<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id26536924-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651"><num value="10651">§ 10651.</num><heading> Adult and juvenile collaboration programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26536925-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section, the following definitions shall apply:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26536926-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Applicant</heading><content><p style="-uslm-lc:I12" class="indent1">The term “applicant” means States, units of local government, Indian tribes, and tribal organizations that apply for a grant under this section.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26536927-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Collaboration program</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “collaboration program” means a program to promote public safety by ensuring access to adequate mental health and other treatment services for mentally ill adults or juveniles that is overseen cooperatively by—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26536928-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/2/A"><num value="A">(A)</num><content> a criminal or juvenile justice agency or a mental health court; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26536929-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/2/B"><num value="B">(B)</num><content> a mental health agency.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2653692a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Criminal or juvenile justice agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “criminal or juvenile justice agency” means an agency of a State or local government or its contracted agency that is responsible for detection, arrest, enforcement, prosecution, defense, adjudication, incarceration, probation, or parole relating to the violation of the criminal laws of that State or local government.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2653692b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/4"><num value="4" class="bold">(4)</num><heading class="bold"> Diversion and alternative prosecution and sentencing</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2653692c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">The terms “diversion” and “alternative prosecution and sentencing” mean the appropriate use of effective mental health treatment alternatives to juvenile justice or criminal justice system institutional placements for preliminarily qualified offenders.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2653692d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Appropriate use</heading><content><p style="-uslm-lc:I13" class="indent2">In this paragraph, the term “appropriate use” includes the discretion of the judge or supervising authority, the leveraging of graduated sanctions to encourage compliance with treatment, and law enforcement diversion, including crisis intervention teams.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2653692e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> Graduated sanctions</heading><content><p style="-uslm-lc:I13" class="indent2">In this paragraph, the term “graduated sanctions” means an accountability-based graduated series of sanctions (including incentives, treatments, and services) applicable to mentally ill offenders within both the juvenile and adult justice system to hold individuals accountable for their actions and to protect communities by providing appropriate sanctions for inducing law-abiding behavior and preventing subsequent involvement in the criminal justice system.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2653903f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/5"><num value="5" class="bold">(5)</num><heading class="bold"> Mental health agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “mental health agency” means an agency of a State or local government or its contracted agency that is responsible for mental health services or co-occurring mental health and substance abuse services.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26539040-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/6"><num value="6" class="bold">(6)</num><heading class="bold"> Mental health court</heading><content><p style="-uslm-lc:I12" class="indent1">The term “mental health court” means a judicial program that meets the requirements of subchapter XXI of this chapter.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26539041-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/7"><num value="7" class="bold">(7)</num><heading class="bold"> Mental illness; mental health disorder</heading><chapeau style="-uslm-lc:I12" class="indent1">The terms “mental illness” and “mental health disorder” mean a diagnosable mental, behavioral, or emotional disorder—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26539042-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/7/A"><num value="A">(A)</num><content> of sufficient duration to meet diagnostic criteria within the most recent edition of the Diagnostic and Statistical Manual of Mental Disorders published by the American Psychiatric Association; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26539043-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/7/B"><num value="B">(B)</num><clause style="-uslm-lc:I13" class="indent2" id="id26539044-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/7/B/i"><num value="i">(i)</num><content> that, in the case of an adult, has resulted in functional impairment that substantially interferes with or limits 1 or more major life activities; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id26539045-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/7/B/ii"><num value="ii">(ii)</num><content> that, in the case of a juvenile, has resulted in functional impairment that substantially interferes with or limits the juvenile’s role or functioning in family, school, or community activities.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26539046-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/8"><num value="8" class="bold">(8)</num><heading class="bold"> Nonviolent offense</heading><content><p style="-uslm-lc:I12" class="indent1">The term “nonviolent offense” means an offense that does not have as an element the use, attempted use, or threatened use of physical force against the person or property of another or is not a felony that by its nature involves a substantial risk that physical force against the person or property of another may be used in the course of committing the offense.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2653b757-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9"><num value="9" class="bold">(9)</num><heading class="bold"> Preliminarily qualified offender</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2653b758-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “preliminarily qualified offender” means an adult or juvenile accused of an offense who—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2653b759-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/i"><num value="i">(i)</num><subclause style="-uslm-lc:I14" class="indent3" id="id2653b75a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/i/I"><num value="I">(I)</num><content> previously or currently has been diagnosed by a qualified mental health professional as having a mental illness or co-occurring mental illness and substance abuse disorders;</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id2653b75b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/i/II"><num value="II">(II)</num><content> manifests obvious signs of mental illness or co-occurring mental illness and substance abuse disorders during arrest or confinement or before any court; or</content>
</subclause>
<subclause style="-uslm-lc:I14" class="indent3" id="id2653b75c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/i/III"><num value="III">(III)</num><content> in the case of a veterans treatment court provided under subsection (i), has been diagnosed with, or manifests obvious signs of, mental illness or a substance abuse disorder or co-occurring mental illness and substance abuse disorder;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2653b75d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/ii"><num value="ii">(ii)</num><chapeau> has been unanimously approved for participation in a program funded under this section by, when appropriate—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id2653b75e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/ii/I"><num value="I">(I)</num><chapeau> the relevant—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id2653b75f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/ii/I/aa"><num value="aa">(aa)</num><content> prosecuting attorney;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id2653b760-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/ii/I/bb"><num value="bb">(bb)</num><content> defense attorney;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id2653b761-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/ii/I/cc"><num value="cc">(cc)</num><content> probation or corrections official; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id2653b762-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/ii/I/dd"><num value="dd">(dd)</num><content> judge; and</content>
