value=\"10152\">§ 10152.</num><heading> Description</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id25fa25e3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Grants authorized</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id25fa25e4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">From amounts made available to carry out this part, the Attorney General may, in accordance with the formula established under <ref href=\"/us/usc/t34/s10156\">section 10156 of this title</ref>, make grants to States and units of local government, for use by the State or unit of local government to provide additional personnel, equipment, supplies, contractual support, training, technical assistance, and information systems for criminal justice, including for any one or more of the following programs:</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fa25e5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/a/1/A\"><num value=\"A\">(A)</num><content> Law enforcement programs.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fa4cf6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/a/1/B\"><num value=\"B\">(B)</num><content> Prosecution and court programs.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fa4cf7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/a/1/C\"><num value=\"C\">(C)</num><content> Prevention and education programs.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fa4cf8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/a/1/D\"><num value=\"D\">(D)</num><content> Corrections and community corrections programs.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fa4cf9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/a/1/E\"><num value=\"E\">(E)</num><content> Drug treatment and enforcement programs.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fa4cfa-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/a/1/F\"><num value=\"F\">(F)</num><content> Planning, evaluation, and technology improvement programs.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fa4cfb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/a/1/G\"><num value=\"G\">(G)</num><content> Crime victim and witness programs (other than compensation).</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fa4cfc-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/a/1/H\"><num value=\"H\">(H)</num><content> Mental health programs and related law enforcement and corrections programs, including behavioral programs and crisis intervention teams.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id25fa4cfd-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Rule of construction</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Paragraph (1) shall be construed to ensure that a grant under that paragraph may be used for any purpose for which a grant was authorized to be used under either or both of the programs specified in <ref href=\"/us/usc/t34/s10151/b\">section 10151(b) of this title</ref>, as those programs were in effect immediately before <date date=\"2006-01-05\">January 5, 2006</date>.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id25fa740e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Contracts and subawards</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">A State or unit of local government may, in using a grant under this part for purposes authorized by subsection (a), use all or a portion of that grant to contract with or make one or more subawards to one or more—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id25fa740f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/b/1\"><num value=\"1\">(1)</num><content> neighborhood or community-based organizations that are private and nonprofit; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id25fa7410-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/b/2\"><num value=\"2\">(2)</num><content> units of local government.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id25fa7411-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Program assessment component; waiver</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id25fa7412-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/c/1\"><num value=\"1\">(1)</num><content> Each program funded under this part shall contain a program assessment component, developed pursuant to guidelines established by the Attorney General, in coordination with the National Institute of Justice.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id25fa9b23-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/c/2\"><num value=\"2\">(2)</num><content> The Attorney General may waive the requirement of paragraph (1) with respect to a program if, in the opinion of the Attorney General, the program is not of sufficient size to justify a full program assessment.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id25fa9b24-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Prohibited uses</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding any other provision of this Act, no funds provided under this part may be used, directly or indirectly, to provide any of the following matters:</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id25fac235-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/d/1\"><num value=\"1\">(1)</num><content> Any security enhancements or any equipment to any nongovernmental entity that is not engaged in criminal justice or public safety.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id25fac236-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/d/2\"><num value=\"2\">(2)</num><chapeau> Unless the Attorney General certifies that extraordinary and exigent circumstances exist that make the use of such funds to provide such matters essential to the maintenance of public safety and good order—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fac237-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/d/2/A\"><num value=\"A\">(A)</num><content> vehicles (excluding police cruisers), vessels (excluding police boats), or aircraft (excluding police helicopters);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fae948-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/d/2/B\"><num value=\"B\">(B)</num><content> luxury items;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fae949-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/d/2/C\"><num value=\"C\">(C)</num><content> real estate;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fae94a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/d/2/D\"><num value=\"D\">(D)</num><content> construction projects (other than penal or correctional institutions); or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id25fae94b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/d/2/E\"><num value=\"E\">(E)</num><content> any similar matters.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id25fb105c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Administrative costs</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Not more than 10 percent of a grant made under this part may be used for costs incurred to administer such grant.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id25fb105d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Period</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The period of a grant made under this part shall be four years, except that renewals and extensions beyond that period may be granted at the discretion of the Attorney General.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id25fb105e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10152/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Rule of construction</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Subparagraph (d)(1) shall not be construed to prohibit the use, directly or indirectly, of funds provided under this part to provide security at a public event, such as a political convention or major sports event, so long as such security is provided under applicable laws and procedures.</p>\n</content>\n</subsection>\n<sourceCredit
