<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id264d4ed9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564"><num value="10564">§ 10564.</num><heading> Use of grants</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id264d4eda-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">A State or unit of local government that receives a grant under this subchapter shall use the grant to do any one or more of the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id264d4edb-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/a/1"><num value="1">(1)</num><content> To carry out all or a substantial part of a program intended to improve the quality and timeliness of forensic science or medical examiner services in the State, including such services provided by the laboratories operated by the State and those operated by units of local government within the State.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id264d4edc-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/a/2"><num value="2">(2)</num><content> To eliminate a backlog in the analysis of forensic science evidence, including firearms examination, latent prints, impression evidence, toxicology, digital evidence, fire evidence, controlled substances, forensic pathology, questionable documents, and trace evidence.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id264d4edd-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/a/3"><num value="3">(3)</num><content> To train, assist, and employ forensic laboratory personnel and medicolegal death investigators, as needed, to eliminate such a backlog.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id264d4ede-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/a/4"><num value="4">(4)</num><content> To address emerging forensic science issues (such as statistics, contextual bias, and uncertainty of measurement) and emerging forensic science technology (such as high throughput automation, statistical software, and new types of instrumentation).</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id264d4edf-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/a/5"><num value="5">(5)</num><content> To educate and train forensic pathologists.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id264d4ee0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/a/6"><num value="6">(6)</num><content> To fund medicolegal death investigation systems to facilitate accreditation of medical examiner and coroner offices and certification of medicolegal death investigators.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id264d75f1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/b"><num value="b" class="bold">(b)</num><heading class="bold"> Permitted categories of funding</heading><chapeau style="-uslm-lc:I11" class="indent0">Subject to subsections (c) and (d), a grant awarded for the purpose set forth in subsection (a)(1)—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id264d75f2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/b/1"><num value="1">(1)</num><content> may only be used for program expenses relating to facilities, personnel, computerization, equipment, supplies, accreditation and certification, education, and training; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id264d75f3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/b/2"><num value="2">(2)</num><content> may not be used for any general law enforcement or nonforensic investigatory function.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id264d75f4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/c"><num value="c" class="bold">(c)</num><heading class="bold"> Facilities costs</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id264d75f5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> States receiving minimum grant amount</heading><content><p style="-uslm-lc:I12" class="indent1">With respect to a State that receives a grant under this subchapter (including grants received by units of local government within a State) in an amount that does not exceed 0.6 percent of the total amount made available to carry out this subchapter for a fiscal year, not more than 80 percent of the total amount of the grant may be used for the costs of any new facility constructed as part of a program described in subsection (a).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id264d75f6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Other States</heading><chapeau style="-uslm-lc:I12" class="indent1">With respect to a State that receives a grant under this subchapter in an amount that exceeds 0.6 percent of the total amount made available to carry out this subchapter for a fiscal year—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id264d75f7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/c/2/A"><num value="A">(A)</num><content> not more than 80 percent of the amount of the grant up to that 0.6 percent may be used for the costs of any new facility constructed as part of a program described in subsection (a); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264d75f8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/c/2/B"><num value="B">(B)</num><content> not more than 40 percent of the amount of the grant in excess of that 0.6 percent may be used for the costs of any new facility constructed as part of a program described in subsection (a).</content>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id264d75f9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/d"><num value="d" class="bold">(d)</num><heading class="bold"> Administrative costs</heading><content><p style="-uslm-lc:I11" class="indent0">Not more than 10 percent of the total amount of a grant awarded under this subchapter may be used for administrative expenses.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id264d75fa-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/e"><num value="e" class="bold">(e)</num><heading class="bold"> Backlog defined</heading><chapeau style="-uslm-lc:I11" class="indent0">For purposes of this section, a backlog in the analysis of forensic science evidence exists if such evidence—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id264d9d0b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/e/1"><num value="1">(1)</num><content> has been stored in a laboratory, medical examiner’s office, coroner’s office, law enforcement storage facility, or medical facility; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id264d9d0c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10564/e/2"><num value="2">(2)</num><content> has not been subjected to all appropriate forensic testing because of a lack of resources or personnel.</content>