</item>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2653b763-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/ii/II"><num value="II">(II)</num><content> a representative from the relevant mental health agency described in subsection (b)(5)(B)(i);</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2653b764-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/iii"><num value="iii">(iii)</num><content> has been determined, by each person described in clause (ii) who is involved in approving the adult or juvenile for participation in a program funded under this section, to not pose a risk of violence to any person in the program, or the public, if selected to participate in the program; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2653b765-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/iv"><num value="iv">(iv)</num><chapeau> has not been charged with or convicted of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id2653b766-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/iv/I"><num value="I">(I)</num><content> any sex offense (as defined in <ref href="/us/usc/t34/s20911">section 20911 of this title</ref>) or any offense relating to the sexual exploitation of children; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2653de77-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/A/iv/II"><num value="II">(II)</num><content> murder or assault with intent to commit murder.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2653de78-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/B"><num value="B" class="bold">(B)</num><heading class="bold"> Determination</heading><chapeau style="-uslm-lc:I13" class="indent2">In determining whether to designate a defendant as a preliminarily qualified offender, the relevant prosecuting attorney, defense attorney, probation or corrections official, judge, and mental health or substance abuse agency representative shall take into account—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2653de79-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/B/i"><num value="i">(i)</num><content> whether the participation of the defendant in the program would pose a substantial risk of violence to the community;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2653de7a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/B/ii"><num value="ii">(ii)</num><content> the criminal history of the defendant and the nature and severity of the offense for which the defendant is charged;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2653de7b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/B/iii"><num value="iii">(iii)</num><content> the views of any relevant victims to the offense;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2653de7c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/B/iv"><num value="iv">(iv)</num><content> the extent to which the defendant would benefit from participation in the program;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2653de7d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/B/v"><num value="v">(v)</num><content> the extent to which the community would realize cost savings because of the defendant’s participation in the program; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2653de7e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/9/B/vi"><num value="vi">(vi)</num><content> whether the defendant satisfies the eligibility criteria for program participation unanimously established by the relevant prosecuting attorney, defense attorney, probation or corrections official, judge and mental health or substance abuse agency representative.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2653de7f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/10"><num value="10" class="bold">(10)</num><heading class="bold"> Secretary</heading><content><p style="-uslm-lc:I12" class="indent1">The term “Secretary” means the Secretary of Health and Human Services.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2653de80-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/a/11"><num value="11" class="bold">(11)</num><heading class="bold"> Unit of local government</heading><content><p style="-uslm-lc:I12" class="indent1">The term “unit of local government” means any city, county, township, town, borough, parish, village, or other general purpose political subdivision of a State, including a State court, local court, or a governmental agency located within a city, county, township, town, borough, parish, or village.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2653de81-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b"><num value="b" class="bold">(b)</num><heading class="bold"> Planning and implementation grants</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2653de82-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Attorney General, in consultation with the Secretary, may award nonrenewable grants to eligible applicants to prepare a comprehensive plan for and implement an adult or juvenile collaboration program, which targets preliminarily qualified offenders in order to promote public safety and public health.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2653de83-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Purposes</heading><chapeau style="-uslm-lc:I12" class="indent1">Grants awarded under this section shall be used to create or expand—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26540594-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/2/A"><num value="A">(A)</num><content> mental health courts or other court-based programs for preliminarily qualified offenders;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26540595-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/2/B"><num value="B">(B)</num><content> programs that offer specialized training to the officers and employees of a criminal or juvenile justice agency and mental health personnel serving those with co-occurring mental illness and substance abuse problems in procedures for identifying the symptoms of preliminarily qualified offenders in order to respond appropriately to individuals with such illnesses;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26540596-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/2/C"><num value="C">(C)</num><chapeau> programs that support cooperative efforts by criminal and juvenile justice agencies and mental health agencies to promote public safety by offering mental health treatment services and, where appropriate, substance abuse treatment services for—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26540597-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/2/C/i"><num value="i">(i)</num><content> preliminarily qualified offenders with mental illness or co-occurring mental illness and substance abuse disorders; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26540598-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/2/C/ii"><num value="ii">(ii)</num><content> adult offenders with mental illness during periods of incarceration, while under the supervision of a criminal justice agency, or following release from correctional facilities; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26540599-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/2/D"><num value="D">(D)</num><content> programs that support intergovernmental cooperation between State and local governments with respect to the mentally ill offender.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2654059a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Applications</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2654059b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">To receive a planning grant or an implementation grant, the joint applicants shall prepare and submit a single application to the Attorney General at such time, in such manner, and containing such information as the Attorney General and the Secretary shall reasonably require. An application under subchapter XXI of this chapter may be made in conjunction with an application under this section.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2654059c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Combined planning and implementation grant application</heading><content><p style="-uslm-lc:I13" class="indent2">The Attorney General and the Secretary shall develop a procedure under which applicants may apply at the same time and in a single application for a planning grant and an implementation grant, with receipt of the implementation grant conditioned on successful completion of the activities funded by the planning grant.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2654059d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/4"><num value="4" class="bold">(4)</num><heading class="bold"> Planning grants</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2654059e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> Application</heading><content><p style="-uslm-lc:I13" class="indent2">The joint applicants may apply to the Attorney General for a nonrenewable planning grant to develop a collaboration program.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26542caf-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Contents</heading><content><p style="-uslm-lc:I13" class="indent2">The Attorney General and the Secretary may not approve a planning grant unless the application for the grant includes or provides, at a minimum, for a budget and a budget justification, a description of the outcome measures that will be used to measure the effectiveness of the program in promoting public safety and public health, the activities proposed (including the provision of substance abuse treatment services, where appropriate) and a schedule for completion of such activities, and the personnel necessary to complete such activities.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26542cb0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/4/C"><num value="C" class="bold">(C)</num><heading class="bold"> Period of grant</heading><content><p style="-uslm-lc:I13" class="indent2">A planning grant shall be effective for a period of 1 year, beginning on the first day of the month in which the planning grant is made. Applicants may not receive more than 1 such planning grant.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26542cb1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/4/D"><num value="D" class="bold">(D)</num><heading class="bold"> Collaboration set aside</heading><content><p style="-uslm-lc:I13" class="indent2">Up to 5 percent of all planning funds shall be used to foster collaboration between State and local governments in furtherance of the purposes set forth in the Mentally Ill Offender Treatment and Crime Reduction Act of 2004.