<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id264efc0e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611"><num value="10611">§ 10611.</num><heading> Grant authority</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id264efc0f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/a"><num value="a" class="bold">(a)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I11" class="indent0">The Attorney General may make grants to States, State courts, local courts, units of local government, and Indian tribal governments, acting directly or through agreements with other public or private entities, for adult drug courts, juvenile drug courts, family drug courts, and tribal drug courts that involve—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id264efc10-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/a/1"><num value="1">(1)</num><content> continuing judicial supervision over offenders, and other individuals under the jurisdiction of the court, with substance abuse problems, including co-occurring substance abuse and mental health problems, who are not violent offenders;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id264f2321-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/a/2"><num value="2">(2)</num><content> coordination with the appropriate State or local prosecutor; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id264f2322-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/a/3"><num value="3">(3)</num><chapeau> the integrated administration of other sanctions and services, which shall include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id264f2323-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/a/3/A"><num value="A">(A)</num><content> mandatory periodic testing for the use of controlled substances or other addictive substances during any period of supervised release or probation for each participant;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f2324-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/a/3/B"><num value="B">(B)</num><content> substance abuse treatment for each participant;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f2325-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/a/3/C"><num value="C">(C)</num><content> diversion, probation, or other supervised release involving the possibility of prosecution, confinement, or incarceration based on noncompliance with program requirements or failure to show satisfactory progress;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f2326-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/a/3/D"><num value="D">(D)</num><content> offender management, and aftercare services such as relapse prevention, health care, education, vocational training, job placement, housing placement, and child care or other family support services for each participant who requires such services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f2327-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/a/3/E"><num value="E">(E)</num><content> payment, in whole or part, by the offender of treatment costs, to the extent practicable, such as costs for urinalysis or counseling; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f2328-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/a/3/F"><num value="F">(F)</num><content> payment, in whole or part, by the offender of restitution, to the extent practicable, to either a victim of the offender’s offense or to a restitution or similar victim support fund.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id264f2329-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/b"><num value="b" class="bold">(b)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I11" class="indent0">Economic sanctions imposed on an offender pursuant to this section shall not be at a level that would interfere with the offender’s rehabilitation.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id264f232a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c"><num value="c" class="bold">(c)</num><heading class="bold"> Mandatory drug testing and mandatory sanctions</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id264f232b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Mandatory testing</heading><chapeau style="-uslm-lc:I12" class="indent1">Grant amounts under this subchapter may be used for a drug court only if the drug court has mandatory periodic testing as described in subsection (a)(3)(A). The Attorney General shall, by prescribing guidelines or regulations, specify standards for the timing and manner of complying with such requirements. The standards—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a3c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/1/A"><num value="A">(A)</num><chapeau> shall ensure that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id264f4a3d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/1/A/i"><num value="i">(i)</num><content> each participant is tested for every controlled substance that the participant has been known to abuse, and for any other controlled substance the Attorney General or the court may require; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id264f4a3e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/1/A/ii"><num value="ii">(ii)</num><content> the testing is accurate and practicable; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a3f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/1/B"><num value="B">(B)</num><content> may require approval of the drug testing regime to ensure that adequate testing occurs.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id264f4a40-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Mandatory sanctions</heading><chapeau style="-uslm-lc:I12" class="indent1">The Attorney General shall, by prescribing guidelines or regulations, specify that grant amounts under this subchapter may be used for a drug court only if the drug court imposes graduated sanctions that increase punitive measures, therapeutic measures, or both whenever a participant fails a drug test. Such sanctions and measures may include, but are not limited to, one or more of the following:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a41-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/A"><num value="A">(A)</num><content> Incarceration.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a42-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/B"><num value="B">(B)</num><content> Detoxification treatment.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a43-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/C"><num value="C">(C)</num><content> Residential treatment.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a44-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/D"><num value="D">(D)</num><content> Increased time in program.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a45-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/E"><num value="E">(E)</num><content> Termination from the program.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a46-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/F"><num value="F">(F)</num><content> Increased drug screening requirements.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a47-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/G"><num value="G">(G)</num><content> Increased court appearances.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a48-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/H"><num value="H">(H)</num><content> Increased counseling.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a49-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/I"><num value="I">(I)</num><content> Increased supervision.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a4a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/J"><num value="J">(J)</num><content> Electronic monitoring.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a4b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/K"><num value="K">(K)</num><content> In-home restriction.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id264f4a4c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10611/c/2/L"><num value="L">(L)</num><content> Community service.</content>
</subparagraph>
