L. 102–241, § 39, Dec. 19, 1991, 105 Stat. 2225.)","seq_in_title":1074,"parent_identifier":"/us/usc/t33/ch33","ancestors":[{"identifier":"/us/usc/t33","level":"title","num":"Title 33—","heading":"NAVIGATION AND NAVIGABLE WATERS","status":null,"is_section":false},{"identifier":"/us/usc/t33/ch33","level":"chapter","num":"CHAPTER 33—","heading":"PREVENTION OF POLLUTION FROM SHIPS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id91490741-7057-11eb-893c-bfbc632a41c7\" identifier=\"/us/usc/t33/s1906\"><num value=\"1906\">§ 1906.</num><heading> Incidents involving ships</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id91490742-7057-11eb-893c-bfbc632a41c7\" identifier=\"/us/usc/t33/s1906/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Requirement to report incident</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The master, person in charge, owner, charterer, manager, or operator of a ship involved in an incident shall report the incident in the manner prescribed by Article 8 of the Convention in accordance with regulations promulgated by the Secretary for that purpose.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id91490743-7057-11eb-893c-bfbc632a41c7\" identifier=\"/us/usc/t33/s1906/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Requirement to report discharge, probable discharge, or presence of oil</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The master or person in charge of—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id91490744-7057-11eb-893c-bfbc632a41c7\" identifier=\"/us/usc/t33/s1906/b/1\"><num value=\"1\">(1)</num><content> a ship of United States registry or nationality, or operated under the authority of the United States, wherever located;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id91490745-7057-11eb-893c-bfbc632a41c7\" identifier=\"/us/usc/t33/s1906/b/2\"><num value=\"2\">(2)</num><content> another ship while in the navigable waters of the United States; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id91490746-7057-11eb-893c-bfbc632a41c7\" identifier=\"/us/usc/t33/s1906/b/3\"><num value=\"3\">(3)</num><content> a sea port or oil handling facility subject to the jurisdiction of the United States,</content>\n</paragraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall report a discharge, probable discharge, or presence of oil in the manner prescribed by Article 4 of the International Convention on Oil Pollution Preparedness, Response and Cooperation, 1990 (adopted at London, <date date=\"1990-11-30\">November 30, 1990</date>), in accordance with regulations promulgated by the Secretary for that purpose.</continuation>\n</subsection>\n<sourceCredit id=\"id91490747-7057-11eb-893c-bfbc632a41c7\">(<ref href=\"/us/pl/96/478/s7\">Pub.