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26542cb2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5"><num value="5" class="bold">(5)</num><heading class="bold"> Implementation grants</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26542cb3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/A"><num value="A" class="bold">(A)</num><heading class="bold"> Application</heading><content><p style="-uslm-lc:I13" class="indent2">Joint applicants that have prepared a planning grant application may apply to the Attorney General for approval of a nonrenewable implementation grant to develop a collaboration program.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26542cb4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/B"><num value="B" class="bold">(B)</num><heading class="bold"> Collaboration</heading><chapeau style="-uslm-lc:I13" class="indent2">To receive an implementation grant, the joint applicants shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26542cb5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/B/i"><num value="i">(i)</num><content> document that at least 1 criminal or juvenile justice agency (which can include a mental health court) and 1 mental health agency will participate in the administration of the collaboration program;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26542cb6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/B/ii"><num value="ii">(ii)</num><content> describe the responsibilities of each participating agency, including how each agency will use grant resources to provide supervision of offenders and jointly ensure that the provision of mental health treatment services and substance abuse services for individuals with co-occurring mental health and substance abuse disorders are coordinated, which may range from consultation or collaboration to integration in a single setting or treatment model;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26542cb7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/B/iii"><num value="iii">(iii)</num><content> in the case of an application from a unit of local government, document that a State mental health authority has provided comment and review; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id265453c8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/B/iv"><num value="iv">(iv)</num><chapeau> involve, to the extent practicable, in developing the grant application—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id265453c9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/B/iv/I"><num value="I">(I)</num><content> preliminarily qualified offenders;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id265453ca-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/B/iv/II"><num value="II">(II)</num><content> the families and advocates of such individuals under subclause (I); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id265453cb-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/B/iv/III"><num value="III">(III)</num><content> advocates for victims of crime.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id265453cc-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C"><num value="C" class="bold">(C)</num><heading class="bold"> Content</heading><chapeau style="-uslm-lc:I13" class="indent2">To be eligible for an implementation grant, joint applicants shall comply with the following:</chapeau><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id265453cd-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C/i"><num value="i" class="bold">(i)</num><heading class="bold"> Definition of target population</heading><chapeau style="-uslm-lc:I14" class="indent3">Applicants for an implementation grant shall—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id265453ce-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C/i/I"><num value="I">(I)</num><content> describe the population with mental illness or co-occurring mental illness and substance abuse disorders that is targeted for the collaboration program; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id265453cf-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C/i/II"><num value="II">(II)</num><content> develop guidelines that can be used by personnel of an adult or juvenile justice agency to identify preliminarily qualified offenders.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id265453d0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Services</heading><chapeau style="-uslm-lc:I14" class="indent3">Applicants for an implementation grant shall—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id265453d1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C/ii/I"><num value="I">(I)</num><content> ensure that preliminarily qualified offenders who are to receive treatment services under the collaboration program will first receive individualized, validated, needs-based assessments to determine, plan, and coordinate the most appropriate services for such individuals;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id265453d2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C/ii/II"><num value="II">(II)</num><content> specify plans for making mental health, or mental health and substance abuse, treatment services available and accessible to preliminarily qualified offenders at the time of their release from the criminal justice system, including outside of normal business hours;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id265453d3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C/ii/III"><num value="III">(III)</num><content> ensure that there are substance abuse personnel available to respond appropriately to the treatment needs of preliminarily qualified offenders;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id265453d4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C/ii/IV"><num value="IV">(IV)</num><content> determine eligibility for Federal benefits;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id265453d5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C/ii/V"><num value="V">(V)</num><content> ensure that preliminarily qualified offenders served by the collaboration program will have adequate supervision and access to effective and appropriate community-based mental health services, including, in the case of individuals with co-occurring mental health and substance abuse disorders, coordinated services, which may range from consultation or collaboration to integration in a single setting treatment model;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id26547ae6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C/ii/VI"><num value="VI">(VI)</num><content> make available, to the extent practicable, other support services that will ensure the preliminarily qualified offender’s successful reintegration into the community (such as housing, education, job placement, mentoring, and health care and benefits, as well as the services of faith-based and community organizations for mentally ill individuals served by the collaboration program); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id26547ae7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/C/ii/VII"><num value="VII">(VII)</num><content> include strategies, to the extent practicable, to address developmental and learning disabilities and problems arising from a documented history of physical or sexual abuse.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26547ae8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/D"><num value="D" class="bold">(D)</num><heading class="bold"> Housing and job placement</heading><content><p style="-uslm-lc:I13" class="indent2">Recipients of an implementation grant may use grant funds to assist mentally ill offenders compliant with the program in seeking housing or employment assistance.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26547ae9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/E"><num value="E" class="bold">(E)</num><heading class="bold"> Policies and procedures</heading><content><p style="-uslm-lc:I13" class="indent2">Applicants for an implementation grant shall strive to ensure prompt access to defense counsel by criminal defendants with mental illness who are facing charges that would trigger a constitutional right to counsel.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26547aea-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/F"><num value="F" class="bold">(F)</num><heading class="bold"> Financial</heading><chapeau style="-uslm-lc:I13" class="indent2">Applicants for an implementation grant shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26547aeb-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/F/i"><num value="i">(i)</num><content> explain the applicant’s inability to fund the collaboration program adequately without Federal assistance;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26547aec-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/F/ii"><num value="ii">(ii)</num><content> specify how the Federal support provided will be used to supplement, and not supplant, State, local, Indian tribe, or tribal organization sources of funding that would otherwise be available, including billing third-party resources for services already covered under programs (such as Medicaid, Medicare, and the State Children’s Insurance Program); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26547aed-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/F/iii"><num value="iii">(iii)</num><content> outline plans for obtaining necessary support and continuing the proposed collaboration program following the conclusion of Federal support.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26547aee-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/G"><num value="G" class="bold">(G)</num><heading class="bold"> Outcomes</heading><chapeau style="-uslm-lc:I13" class="indent2">Applicants for an implementation grant shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26547aef-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/G/i"><num value="i">(i)</num><content> identify methodology and outcome measures, as required by the Attorney General and the Secretary, to be used in evaluating the effectiveness of the collaboration program;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26547af0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/G/ii"><num value="ii">(ii)</num><content> ensure mechanisms are in place to capture data, consistent with the methodology and outcome measures under clause (i); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2654a201-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/G/iii"><num value="iii">(iii)</num><content> submit specific agreements from affected agencies to provide the data needed by the Attorney General and the Secretary to accomplish the evaluation under clause (i).