L. 110–199, title I, § 103(a), Apr. 9, 2008, 122 Stat. 668.)","seq_in_title":190,"parent_identifier":"/us/usc/t34/stI/ch101/schXXX","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI","level":"subtitle","num":"Subtitle I—","heading":"Comprehensive Acts","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch101","level":"chapter","num":"CHAPTER 101—","heading":"JUSTICE SYSTEM IMPROVEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch101/schXXX","level":"subchapter","num":"SUBCHAPTER XXX—","heading":"DRUG COURTS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id264f987a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10613\"><num value=\"10613\">§ 10613.</num><heading> Definition</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id264f987b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10613/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Except as provided in subsection (b), in this subchapter, the term “violent offender” means a person who—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id264f987c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10613/a/1\"><num value=\"1\">(1)</num><chapeau> is charged with or convicted of an offense that is punishable by a term of imprisonment exceeding one year, during the course of which offense or conduct—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id264f987d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10613/a/1/A\"><num value=\"A\">(A)</num><content> the person carried, possessed, or used a firearm or dangerous weapon;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id264f987e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10613/a/1/B\"><num value=\"B\">(B)</num><content> there occurred the death of or serious bodily injury to any person; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id264f987f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10613/a/1/C\"><num value=\"C\">(C)</num><content> there occurred the use of force against the person of another, without regard to whether any of the circumstances described in subparagraph (A) or (B) is an element of the offense or conduct of which or for which the person is charged or convicted; or</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id264f9880-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10613/a/2\"><num value=\"2\">(2)</num><content> has 1 or more prior convictions for a felony crime of violence involving the use or attempted use of force against a person with the intent to cause death or serious bodily harm.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id264f9881-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10613/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Definition for purposes of juvenile drug courts</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">For purposes of juvenile drug courts, the term “violent offender” means a juvenile who has been convicted of, or adjudicated delinquent for, a felony-level offense that—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id264f9882-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10613/b/1\"><num value=\"1\">(1)</num><content> has as an element, the use, attempted use, or threatened use of physical force against the person or property of another, or the possession or use of a firearm; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id264f9883-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10613/b/2\"><num value=\"2\">(2)</num><content> by its nature, involves a substantial risk that physical force against the person or property of another may be used in the course of committing the offense.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id264f9884-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/90/351/tI/s2953\">Pub.
