<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id2639ee0f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10423"><num value="10423">§ 10423.</num><heading> Review of State applications</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2639ee10-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10423/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">The Attorney General shall make a grant under <ref href="/us/usc/t34/s10421">section 10421 of this title</ref> to carry out the projects described in the application submitted under <ref href="/us/usc/t34/s10422">section 10422 of this title</ref> upon determining that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2639ee11-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10423/a/1"><num value="1">(1)</num><content> the application is consistent with the requirements of this subchapter; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2639ee12-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10423/a/2"><num value="2">(2)</num><content> before the approval of the application the Attorney General has made an affirmative finding in writing that the proposed project has been reviewed in accordance with this subchapter.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2639ee13-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10423/b"><num value="b" class="bold">(b)</num><heading class="bold"> Approval</heading><content><p style="-uslm-lc:I11" class="indent0">Each application submitted under <ref href="/us/usc/t34/s10422">section 10422 of this title</ref> shall be considered approved, in whole or in part, by the Attorney General not later than 90 days after first received unless the Attorney General informs the applicant of specific reasons for disapproval.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id263a1524-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10423/c"><num value="c" class="bold">(c)</num><heading class="bold"> Restriction</heading><content><p style="-uslm-lc:I11" class="indent0">Grant funds received under this subchapter shall not be used for land acquisition or construction projects.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id263a1525-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10423/d"><num value="d" class="bold">(d)</num><heading class="bold"> Disapproval notice and reconsideration</heading><content><p style="-uslm-lc:I11" class="indent0">The Attorney General shall not disapprove any application without first affording the applicant reasonable notice and an opportunity for reconsideration.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id263a1526-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10423/e"><num value="e" class="bold">(e)</num><heading class="bold"> Priority for partnerships with community-based drug treatment programs</heading><content><p style="-uslm-lc:I11" class="indent0">In considering an application submitted by a State under <ref href="/us/usc/t34/s10422">section 10422 of this title</ref>, the Attorney General shall give priority to an application that involves a partnership between the State and a community-based drug treatment program within the State.</p>