</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2654a202-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/H"><num value="H" class="bold">(H)</num><heading class="bold"> State plans</heading><content><p style="-uslm-lc:I13" class="indent2">Applicants for an implementation grant shall describe how the adult or juvenile collaboration program relates to existing State criminal or juvenile justice and mental health plans and programs.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2654a203-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I"><num value="I" class="bold">(I)</num><heading class="bold"> Use of funds</heading><chapeau style="-uslm-lc:I13" class="indent2">Applicants that receive an implementation grant may use funds for 1 or more of the following purposes:</chapeau><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id2654a204-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I/i"><num value="i" class="bold">(i)</num><heading class="bold"> Mental health courts and diversion/alternative prosecution and sentencing programs</heading><content><p style="-uslm-lc:I14" class="indent3">Funds may be used to create or expand existing mental health courts that meet program requirements established by the Attorney General under subchapter XXI of this chapter, other court-based programs, or diversion and alternative prosecution and sentencing programs (including crisis intervention teams and treatment accountability services for communities) that meet requirements established by the Attorney General and the Secretary.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id2654a205-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Training</heading><chapeau style="-uslm-lc:I14" class="indent3">Funds may be used to create or expand programs, such as crisis intervention training, which offer specialized training to—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id2654a206-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I/ii/I"><num value="I">(I)</num><content> criminal justice system personnel to identify and respond appropriately to the unique needs of preliminarily qualified offenders; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2654a207-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I/ii/II"><num value="II">(II)</num><content> mental health system personnel to respond appropriately to the treatment needs of preliminarily qualified offenders.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id2654a208-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I/iii"><num value="iii" class="bold">(iii)</num><heading class="bold"> Service delivery</heading><content><p style="-uslm-lc:I14" class="indent3">Funds may be used to create or expand programs that promote public safety by providing the services described in subparagraph (C)(ii) to preliminarily qualified offenders.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id2654a209-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I/iv"><num value="iv" class="bold">(iv)</num><heading class="bold"> In-jail and transitional services</heading><content><p style="-uslm-lc:I14" class="indent3">Funds may be used to promote and provide mental health treatment and transitional services for those incarcerated or for transitional re-entry programs for those released from any penal or correctional institution.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id2654a20a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I/v"><num value="v" class="bold">(v)</num><heading class="bold"> Teams addressing frequent users of crisis services</heading><chapeau style="-uslm-lc:I14" class="indent3">Multidisciplinary teams that—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id2654a20b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I/v/I"><num value="I">(I)</num><content> coordinate, implement, and administer community-based crisis responses and long-term plans for frequent users of crisis services;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2654c91c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I/v/II"><num value="II">(II)</num><content> provide training on how to respond appropriately to the unique issues involving frequent users of crisis services for public service personnel, including criminal justice, mental health, substance abuse, emergency room, healthcare, law enforcement, corrections, and housing personnel;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2654c91d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I/v/III"><num value="III">(III)</num><content> develop or support alternatives to hospital and jail admissions for frequent users of crisis services that provide treatment, stabilization, and other appropriate supports in the least restrictive, yet appropriate, environment; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2654c91e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/I/v/IV"><num value="IV">(IV)</num><content> develop protocols and systems among law enforcement, mental health, substance abuse, housing, corrections, and emergency medical service operations to provide coordinated assistance to frequent users of crisis services.</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2654c91f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/b/5/J"><num value="J" class="bold">(J)</num><heading class="bold"> Geographic distribution of grants</heading><content><p style="-uslm-lc:I13" class="indent2">The Attorney General, in consultation with the Secretary, shall ensure that planning and implementation grants are equitably distributed among the geographical regions of the United States and between urban and rural populations.</p>
</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2654c920-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/c"><num value="c" class="bold">(c)</num><heading class="bold"> Priority</heading><chapeau style="-uslm-lc:I11" class="indent0">The Attorney General, in awarding funds under this section, shall give priority to applications that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2654c921-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/c/1"><num value="1">(1)</num><content> promote effective strategies by law enforcement to identify and to reduce risk of harm to mentally ill offenders and public safety;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2654c922-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/c/2"><num value="2">(2)</num><content> promote effective strategies for identification and treatment of female mentally ill offenders;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2654c923-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/c/3"><num value="3">(3)</num><content> promote effective strategies to expand the use of mental health courts, including the use of pretrial services and related treatment programs for offenders;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2654c924-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/c/4"><num value="4">(4)</num><content> propose interventions that have been shown by empirical evidence to reduce recidivism;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2654c925-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/c/5"><num value="5">(5)</num><content> when appropriate, use validated assessment tools to target preliminarily qualified offenders with a moderate or high risk of recidivism and a need for treatment and services; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2654c926-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/c/6"><num value="6">(6)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id2654c927-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/c/6/A"><num value="A">(A)</num><content> demonstrate the strongest commitment to ensuring that such funds are used to promote both public health and public safety;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id2654f038-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/c/6/B"><num value="B">(B)</num><content> demonstrate the active participation of each co-applicant in the administration of the collaboration program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id2654f039-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/c/6/C"><num value="C">(C)</num><content> document, in the case of an application for a grant to be used in whole or in part to fund treatment services for adults or juveniles during periods of incarceration or detention, that treatment programs will be available to provide transition and reentry services for such individuals; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id2654f03a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/c/6/D"><num value="D">(D)</num><content> have the support of both the Attorney General and the Secretary.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2654f03b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/d"><num value="d" class="bold">(d)</num><heading class="bold"> Matching requirements</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2654f03c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Federal share</heading><chapeau style="-uslm-lc:I12" class="indent1">The Federal share of the cost of a collaboration program carried out by a State, unit of local government, Indian tribe, or tribal organization under this section shall not exceed—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2654f03d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/d/1/A"><num value="A">(A)</num><content> 80 percent of the total cost of the program during the first 2 years of the grant;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2654f03e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/d/1/B"><num value="B">(B)</num><content> 60 percent of the total cost of the program in year 3; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2654f03f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/d/1/C"><num value="C">(C)</num><content> 25 percent of the total cost of the program in years 4 and 5.</content>
