<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id1528ce54-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10513"><num value="10513">§ 10513.</num><heading> Application requirements</heading>
<chapeau style="-uslm-lc:I11" class="indent0">No grant may be made under this subchapter unless an application has been submitted to the Attorney General in which the applicant certifies that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id1528f565-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10513/1"><num value="1">(1)</num><content> DNA analyses performed at the laboratory will satisfy or exceed then current standards for a quality assurance program for DNA analysis issued by the Director of the Federal Bureau of Investigation under <ref href="/us/usc/t34/s12591">section 12591 of this title</ref>.<ref class="footnoteRef" idref="fn002047">1</ref><note type="footnote" id="fn002047"><num>1</num> So in original. </paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1528f566-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10513/2"><num value="2">(2)</num><chapeau> DNA samples obtained by and DNA analyses performed at the laboratory shall be made available only—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id1528f567-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10513/2/A"><num value="A">(A)</num><content> to criminal justice agencies for law enforcement identification purposes;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1528f568-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10513/2/B"><num value="B">(B)</num><content> in judicial proceedings, if otherwise admissible pursuant to applicable statutes or rules;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1528f569-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10513/2/C"><num value="C">(C)</num><content> for criminal defense purposes, to a defendant, who shall have access to samples and analyses performed in connection with the case in which the defendant is charged; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id1528f56a-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10513/2/D"><num value="D">(D)</num><content> if personally identifiable information is removed, for a population statistics database, for identification research and protocol development purposes, or for quality control purposes; and</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id1528f56b-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s10513/3"><num value="3">(3)</num><content> the laboratory and each analyst performing DNA analyses at the laboratory shall undergo semiannual external proficiency testing by a DNA proficiency testing program that meets the standards issued under <ref href="/us/usc/t34/s12591">section 12591 of this title</ref>.</content>
