and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2636e00c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/a/1/B\"><num value=\"B\">(B)</num><content> the criteria by which the State proposes to assess the effectiveness of such activities on achieving the purposes of this subchapter, including the extent to which evidence-based approaches are utilized; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2636e00d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/a/2\"><num value=\"2\">(2)</num><content> assurances that the State and any unit of local government to which the State provides funding under <ref href=\"/us/usc/t34/s10404/b\">section 10404(b) of this title</ref>, has in effect (or shall have in effect, not later than 1 year after the date that the State submits such application) laws, or has implemented (or shall implement, not later than 1 year after the date that the State submits such application) policies and programs, that provide for a system of graduated sanctions described in subsection (d).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2637071e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Local eligibility</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2637071f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Subgrant eligibility</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">To be eligible to receive a subgrant, a unit of local government, other than a specially qualified unit, shall provide to the State—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26370720-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/b/1/A\"><num value=\"A\">(A)</num><chapeau> information about—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26370721-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/b/1/A/i\"><num value=\"i\">(i)</num><content> the activities proposed to be carried out with such subgrant; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26370722-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/b/1/A/ii\"><num value=\"ii\">(ii)</num><content> the criteria by which the unit proposes to assess the effectiveness of such activities on achieving the purposes of this subchapter, including the extent to which evidence-based approaches are utilized; and</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26370723-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/b/1/B\"><num value=\"B\">(B)</num><content> such assurances as the State shall require, that, to the maximum extent applicable, the unit of local government has in effect (or shall have in effect, not later than 1 year after the date that the unit submits such application) laws, or has implemented (or shall implement, not later than 1 year after the date that the unit submits such application) policies and programs, that provide for a system of graduated sanctions described in subsection (d).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26370724-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Special rule</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The requirements of paragraph (1) shall apply to a specially qualified unit that receives funds from the Attorney General under <ref href=\"/us/usc/t34/s10404/e\">section 10404(e) of this title</ref>, except that information that is otherwise required to be submitted to the State shall be submitted to the Attorney General.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26370725-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Role of courts</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">In the development of the grant application, the States and units of local governments shall take into consideration the needs of the judicial branch in strengthening the juvenile justice system and specifically seek the advice of the chief of the highest court of the State and where appropriate, the chief judge of the local court, with respect to the application.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26372e36-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Graduated sanctions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">A system of graduated sanctions, which may be discretionary as provided in subsection (e), shall ensure, at a minimum, that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26372e37-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/d/1\"><num value=\"1\">(1)</num><content> sanctions are imposed on a juvenile offender for each delinquent offense;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26372e38-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/d/2\"><num value=\"2\">(2)</num><content> sanctions escalate in intensity with each subsequent, more serious delinquent offense;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26372e39-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/d/3\"><num value=\"3\">(3)</num><content> there is sufficient flexibility to allow for individualized sanctions and services suited to the individual juvenile offender; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26372e3a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/d/4\"><num value=\"4\">(4)</num><content> appropriate consideration is given to public safety and victims of crime.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26372e3b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Discretionary use of sanctions</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26372e3c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Voluntary participation</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">A State or unit of local government may be eligible to receive a grant under this subchapter if—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26372e3d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/e/1/A\"><num value=\"A\">(A)</num><content> its system of graduated sanctions is discretionary; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26372e3e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/e/1/B\"><num value=\"B\">(B)</num><content> it demonstrates that it has promoted the use of a system of graduated sanctions by taking steps to encourage implementation of such a system by juvenile courts.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26372e3f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Reporting requirement if graduated sanctions not used</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26372e40-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/e/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Juvenile courts</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">A State or unit of local government in which the imposition of graduated sanctions is discretionary shall require each juvenile court within its jurisdiction—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26372e41-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/e/2/A/i\"><num value=\"i\">(i)</num><content> which has not implemented a system of graduated sanctions, to submit an annual report that explains why such court did not implement graduated sanctions; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26372e42-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/e/2/A/ii\"><num value=\"ii\">(ii)</num><content> which has implemented a system of graduated sanctions but has not imposed graduated sanctions in all cases, to submit an annual report that explains why such court did not impose graduated sanctions in all cases.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26375553-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/e/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Units of local government</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Each unit of local government, other than a specially qualified unit, that has 1 or more juvenile courts that use a discretionary system of graduated sanctions shall collect the information reported under subparagraph (A) for submission to the State each year.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26375554-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/e/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> States</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Each State and specially qualified unit that has 1 or more juvenile courts that use a discretionary system of graduated sanctions shall collect the information reported under subparagraph (A) for submission to the Attorney General each year. A State shall also collect and submit to the Attorney General the information collected under subparagraph (B).</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26375555-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26375556-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Discretionary</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “discretionary” means that a system of graduated sanctions is not required to be imposed by each and every juvenile court in a State or unit of local government.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26375557-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10403/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Sanctions</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “sanctions” means tangible, proportional consequences that hold the juvenile offender accountable for the offense committed.