</subparagraph>
</paragraph>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2654f041-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/e"><num value="e" class="bold">(e)</num><heading class="bold"> Federal use of funds</heading><chapeau style="-uslm-lc:I11" class="indent0">The Attorney General, in consultation with the Secretary, in administering grants under this section, shall use not less than 6 percent of funds appropriated to—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2654f042-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/e/1"><num value="1">(1)</num><content> research the use of alternatives to prosecution through pretrial diversion in appropriate cases involving individuals with mental illness;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2654f043-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/e/2"><num value="2">(2)</num><content> offer specialized training to personnel of criminal and juvenile justice agencies in appropriate diversion techniques;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2654f044-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/e/3"><num value="3">(3)</num><content> provide technical assistance to local governments, mental health courts, and diversion programs, including technical assistance relating to program evaluation;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2654f045-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/e/4"><num value="4">(4)</num><content> help localities build public understanding and support for community reintegration of individuals with mental illness;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2654f046-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/e/5"><num value="5">(5)</num><content> develop a uniform program evaluation process; and</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2654f047-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/e/6"><num value="6">(6)</num><content> conduct a national evaluation of the collaboration program that will include an assessment of its cost-effectiveness.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26551758-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/f"><num value="f" class="bold">(f)</num><heading class="bold"> Interagency task force</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26551759-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/f/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Attorney General and the Secretary shall establish an interagency task force with the Secretaries of Housing and Urban Development, Labor, Education, and Veterans Affairs and the Commissioner of Social Security, or their designees.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2655175a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/f/2"><num value="2" class="bold">(2)</num><heading class="bold"> Responsibilities</heading><chapeau style="-uslm-lc:I12" class="indent1">The task force established under paragraph (1) shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2655175b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/f/2/A"><num value="A">(A)</num><content> identify policies within their departments that hinder or facilitate local collaborative initiatives for preliminarily qualified offenders; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2655175c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/f/2/B"><num value="B">(B)</num><content> submit, not later than 2 years after <date date="2004-10-30">October 30, 2004</date>, a report to Congress containing recommendations for improved interdepartmental collaboration regarding the provision of services to preliminarily qualified offenders.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2655175d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/g"><num value="g" class="bold">(g)</num><heading class="bold"> Collaboration set-aside</heading><content><p style="-uslm-lc:I11" class="indent0">The Attorney General shall use not less than 8 percent of funds appropriated to provide technical assistance to State and local governments receiving grants under this subchapter to foster collaboration between such governments in furtherance of the purposes set forth in section 3 of the Mentally Ill Offender Treatment and Crime Reduction Act of 2004 (<ref href="/us/usc/t34/s10651">34 U.S.C. 10651</ref> note).</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2655175e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/h"><num value="h" class="bold">(h)</num><heading class="bold"> Law enforcement response to mentally ill offenders improvement grants</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2655175f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/h/1"><num value="1" class="bold">(1)</num><heading class="bold"> Authorization</heading><chapeau style="-uslm-lc:I12" class="indent1">The Attorney General is authorized to make grants under this section to States, units of local government, Indian tribes, and tribal organizations for the following purposes:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26551760-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/h/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Training programs</heading><content><p style="-uslm-lc:I13" class="indent2">To provide for programs that offer law enforcement personnel specialized and comprehensive training in procedures to identify and respond appropriately to incidents in which the unique needs of individuals with mental illnesses are involved.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26551761-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/h/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Receiving centers</heading><content><p style="-uslm-lc:I13" class="indent2">To provide for the development of specialized receiving centers to assess individuals in the custody of law enforcement personnel for suicide risk and mental health and substance abuse treatment needs.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26553d72-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/h/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Improved technology</heading><content><p style="-uslm-lc:I13" class="indent2">To provide for computerized information systems (or to improve existing systems) to provide timely information to law enforcement personnel and criminal justice system personnel to improve the response of such respective personnel to mentally ill offenders.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26553d73-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/h/1/D"><num value="D" class="bold">(D)</num><heading class="bold"> Cooperative programs</heading><content><p style="-uslm-lc:I13" class="indent2">To provide for the establishment and expansion of cooperative efforts by criminal and juvenile justice agencies and mental health agencies to promote public safety through the use of effective intervention with respect to mentally ill offenders.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26553d74-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/h/1/E"><num value="E" class="bold">(E)</num><heading class="bold"> Campus security personnel training</heading><content><p style="-uslm-lc:I13" class="indent2">To provide for programs that offer campus security personnel training in procedures to identify and respond appropriately to incidents in which the unique needs of individuals with mental illnesses are involved.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26553d75-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/h/1/F"><num value="F" class="bold">(F)</num><heading class="bold"> Academy training</heading><content><p style="-uslm-lc:I13" class="indent2">To provide support for academy curricula, law enforcement officer orientation programs, continuing education training, and other programs that teach law enforcement personnel how to identify and respond to incidents involving persons with mental health disorders or co-occurring mental health and substance abuse disorders.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26553d76-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/h/2"><num value="2" class="bold">(2)</num><heading class="bold"> BJA training models</heading><content><p style="-uslm-lc:I12" class="indent1">For purposes of paragraph (1)(A), the Director of the Bureau of Justice Assistance shall develop training models for training law enforcement personnel in procedures to identify and respond appropriately to incidents in which the unique needs of individuals with mental illnesses are involved, including suicide prevention.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26553d77-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/h/3"><num value="3" class="bold">(3)</num><heading class="bold"> Matching funds</heading><content><p style="-uslm-lc:I12" class="indent1">The Federal share of funds for a program funded by a grant received under this subsection may not exceed 50 percent of the costs of the program. The non-Federal share of payments made for such a program may be made in cash or in-kind fairly evaluated, including planned equipment or services.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26553d78-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/h/4"><num value="4" class="bold">(4)</num><heading class="bold"> Priority consideration</heading><content><p style="-uslm-lc:I12" class="indent1">The Attorney General, in awarding grants under this subsection, shall give priority to programs that law enforcement personnel and members of the mental health and substance abuse professions develop and administer cooperatively.