<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="idafaa4204-0612-11ea-8fdb-f04562b75a90" identifier="/us/usc/t33/s709c"><num value="709c">§ 709c.</num><heading> Emergency communication of risk</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idafaa4205-0612-11ea-8fdb-f04562b75a90" identifier="/us/usc/t33/s709c/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idafaa4206-0612-11ea-8fdb-f04562b75a90" identifier="/us/usc/t33/s709c/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Affected government</heading><content><p style="-uslm-lc:I12" class="indent1">The term “affected government” means a State, local, or tribal government with jurisdiction over an area that will be affected by a flood.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="idafaa4207-0612-11ea-8fdb-f04562b75a90" identifier="/us/usc/t33/s709c/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Annual operating plan</heading><content><p style="-uslm-lc:I12" class="indent1">The term “annual operating plan” means a plan prepared by the Secretary that describes potential water condition scenarios for a river basin for a year.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idafaa4208-0612-11ea-8fdb-f04562b75a90" identifier="/us/usc/t33/s709c/b"><num value="b" class="bold">(b)</num><heading class="bold"> Communication</heading><chapeau>In any river basin where the Secretary carries out flood risk management activities subject to an annual operating plan, the Secretary shall establish procedures for providing the public and affected governments, including Indian tribes, in the river basin with—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="idafaa4209-0612-11ea-8fdb-f04562b75a90" identifier="/us/usc/t33/s709c/b/1"><num value="1">(1)</num><content> timely information regarding expected water levels;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idafaa420a-0612-11ea-8fdb-f04562b75a90" identifier="/us/usc/t33/s709c/b/2"><num value="2">(2)</num><content> advice regarding appropriate preparedness actions;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idafaa420b-0612-11ea-8fdb-f04562b75a90" identifier="/us/usc/t33/s709c/b/3"><num value="3">(3)</num><content> technical assistance; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="idafaa420c-0612-11ea-8fdb-f04562b75a90" identifier="/us/usc/t33/s709c/b/4"><num value="4">(4)</num><content> any other information or assistance determined appropriate by the Secretary.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idafaa420d-0612-11ea-8fdb-f04562b75a90" identifier="/us/usc/t33/s709c/c"><num value="c" class="bold">(c)</num><heading class="bold"> Public availability of information</heading><content><p style="-uslm-lc:I11" class="indent0">To the maximum extent practicable, the Secretary, in coordination with the Administrator of the Federal Emergency Management Agency, shall make the information required under subsection (b) available to the public through widely used and readily available means, including on the Internet.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="idafaa420e-0612-11ea-8fdb-f04562b75a90" identifier="/us/usc/t33/s709c/d"><num value="d" class="bold">(d)</num><heading class="bold"> Procedures</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary shall use the procedures established under subsection (b) only when precipitation or runoff exceeds those calculations considered as the lowest risk to life and property contemplated by the annual operating plan.</p>
