L. 97–258, Sept. 13, 1982, 96 Stat. 1049.)","seq_in_title":480,"parent_identifier":"/us/usc/t31/stVI/ch93","ancestors":[{"identifier":"/us/usc/t31","level":"title","num":"Title 31—","heading":"MONEY AND FINANCE","status":null,"is_section":false},{"identifier":"/us/usc/t31/stVI","level":"subtitle","num":"SUBTITLE VI—","heading":"MISCELLANEOUS","status":null,"is_section":false},{"identifier":"/us/usc/t31/stVI/ch93","level":"chapter","num":"CHAPTER 93—","heading":"SURETIES AND SURETY BONDS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id232c03b6-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s9307\"><num value=\"9307\">§ 9307.</num><heading> Civil actions and judgments against surety corporations</heading><subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id232c03b7-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s9307/a\"><num value=\"a\">(a)</num><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id232c03b8-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s9307/a/1\"><num value=\"1\">(1)</num><chapeau> A surety corporation providing a surety bond under <ref href=\"/us/usc/t31/s9304\">section 9304 of this title</ref> may be sued in a court of the United States having jurisdiction of civil actions on surety bonds in—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id232c03b9-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s9307/a/1/A\"><num value=\"A\">(A)</num><content> the judicial district in which the surety bond was provided; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id232c03ba-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s9307/a/1/B\"><num value=\"B\">(B)</num><content> the district in which the principal office of the corporation is located.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id232c03bb-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s9307/a/2\"><num value=\"2\">(2)</num><chapeau> Under sections 9304–9308 of this title, a surety bond is deemed to be provided in the district—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id232c03bc-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s9307/a/2/A\"><num value=\"A\">(A)</num><content> in which the principal office of the surety corporation is located;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id232c03bd-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s9307/a/2/B\"><num value=\"B\">(B)</num><content> to which the surety bond is returnable;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id232c03be-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s9307/a/2/C\"><num value=\"C\">(C)</num><content> in which the surety bond is filed; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id232c03bf-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s9307/a/2/D\"><num value=\"D\">(D)</num><content> in which the person required to provide a surety bond resided when the bond was provided.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id232c03c0-3bf5-11e3-9fd0-985dd9cd422a\" identifier=\"/us/usc/t31/s9307/b\"><num value=\"b\">(b)</num><content> In a proceeding against a surety corporation providing a surety bond under <ref href=\"/us/usc/t31/s9304\">section 9304 of this title</ref>, the corporation may not deny its power to provide a surety bond or to assume liability.</content>\n</subsection>\n<sourceCredit id=\"id232c03c1-3bf5-11e3-9fd0-985dd9cd422a\">(<ref href=\"/us/pl/97/258\">Pub. The words “in respect thereof” are omitted as surplus. The words “civil actions on surety bonds” are substituted for “actions or suits upon such recognizance, stipulation, bond, or undertaking” for consistency. In clause (A), the words “the surety bond was provided” are substituted for “such recognizance, stipulation, bond, or undertaking was made or guaranteed” for consistency.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">In subsection (a)(2), before clause (A), the words “a surety bond is deemed to be provided” are substituted for “such recognizance, stipulation, bond, or undertaking shall be treated as made or guaranteed” for consistency. In clause (A), the words “principal office of the surety corporation” are substituted for “office” for clarity and consistency.