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26553d79-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i"><num value="i" class="bold">(i)</num><heading class="bold"> Assisting veterans</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26553d7a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I12" class="indent1">In this subsection:</chapeau><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2655648b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Peer-to-peer services or programs</heading><content><p style="-uslm-lc:I13" class="indent2">The term “peer-to-peer services or programs” means services or programs that connect qualified veterans with other veterans for the purpose of providing support and mentorship to assist qualified veterans in obtaining treatment, recovery, stabilization, or rehabilitation.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2655648c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Qualified veteran</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “qualified veteran” means a preliminarily qualified offender who—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2655648d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/1/B/i"><num value="i">(i)</num><content> served on active duty in any branch of the Armed Forces, including the National Guard or Reserves; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2655648e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/1/B/ii"><num value="ii">(ii)</num><content> was discharged or released from such service under conditions other than dishonorable, unless the reason for the dishonorable discharge was attributable to a substance abuse disorder.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2655648f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Veterans treatment court program</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “veterans treatment court program” means a court program involving collaboration among criminal justice, veterans, and mental health and substance abuse agencies that provides qualified veterans with—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26556490-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/1/C/i"><num value="i">(i)</num><content> intensive judicial supervision and case management, which may include random and frequent drug testing where appropriate;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26556491-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/1/C/ii"><num value="ii">(ii)</num><content> a full continuum of treatment services, including mental health services, substance abuse services, medical services, and services to address trauma;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26556492-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/1/C/iii"><num value="iii">(iii)</num><content> alternatives to incarceration; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26556493-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/1/C/iv"><num value="iv">(iv)</num><content> other appropriate services, including housing, transportation, mentoring, employment, job training, education, or assistance in applying for and obtaining available benefits.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26556494-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/2"><num value="2" class="bold">(2)</num><heading class="bold"> Veterans assistance program</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26556495-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">The Attorney General, in consultation with the Secretary of Veterans Affairs, may award grants under this subsection to applicants to establish or expand—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26556496-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/2/A/i"><num value="i">(i)</num><content> veterans treatment court programs;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26556497-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/2/A/ii"><num value="ii">(ii)</num><content> peer-to-peer services or programs for qualified veterans;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26556498-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/2/A/iii"><num value="iii">(iii)</num><content> practices that identify and provide treatment, rehabilitation, legal, transitional, and other appropriate services to qualified veterans who have been incarcerated; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26556499-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/2/A/iv"><num value="iv">(iv)</num><content> training programs to teach criminal justice, law enforcement, corrections, mental health, and substance abuse personnel how to identify and appropriately respond to incidents involving qualified veterans.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26558baa-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Priority</heading><chapeau style="-uslm-lc:I13" class="indent2">In awarding grants under this subsection, the Attorney General shall give priority to applications that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26558bab-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/2/B/i"><num value="i">(i)</num><content> demonstrate collaboration between and joint investments by criminal justice, mental health, substance abuse, and veterans service agencies;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26558bac-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/2/B/ii"><num value="ii">(ii)</num><content> promote effective strategies to identify and reduce the risk of harm to qualified veterans and public safety; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26558bad-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/i/2/B/iii"><num value="iii">(iii)</num><content> propose interventions with empirical support to improve outcomes for qualified veterans.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26558bae-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/j"><num value="j" class="bold">(j)</num><heading class="bold"> Forensic assertive community treatment (FACT) initiative program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26558baf-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/j/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">The Attorney General may make grants to States, units of local government, territories, Indian Tribes, nonprofit agencies, or any combination thereof, to develop, implement, or expand Assertive Community Treatment initiatives to develop forensic assertive community treatment (referred to in this subsection as “FACT”) programs that provide high intensity services in the community for individuals with mental illness with involvement in the criminal justice system to prevent future incarcerations.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26558bb0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/j/2"><num value="2" class="bold">(2)</num><heading class="bold"> Allowable uses</heading><chapeau style="-uslm-lc:I12" class="indent1">Grant funds awarded under this subsection may be used for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26558bb1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/j/2/A"><num value="A">(A)</num><content> multidisciplinary team initiatives for individuals with mental illnesses with criminal justice involvement that address criminal justice involvement as part of treatment protocols;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26558bb2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/j/2/B"><num value="B">(B)</num><content> FACT programs that involve mental health professionals, criminal justice agencies, chemical dependency specialists, nurses, psychiatrists, vocational specialists, forensic peer specialists, forensic specialists, and dedicated administrative support staff who work together to provide recovery oriented, 24/7 wraparound services;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26558bb3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/j/2/C"><num value="C">(C)</num><content> services such as integrated evidence-based practices for the treatment of co-occurring mental health and substance-related disorders, assertive outreach and engagement, community-based service provision at participants’ residence or in the community, psychiatric rehabilitation, recovery oriented services, services to address criminogenic risk factors, and community tenure;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2655b2c4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/j/2/D"><num value="D">(D)</num><content> payments for treatment providers that are approved by the State or Indian Tribe and licensed, if necessary, to provide needed treatment to eligible offenders participating in the program, including behavioral health services and aftercare supervision; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2655b2c5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/j/2/E"><num value="E">(E)</num><content> training for all FACT teams to promote high-fidelity practice principles and technical assistance to support effective and continuing integration with criminal justice agency partners.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2655b2c6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/j/3"><num value="3" class="bold">(3)</num><heading class="bold"> Supplement and not supplant</heading><content><p style="-uslm-lc:I12" class="indent1">Grants made under this subsection shall be used to supplement, and not supplant, non-Federal funds that would otherwise be available for programs described in this subsection.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2655b2c7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/j/4"><num value="4" class="bold">(4)</num><heading class="bold"> Applications</heading><content><p style="-uslm-lc:I12" class="indent1">To request a grant under this subsection, a State, unit of local government, territory, Indian Tribe, or nonprofit agency shall submit an application to the Attorney General in such form and containing such information as the Attorney General may reasonably require.</p>
