<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id2797c295-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602"><num value="2602">§ 2602.</num><heading> Vessel permits and numbers</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2797c296-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau>A vessel (except a public vessel as defined in <ref href="/us/usc/t46/s2101">section 2101 of title 46</ref>) may not transport municipal or commercial waste in coastal waters without—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2797c297-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/a/1"><num value="1">(1)</num><content> a permit for that vessel from the Secretary of Transportation; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c298-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/a/2"><num value="2">(2)</num><content> displaying a number or other marking on the vessel as prescribed by the Secretary under chapter 123 or <ref href="/us/usc/t46/s12502/b">section 12502(b) of title 46</ref>.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2797c299-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b"><num value="b" class="bold">(b)</num><heading class="bold"> Permit applications</heading><chapeau>Application for a permit required by subsection (a) of this section shall be made by the vessel owner or operator and include—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2797c29a-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b/1"><num value="1">(1)</num><content> the name, address, and telephone number of the vessel owner and operator;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c29b-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b/2"><num value="2">(2)</num><content> the vessel’s name and identification number;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c29c-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b/3"><num value="3">(3)</num><content> the vessel’s area of operation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c29d-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b/4"><num value="4">(4)</num><content> the vessel’s transport capacity;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c29e-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b/5"><num value="5">(5)</num><chapeau> a history of the types of cargo transported by that vessel during the previous year, including identifying the type of municipal or commercial waste transported as—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2797c29f-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b/5/A"><num value="A">(A)</num><content> municipal waste;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2797c2a0-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b/5/B"><num value="B">(B)</num><content> commercial waste;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2797c2a1-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b/5/C"><num value="C">(C)</num><content> medical waste; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2797c2a2-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b/5/D"><num value="D">(D)</num><content> waste of another character.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2a3-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b/6"><num value="6">(6)</num><content> any other information the Secretary may require; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2a4-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/b/7"><num value="7">(7)</num><content> an acknowledgment.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2797c2a5-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/c"><num value="c" class="bold">(c)</num><heading class="bold"> Effective date of permits</heading><chapeau>A permit issued under this section—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2a6-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/c/1"><num value="1">(1)</num><content> is effective 30 days after the date on which it was issued;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2a7-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/c/2"><num value="2">(2)</num><content> may be issued only for a period of not more than 5 years after the effective date of the permit;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2a8-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/c/3"><num value="3">(3)</num><content> may be renewed for periods of not more than 5 years only by the vessel owner or operator that applied for the original permit; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2a9-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/c/4"><num value="4">(4)</num><content> is terminated when the vessel is sold.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2797c2aa-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/d"><num value="d" class="bold">(d)</num><heading class="bold"> Denial of permits</heading><chapeau>The Secretary may, or at the request of the Administrator shall, deny the issuance of a permit for any vessel if the owner or operator of the vessel has a record of a pattern of serious violations of—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2ab-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/d/1"><num value="1">(1)</num><content> this subchapter;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2ac-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/d/2"><num value="2">(2)</num><content> the Solid Waste Disposal Act (<ref href="/us/usc/t42/s6901">42 U.S.C. 6901</ref> et seq.);</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2ad-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/d/3"><num value="3">(3)</num><content> the Marine Protection, Research, and Sanctuaries Act of 1972 [<ref href="/us/usc/t16/s1431">16 U.S.C. 1431</ref> et seq., 1447 et seq.; <ref href="/us/usc/t33/s1401">33 U.S.C. 1401</ref> et seq., 2801 et seq.];</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2ae-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/d/4"><num value="4">(4)</num><content> the Rivers and Harbors Appropriation Act of 1899 (<ref href="/us/usc/t33/s401">33 U.S.C. 401</ref> et seq.); or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2af-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/d/5"><num value="5">(5)</num><content> the Federal Water Pollution Control Act (<ref href="/us/usc/t33/s1251">33 U.S.C. 1251</ref> et seq.).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2797c2b0-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/e"><num value="e" class="bold">(e)</num><heading class="bold"> Permit decision</heading><chapeau>The Secretary, after consultation with the Administrator, shall issue or deny a vessel permit under this section within 30 days after receiving a complete application. On denying the issuance of the permit for a vessel the Secretary shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2b1-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/e/1"><num value="1">(1)</num><content> notify the applicant of the denial and the reasons for the denial; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2797c2b2-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/e/2"><num value="2">(2)</num><content> provide an opportunity for a hearing on the denial.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2797c2b3-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/f"><num value="f" class="bold">(f)</num><heading class="bold"> Maintaining permit</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2797c2b4-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The permit issued for a vessel under this chapter shall be maintained in a manner prescribed by the Secretary.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2797c2b5-f67d-11e5-9f42-c848129ffd38" identifier="/us/usc/t33/s2602/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Endorsements</heading><content><p style="-uslm-lc:I12" class="indent1">If a vessel is a documented vessel, the Secretary may endorse a permit on the vessel’s certificate of documentation.</p>
