<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id152747d7-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472"><num value="10472">§ 10472.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">In this subchapter—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id152747d8-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/1"><num value="1">(1)</num><chapeau> the term “mental illness” means a diagnosable mental, behavioral, or emotional disorder—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id152747d9-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/1/A"><num value="A">(A)</num><content> of sufficient duration to meet diagnostic criteria within the most recent edition of the Diagnostic and Statistical Manual of Mental Disorders published by the American Psychiatric Association; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id152747da-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/1/B"><num value="B">(B)</num><content> that has resulted in functional impairment that substantially interferes with or limits 1 or more major life activities;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id152747db-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/2"><num value="2">(2)</num><chapeau> the term “preliminarily qualified offender with mental illness, mental retardation, or co-occurring mental and substance abuse disorders” means a person who—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id152747dc-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/2/A"><num value="A">(A)</num><clause style="-uslm-lc:I13" class="indent2" id="id152747dd-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/2/A/i"><num value="i">(i)</num><content> previously or currently has been diagnosed by a qualified mental health professional as having a mental illness, mental retardation, or co-occurring mental illness and substance abuse disorders; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id152747de-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/2/A/ii"><num value="ii">(ii)</num><content> manifests obvious signs of mental illness, mental retardation, or co-occurring mental illness and substance abuse disorders during arrest or confinement or before any court; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id152747df-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/2/B"><num value="B">(B)</num><content> is deemed eligible by designated judges;</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id152747e0-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/3"><num value="3">(3)</num><chapeau> the term “court-ordered assisted outpatient treatment” means a program through which a court may order a treatment plan for an eligible patient that—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id152747e1-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/3/A"><num value="A">(A)</num><content> requires such patient to obtain outpatient mental health treatment while the patient is not currently residing in a correctional facility or inpatient treatment facility; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id152747e2-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/3/B"><num value="B">(B)</num><chapeau> is designed to improve access and adherence by such patient to intensive behavioral health services in order to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id152747e3-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/3/B/i"><num value="i">(i)</num><content> avert relapse, repeated hospitalizations, arrest, incarceration, suicide, property destruction, and violent behavior; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id152747e4-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/3/B/ii"><num value="ii">(ii)</num><content> provide such patient with the opportunity to live in a less restrictive alternative to incarceration or involuntary hospitalization; and</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id152747e5-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/4"><num value="4">(4)</num><chapeau> the term “eligible patient” means an adult, mentally ill person who, as determined by a court—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id152747e6-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/4/A"><num value="A">(A)</num><content> has a history of violence, incarceration, or medically unnecessary hospitalizations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id152747e7-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/4/B"><num value="B">(B)</num><content> without supervision and treatment, may be a danger to self or others in the community;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id152747e8-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/4/C"><num value="C">(C)</num><content> is substantially unlikely to voluntarily participate in treatment;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id152747e9-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/4/D"><num value="D">(D)</num><content> may be unable, for reasons other than indigence, to provide for any of his or her basic needs, such as food, clothing, shelter, health, or safety;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id152747ea-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/4/E"><num value="E">(E)</num><content> has a history of mental illness or a condition that is likely to substantially deteriorate if the person is not provided with timely treatment; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id152747eb-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10472/4/F"><num value="F">(F)</num><content> due to mental illness, lacks capacity to fully understand or lacks judgment to make informed decisions regarding his or her need for treatment, care, or supervision.</content>