</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2655b2c8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k"><num value="k" class="bold">(k)</num><heading class="bold"> Sequential intercept grants</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2655b2c9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definition</heading><content><p style="-uslm-lc:I12" class="indent1">In this subsection, the term “eligible entity” means a State, unit of local government, Indian tribe, or tribal organization.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2655b2ca-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/2"><num value="2" class="bold">(2)</num><heading class="bold"> Authorization</heading><content><p style="-uslm-lc:I12" class="indent1">The Attorney General may make grants under this subsection to an eligible entity for sequential intercept mapping and implementation in accordance with paragraph (3).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2655b2cb-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3"><num value="3" class="bold">(3)</num><heading class="bold"> Sequential intercept mapping; implementation</heading><chapeau style="-uslm-lc:I12" class="indent1">An eligible entity that receives a grant under this subsection may use funds for—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2655b2cc-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A"><num value="A">(A)</num><chapeau> sequential intercept mapping, which—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2655b2cd-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A/i"><num value="i">(i)</num><chapeau> shall consist of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id2655b2ce-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A/i/I"><num value="I">(I)</num><chapeau> convening mental health and criminal justice stakeholders to—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id2655b2cf-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A/i/I/aa"><num value="aa">(aa)</num><content> develop a shared understanding of the flow of justice-involved individuals with mental illnesses through the criminal justice system; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id2655b2d0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A/i/I/bb"><num value="bb">(bb)</num><content> identify opportunities for improved collaborative responses to the risks and needs of individuals described in item (aa); and</content>
</item>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2655b2d1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A/i/II"><num value="II">(II)</num><chapeau> developing strategies to address gaps in services and bring innovative and effective programs to scale along multiple intercepts, including—</chapeau><item style="-uslm-lc:I580434" class="indent5" id="id2655d9e2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A/i/II/aa"><num value="aa">(aa)</num><content> emergency and crisis services;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id2655d9e3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A/i/II/bb"><num value="bb">(bb)</num><content> specialized police-based responses;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id2655d9e4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A/i/II/cc"><num value="cc">(cc)</num><content> court hearings and disposition alternatives;</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id2655d9e5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A/i/II/dd"><num value="dd">(dd)</num><content> reentry from jails and prisons; and</content>
</item>
<item style="-uslm-lc:I580434" class="indent5" id="id2655d9e6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A/i/II/ee"><num value="ee">(ee)</num><content> community supervision, treatment and support services; and</content>
</item>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2655d9e7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/A/ii"><num value="ii">(ii)</num><content> may serve as a starting point for the development of strategic plans to achieve positive public health and safety outcomes; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2655d9e8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/B"><num value="B">(B)</num><chapeau> implementation, which shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2655d9e9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/B/i"><num value="i">(i)</num><content> be derived from the strategic plans described in subparagraph (A)(ii); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2655d9ea-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/B/ii"><num value="ii">(ii)</num><chapeau> consist of—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id2655d9eb-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/B/ii/I"><num value="I">(I)</num><content> hiring and training personnel;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2655d9ec-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/B/ii/II"><num value="II">(II)</num><content> identifying the eligible entity’s target population;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2655d9ed-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/B/ii/III"><num value="III">(III)</num><content> providing services and supports to reduce unnecessary penetration into the criminal justice system;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2655d9ee-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/B/ii/IV"><num value="IV">(IV)</num><content> reducing recidivism;</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2655d9ef-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/B/ii/V"><num value="V">(V)</num><content> evaluating the impact of the eligible entity’s approach; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2655d9f0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/k/3/B/ii/VI"><num value="VI">(VI)</num><content> planning for the sustainability of effective interventions.</content>
</subclause>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2655d9f1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l"><num value="l" class="bold">(l)</num><heading class="bold"> Correctional facilities</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2655d9f2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/1"><num value="1" class="bold">(1)</num><heading class="bold"> Definitions</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2655d9f3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Correctional facility</heading><content><p style="-uslm-lc:I13" class="indent2">The term “correctional facility” means a jail, prison, or other detention facility used to house people who have been arrested, detained, held, or convicted by a criminal justice agency or a court.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2655d9f4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Eligible inmate</heading><chapeau style="-uslm-lc:I13" class="indent2">The term “eligible inmate” means an individual who—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2655d9f5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/1/B/i"><num value="i">(i)</num><content> is being held, detained, or incarcerated in a correctional facility; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2655d9f6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/1/B/ii"><num value="ii">(ii)</num><content> manifests obvious signs of a mental illness or has been diagnosed by a qualified mental health professional as having a mental illness.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2655d9f7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/2"><num value="2" class="bold">(2)</num><heading class="bold"> Correctional facility grants</heading><chapeau style="-uslm-lc:I12" class="indent1">The Attorney General may award grants to applicants to enhance the capabilities of a correctional facility—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26560108-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/2/A"><num value="A">(A)</num><content> to identify and screen for eligible inmates;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26560109-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/2/B"><num value="B">(B)</num><chapeau> to plan and provide—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2656010a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/2/B/i"><num value="i">(i)</num><content> initial and periodic assessments of the clinical, medical, and social needs of inmates; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2656010b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/2/B/ii"><num value="ii">(ii)</num><content> appropriate treatment and services that address the mental health and substance abuse needs of inmates;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2656010c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/2/C"><num value="C">(C)</num><chapeau> to develop, implement, and enhance—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2656010d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/2/C/i"><num value="i">(i)</num><content> post-release transition plans for eligible inmates that, in a comprehensive manner, coordinate health, housing, medical, employment, and other appropriate services and public benefits;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2656010e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/2/C/ii"><num value="ii">(ii)</num><content> the availability of mental health care services and substance abuse treatment services; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2656010f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/2/C/iii"><num value="iii">(iii)</num><content> alternatives to solitary confinement and segregated housing and mental health screening and treatment for inmates placed in solitary confinement or segregated housing; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26560110-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/l/2/D"><num value="D">(D)</num><content> to train each employee of the correctional facility to identify and appropriately respond to incidents involving inmates with mental health or co-occurring mental health and substance abuse disorders.