L. 115–36, § 5, June 2, 2017, 131 Stat. 852.)","seq_in_title":63,"parent_identifier":"/us/usc/t34/stI/ch101/schXI/ptA","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI","level":"subtitle","num":"Subtitle I—","heading":"Comprehensive Acts","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch101","level":"chapter","num":"CHAPTER 101—","heading":"JUSTICE SYSTEM IMPROVEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch101/schXI","level":"subchapter","num":"SUBCHAPTER XI—","heading":"PUBLIC SAFETY OFFICERS’ DEATH BENEFITS","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch101/schXI/ptA","level":"part","num":"Part A—","heading":"Death Benefits","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id26257b91-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10282\"><num value=\"10282\">§ 10282.</num><heading> Limitations on benefits</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26257b92-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10282/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">No benefit shall be paid under this subchapter—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26257b93-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10282/a/1\"><num value=\"1\">(1)</num><content> if the fatal or catastrophic injury was caused by the intentional misconduct of the public safety officer or by such officer’s intention to bring about his death, disability, or injury;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26257b94-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10282/a/2\"><num value=\"2\">(2)</num><content> if the public safety officer was voluntarily intoxicated at the time of his fatal or catastrophic injury;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26257b95-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10282/a/3\"><num value=\"3\">(3)</num><content> if the public safety officer was performing his duties in a grossly negligent manner at the time of his fatal or catastrophic injury;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26257b96-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10282/a/4\"><num value=\"4\">(4)</num><content> to any individual who would otherwise be entitled to a benefit under this subchapter if such individual’s actions were a substantial contributing factor to the fatal or catastrophic injury of the public safety officer; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26257b97-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10282/a/5\"><num value=\"5\">(5)</num><content> with respect to any individual employed in a capacity other than a civilian capacity.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2625a2a8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10282/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Presumption</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In determining whether a benefit is payable under this subchapter, the Bureau—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2625a2a9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10282/b/1\"><num value=\"1\">(1)</num><content> shall presume that none of the limitations described in subsection (a) apply; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2625a2aa-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10282/b/2\"><num value=\"2\">(2)</num><content> shall not determine that a limitation described in subsection (a) applies, absent clear and convincing evidence.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id2625a2ab-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/90/351/tI/s1202\">Pub.
