Regulations prescribed by the heads of executive agencies are subject to policies prescribed by the President and shall be as uniform as practicable. Each charge shall be—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id70416c0f-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s9701/b/1\"><num value=\"1\">(1)</num><content> fair; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id70416c10-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s9701/b/2\"><num value=\"2\">(2)</num><chapeau> based on—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id70416c11-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s9701/b/2/A\"><num value=\"A\">(A)</num><content> the costs to the Government;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id70416c12-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s9701/b/2/B\"><num value=\"B\">(B)</num><content> the value of the service or thing to the recipient;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id70416c13-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s9701/b/2/C\"><num value=\"C\">(C)</num><content> public policy or interest served; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id70416c14-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s9701/b/2/D\"><num value=\"D\">(D)</num><content> other relevant facts.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id70416c15-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s9701/c\"><num value=\"c\">(c)</num><chapeau> This section does not affect a law of the United States—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id70416c16-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s9701/c/1\"><num value=\"1\">(1)</num><content> prohibiting the determination and collection of charges and the disposition of those charges; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id70416c17-b854-11e9-b72c-a5fb66e51517\" identifier=\"/us/usc/t31/s9701/c/2\"><num value=\"2\">(2)</num><content> prescribing bases for determining charges, but a charge may be redetermined under this section consistent with the prescribed bases.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id70416c18-b854-11e9-b72c-a5fb66e51517\">(<ref href=\"/us/pl/97/258\">Pub. The words “(including groups, associations, organizations, partnerships, corporations, or businesses)” are omitted as being included in “person” under 1:1.</p>\n<p style=\"-uslm-lc:I21\" class=\"indent0\">In subsection (b), before clause (1), the words “may prescribe regulations establishing the charge for a service or thing of value provided by the agency” are substituted for “is authorized by regulation . . . to prescribe therefor such fee, charge, or price, if any, as he shall determine, in case none exists, or redetermine, in case of any existing one” for consistency, to eliminate unnecessary words, and because of the restatement. In clause (1), the words “and equitable” are omitted as being included in “fair”. In clause (2)(A), the words “direct and indirect” are omitted as surplus. In clause (2)(B), the words “of the service or thing” are added for clarity.