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26560111-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m"><num value="m" class="bold">(m)</num><heading class="bold"> Accountability</heading><chapeau style="-uslm-lc:I11" class="indent0">All grants awarded by the Attorney General under this section shall be subject to the following accountability provisions:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26560112-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/1"><num value="1" class="bold">(1)</num><heading class="bold"> Audit requirement</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26560113-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> Definition</heading><content><p style="-uslm-lc:I13" class="indent2">In this paragraph, the term “unresolved audit finding” means a finding in the final audit report of the Inspector General of the Department of Justice that the audited grantee has utilized grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within 12 months from the date when the final audit report is issued.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26560114-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Audits</heading><content><p style="-uslm-lc:I13" class="indent2">Beginning in the first fiscal year beginning after <date date="2016-12-13">December 13, 2016</date>, and in each fiscal year thereafter, the Inspector General of the Department of Justice shall conduct audits of recipients of grants under this section to prevent waste, fraud, and abuse of funds by grantees. The Inspector General shall determine the appropriate number of grantees to be audited each year.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26562825-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Mandatory exclusion</heading><content><p style="-uslm-lc:I13" class="indent2">A recipient of grant funds under this section that is found to have an unresolved audit finding shall not be eligible to receive grant funds under this section during the first 2 fiscal years beginning after the end of the 12-month period described in subparagraph (A).</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26562826-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/1/D"><num value="D" class="bold">(D)</num><heading class="bold"> Priority</heading><content><p style="-uslm-lc:I13" class="indent2">In awarding grants under this section, the Attorney General shall give priority to eligible applicants that did not have an unresolved audit finding during the 3 fiscal years before submitting an application for a grant under this section.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26562827-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/1/E"><num value="E" class="bold">(E)</num><heading class="bold"> Reimbursement</heading><chapeau style="-uslm-lc:I13" class="indent2">If an entity is awarded grant funds under this section during the 2-fiscal-year period during which the entity is barred from receiving grants under subparagraph (C), the Attorney General shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26562828-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/1/E/i"><num value="i">(i)</num><content> deposit an amount equal to the amount of the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26562829-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/1/E/ii"><num value="ii">(ii)</num><content> seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2656282a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/2"><num value="2" class="bold">(2)</num><heading class="bold"> Nonprofit organization requirements</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2656282b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> Definition</heading><content><p style="-uslm-lc:I13" class="indent2">For purposes of this paragraph and the grant programs under this subchapter, the term “nonprofit organization” means an organization that is described in <ref href="/us/usc/t26/s501/c/3">section 501(c)(3) of title 26</ref> and is exempt from taxation under section 501(a) of such title.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2656282c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Prohibition</heading><content><p style="-uslm-lc:I13" class="indent2">The Attorney General may not award a grant under this subchapter to a nonprofit organization that holds money in offshore accounts for the purpose of avoiding paying the tax described in <ref href="/us/usc/t26/s511/a">section 511(a) of title 26</ref>.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2656282d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/2/C"><num value="C" class="bold">(C)</num><heading class="bold"> Disclosure</heading><content><p style="-uslm-lc:I13" class="indent2">Each nonprofit organization that is awarded a grant under this section and uses the procedures prescribed in regulations to create a rebuttable presumption of reasonableness for the compensation of its officers, directors, trustees, and key employees, shall disclose to the Attorney General, in the application for the grant, the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, the comparability data used, and contemporaneous substantiation of the deliberation and decision. Upon request, the Attorney General shall make the information disclosed under this subparagraph available for public inspection.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26564f3e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/3"><num value="3" class="bold">(3)</num><heading class="bold"> Conference expenditures</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26564f3f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Limitation</heading><content><p style="-uslm-lc:I13" class="indent2">No amounts made available to the Department of Justice under this section may be used by the Attorney General, or by any individual or entity awarded discretionary funds through a cooperative agreement under this section, to host or support any expenditure for conferences that uses more than $20,000 in funds made available by the Department of Justice, unless the head of the relevant agency or department, provides prior written authorization that the funds may be expended to host the conference.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26564f40-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Written approval</heading><content><p style="-uslm-lc:I13" class="indent2">Written approval under subparagraph (A) shall include a written estimate of all costs associated with the conference, including the cost of all food, beverages, audio-visual equipment, honoraria for speakers, and entertainment.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26564f41-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Report</heading><content><p style="-uslm-lc:I13" class="indent2">The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on all conference expenditures approved under this paragraph.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26564f42-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/4"><num value="4" class="bold">(4)</num><heading class="bold"> Annual certification</heading><chapeau style="-uslm-lc:I12" class="indent1">Beginning in the first fiscal year beginning after <date date="2016-12-13">December 13, 2016</date>, the Attorney General shall submit, to the Committee on the Judiciary and the Committee on Appropriations of the Senate and the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives, an annual certification—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26564f43-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/4/A"><num value="A">(A)</num><chapeau> indicating whether—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26564f44-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/4/A/i"><num value="i">(i)</num><content> all audits issued by the Office of the Inspector General under paragraph (1) have been completed and reviewed by the appropriate Assistant Attorney General or Director;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26564f45-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/4/A/ii"><num value="ii">(ii)</num><content> all mandatory exclusions required under paragraph (1)(C) have been issued; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26564f46-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/4/A/iii"><num value="iii">(iii)</num><content> all reimbursements required under paragraph (1)(E) have been made; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26564f47-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/m/4/B"><num value="B">(B)</num><content> that includes a list of any grant recipients excluded under paragraph (1) from the previous year.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26567658-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/n"><num value="n" class="bold">(n)</num><heading class="bold"> Preventing duplicative grants</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26567659-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10651/n/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Before the Attorney General awards a grant to an applicant under this section, the Attorney General shall compare potential grant awards with other grants awarded under this Act to determine if duplicate grant awards are awarded for the same purpose.</p>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> According to the Office of Juvenile Justice and Delinquency Prevention, over 150,000 juveniles who come into contact with the juvenile justice system each year meet the diagnostic criteria for at least 1 mental or emotional disorder.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> A significant proportion of adults with a serious mental illness who are involved with the criminal justice system are homeless or at imminent risk of homelessness, and many of these individuals are arrested and jailed for minor, nonviolent offenses.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> promote adequate training for mental health and substance abuse treatment personnel about criminal offenders with mental illness or co-occurring substance abuse disorders and the appropriate response to such offenders in the criminal justice system;</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> promote communication among adult or juvenile justice personnel, mental health and co-occurring mental illness and substance abuse disorders treatment personnel, nonviolent offenders with mental illness or co-occurring mental illness and substance abuse disorders, and support services such as housing, job placement, community, faith-based, and crime victims organizations; and</content>
