<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id149bfc73-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904"><num value="1904">§ 1904.</num><heading> Certificates</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id149bfc74-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/a"><num value="a" class="bold">(a)</num><heading class="bold"> Issuance by authorized designees; restriction on issuance</heading><content><p style="-uslm-lc:I11" class="indent0">Except as provided in <ref href="/us/usc/t33/s1903/b/1">section 1903(b)(1) of this title</ref>, the Secretary shall designate those persons authorized to issue on behalf of the United States the certificates required by the MARPOL Protocol. A certificate required by the MARPOL Protocol shall not be issued to a ship which is registered in or of the nationality of a country which is not a party to the MARPOL Protocol.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id149bfc75-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/b"><num value="b" class="bold">(b)</num><heading class="bold"> Validity of foreign certificates</heading><content><p style="-uslm-lc:I11" class="indent0">A certificate issued by a country which is a party to the MARPOL Protocol has the same validity as a certificate issued by the Secretary or the Administrator under the authority of this chapter.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id149bfc76-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/c"><num value="c" class="bold">(c)</num><heading class="bold"> Location onboard vessel; inspection of vessels subject to jurisdiction of the United States</heading><chapeau>A ship required by the MARPOL Protocol to have a certificate—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id149bfc77-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/c/1"><num value="1">(1)</num><content> shall carry a valid certificate onboard in the manner prescribed by the authority issuing the certificate; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id149bfc78-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/c/2"><num value="2">(2)</num><content> is subject to inspection while in a port or terminal under the jurisdiction of the United States.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id149bfc79-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/d"><num value="d" class="bold">(d)</num><heading class="bold"> Onboard inspections; other Federal inspection authority unaffected</heading><content><p style="-uslm-lc:I11" class="indent0">An inspection conducted under subsection (c)(2) of this section is limited to verifying whether or not a valid certificate is onboard, unless clear grounds exist which reasonably indicate that the condition of the ship or its equipment does not substantially agree with the particulars of its certificate. This section shall not limit the authority of any official or employee of the United States under any other treaty, law, or regulation to board and inspect a ship or its equipment.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id149bfc7a-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/e"><num value="e" class="bold">(e)</num><heading class="bold"> Detention orders; duration of detention; shipyard option</heading><chapeau>In addition to the penalties prescribed in <ref href="/us/usc/t33/s1908">section 1908 of this title</ref>, a ship required by the MARPOL Protocol to have a certificate—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id149bfc7b-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/e/1"><num value="1">(1)</num><content> which does not have a valid certificate onboard; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id149bfc7c-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/e/2"><num value="2">(2)</num><content> whose condition or whose equipment’s condition does not substantially agree with the particulars of the certificate onboard;</content>
</paragraph>

<continuation style="-uslm-lc:I10" class="indent0 firstIndent0">shall be detained by order of the Secretary at the port or terminal where the violation is discovered until, in the opinion of the Secretary, the ship can proceed to sea without presenting an unreasonable threat of harm to the marine environment or the public health and welfare. The detention order may authorize the ship to proceed to the nearest appropriate available shipyard rather than remaining at the place where the violation was discovered.</continuation>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id149bfc7d-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/f"><num value="f" class="bold">(f)</num><heading class="bold"> Ship clearance or permits; refusal or revocation</heading><chapeau>If a ship is under a detention order under this section, the Secretary of the Treasury, upon the request of the Secretary, may refuse or revoke—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id149bfc7e-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/f/1"><num value="1">(1)</num><content> the clearance required by <ref href="/us/usc/t46/s60105">section 60105 of title 46</ref>; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id149bfc7f-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/f/2"><num value="2">(2)</num><content> a permit to proceed under section 4367 of the Revised Statutes of the United States (<ref href="/us/usc/t46/s313">46 U.S.C. 313</ref>) <ref class="footnoteRef" idref="fn002088">1</ref><note type="footnote" id="fn002088"><num>1</num> See References in Text note below.</note> or section 1443 <ref class="footnoteRef" idref="fn002089">2</ref><note type="footnote" id="fn002089"><num>2</num> See Codification note below.</note> of title 19.</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id149bfc80-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/g"><num value="g" class="bold">(g)</num><heading class="bold"> Review of detention orders; petition; determination by Secretary</heading><content><p style="-uslm-lc:I11" class="indent0">A person whose ship is subject to a detention order under this section may petition the Secretary, in the manner prescribed by regulation, to review the detention order. Upon receipt of a petition under this subsection, the Secretary shall affirm, modify, or withdraw the detention order within the time prescribed by regulation.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id149bfc81-ef14-11e6-a2f3-8a2b434a7bfe" identifier="/us/usc/t33/s1904/h"><num value="h" class="bold">(h)</num><heading class="bold"> Compensation for loss or damage</heading><content><p style="-uslm-lc:I11" class="indent0">A ship unreasonably detained or delayed by the Secretary acting under the authority of this chapter is entitled to compensation for any loss or damage suffered thereby.</p>
