits under <ref href="/us/usc/t31/s773">section 773 of this title</ref> made for the last 18 months of civilian service.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6fc53711-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/c"><num value="c">(c)</num><chapeau> If the Comptroller General or retired Comptroller General is survived—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6fc53712-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/c/1"><num value="1">(1)</num><content> only by a spouse, the surviving spouse shall receive an annuity computed under subsection (d) of this section beginning on the death of the Comptroller General or retired Comptroller General or when the spouse is 50 years of age, whichever is later;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fc53713-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/c/2"><num value="2">(2)</num><chapeau> by a spouse and a dependent child, the surviving spouse shall receive an immediate annuity computed under subsection (d) of this section and each dependent child shall receive an immediate annuity equal to the smaller of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6fc53714-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/c/2/A"><num value="A">(A)</num><content> 10 percent of the average annual pay computed under subsection (d)(1) of this section; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6fc53715-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/c/2/B"><num value="B">(B)</num><content> 20 percent of the average annual pay computed under subsection (d)(1) of this section, divided by the number of dependent children; or</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fc53716-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/c/3"><num value="3">(3)</num><chapeau> only by a dependent child, each dependent child shall receive an immediate annuity equal to the smaller of—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6fc53717-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/c/3/A"><num value="A">(A)</num><content> the annuity a surviving spouse would be entitled to receive under clause (2) of this subsection, divided by the number of dependent children;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6fc53718-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/c/3/B"><num value="B">(B)</num><content> 20 percent of the average annual pay computed under subsection (d)(1) of this section; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6fc53719-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/c/3/C"><num value="C">(C)</num><content> 40 percent of the average annual pay computed under subsection (d)(1) of this section, divided by the number of dependent children.</content>

</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6fc5371a-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/d"><num value="d">(d)</num><chapeau> The annuity of a surviving spouse is equal to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id6fc55e2b-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/d/1"><num value="1">(1)</num><chapeau> 1.5 percent of the average annual pay (based on the 3 years of highest pay received as Comptroller General and other prior allowable service) times—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id6fc55e2c-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/d/1/A"><num value="A">(A)</num><chapeau> the number of years of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id6fc55e2d-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/d/1/A/i"><num value="i">(i)</num><content> service as Comptroller General or a member of Congress; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id6fc55e2e-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/d/1/A/ii"><num value="ii">(ii)</num><content> prior allowable military service; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id6fc55e2f-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/d/1/B"><num value="B">(B)</num><content> not more than 15 years of prior allowable service as a congressional employee; plus</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id6fc55e30-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/d/2"><num value="2">(2)</num><content> .75 percent of the average pay computed under clause (1) of this subsection times the number of years of other allowable service.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I11" class="indent0" id="id6fc55e31-b854-11e9-b72c-a5fb66e51517" identifier="/us/usc/t31/s774/e"><num value="e">(e)</num><content> A surviving spouse’s annuity may not be more than 50 percent nor less than 25 percent of the average annual pay computed under subsection (d)(1) of this section. If a Comptroller General does not make the deposit under <ref href="/us/usc/t31/s773/b">section 773(b) of this title</ref>, a surviving spouse’s annuity shall be credited with the service during which a deposit was not made, unless the spouse elects not to have the service credited. However, the annuity shall be reduced by 10 percent of the amount of the unpaid deposit, computed on the date the Comptroller General or retired Comptroller General dies.</content>
