<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id9149077f-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910"><num value="1910">§ 1910.</num><heading> Legal actions</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id91490780-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/a"><num value="a" class="bold">(a)</num><heading class="bold"> Persons with adversely affected interests as plaintiffs; defendants</heading><chapeau style="-uslm-lc:I11" class="indent0">Except as provided in subsection (b) of this section, any person having an interest which is, or can be, adversely affected, may bring an action on his own behalf—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91490781-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/a/1"><num value="1">(1)</num><content> against any person alleged to be in violation of the provisions of this chapter, or regulations issued hereunder;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91490782-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/a/2"><num value="2">(2)</num><content> against the Secretary where there is alleged a failure of the Secretary to perform any act or duty under this chapter which is not discretionary with the Secretary;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91490783-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/a/3"><num value="3">(3)</num><content> against the Administrator where there is alleged a failure of the Administrator to perform any act or duty under this chapter which is not discretionary; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91490784-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/a/4"><num value="4">(4)</num><content> against the Secretary of the Treasury where there is alleged a failure of the Secretary of the Treasury to take action under <ref href="/us/usc/t33/s1908/e">section 1908(e) of this title</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id91490785-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/b"><num value="b" class="bold">(b)</num><heading class="bold"> Commencement conditions</heading><chapeau style="-uslm-lc:I11" class="indent0">No action may be commenced under subsection (a) of this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91490786-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/b/1"><num value="1">(1)</num><content> prior to 60 days after the plaintiff has given notice, in writing and under oath, to the alleged violator, the Secretary concerned or the Administrator, and the Attorney General; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id91490787-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/b/2"><num value="2">(2)</num><content> if the Secretary or the Administrator has commenced enforcement or penalty action with respect to the alleged violation and is conducting such procedures diligently.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id91490788-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/c"><num value="c" class="bold">(c)</num><heading class="bold"> Venue</heading><chapeau style="-uslm-lc:I11" class="indent0">Any suit brought under this section shall be brought—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id91490789-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/c/1"><num value="1">(1)</num><content> in a case concerning an onshore facility or port, in the United States district court for the judicial district where the onshore facility or port is located;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9149078a-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/c/2"><num value="2">(2)</num><content> in a case concerning an offshore facility or offshore structure under the jurisdiction of the United States, in the United States district court for the judicial district nearest the offshore facility or offshore structure;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9149078b-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/c/3"><num value="3">(3)</num><content> in a case concerning a ship, in the United States district court for any judicial district wherein the ship or its owner or operator may be found; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id9149078c-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/c/4"><num value="4">(4)</num><content> in any case, in the District Court for the District of Columbia.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9149078d-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/d"><num value="d" class="bold">(d)</num><heading class="bold"> Costs; attorney fees; witness fees</heading><content><p style="-uslm-lc:I11" class="indent0">The court, in issuing any final order in any action brought pursuant to this section, may award costs of litigation (including reasonable attorney and expert witness fees) to any party including the Federal Government.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id9149078e-7057-11eb-893c-bfbc632a41c7" identifier="/us/usc/t33/s1910/e"><num value="e" class="bold">(e)</num><heading class="bold"> Federal intervention</heading><content><p style="-uslm-lc:I11" class="indent0">In any action brought under this section, if the Secretary or Attorney General are not parties of record, the United States, through the Attorney General, shall have the right to intervene.</p>
