<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id265899a7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/b"><num value="b" class="bold">(b)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this section, the following definitions shall apply:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id265899a8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> Child welfare agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “child welfare agency” means the State, territorial, or Tribal agency responsible for child or family services and welfare.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id265899a9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Criminal justice agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “criminal justice agency” means an agency of the State, territory, Indian tribe, or local government or its contracted agency that is responsible for detection, arrest, enforcement, prosecution, defense, adjudication, incarceration, probation, or parole relating to the violation of the criminal laws of that State, territory, Indian tribe, or local government.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2658c0be-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Eligible entities</heading><content><p style="-uslm-lc:I12" class="indent1">The Attorney General shall make grants to States, territories, and Indian tribes. Applicants must demonstrate extensive collaboration with the State criminal justice agency and child welfare agency in the planning and implementation of the program.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2658c0bf-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Contents</heading><chapeau style="-uslm-lc:I12" class="indent1">In accordance with the regulations or guidelines established by the Attorney General in consultation with the Secretary of Health and Human Services, each application for a grant under this section shall contain a plan to expand the services for pregnant and parenting women offenders who are pregnant women or women with dependent children for the use of methamphetamine or methamphetamine and other drugs and include the following in the plan:</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id2658c0c0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/c/4/A"><num value="A">(A)</num><content> A description of how the applicant will work jointly with the criminal justice and child welfare agencies needs <ref class="footnoteRef" idref="fn002057">4</ref><note type="footnote" id="fn002057"><num>4</num> So in original. The word “needs” probably should not appear.</note> associated with the use of methamphetamine or methamphetamine and other drugs by pregnant and parenting women offenders to promote family stability and permanence.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2658c0c1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/c/4/B"><num value="B">(B)</num><content> A description of the nature and the extent of the problem of methamphetamine use by pregnant and parenting women offenders.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2658c0c2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/c/4/C"><num value="C">(C)</num><content> A certification that the State has involved counties, Indian tribes, and other units of local government, when appropriate, in the development, expansion, modification, operation or improvement of proposed programs to address the use, manufacture, or sale of methamphetamine.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2658c0c3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/c/4/D"><num value="D">(D)</num><content> A certification that funds received under this section will be used to supplement, not supplant, other Federal, State, Tribal, and local funds.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2658c0c4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/c/4/E"><num value="E">(E)</num><chapeau> A description of clinically appropriate practices and procedures to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2658c0c5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/c/4/E/i"><num value="i">(i)</num><content> screen and assess pregnant and parenting women offenders for addiction to methamphetamine and other drugs;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2658e7d6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/c/4/E/ii"><num value="ii">(ii)</num><content> when clinically appropriate for both the women and children, provide family treatment for pregnant and parenting women offenders, with clinically appropriate services in the same location to promote family permanence and self sufficiency; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2658e7d7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/c/4/E/iii"><num value="iii">(iii)</num><content> provide for a process to enhance or ensure the abilities of the child welfare agency, criminal justice agency and State substance agency to work together to re-unite families when appropriate in the case where family treatment is not provided.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2658e7d8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/d"><num value="d" class="bold">(d)</num><heading class="bold"> Period of grant</heading><content><p style="-uslm-lc:I11" class="indent0">The grant shall be a three-year grant. Successful applicants may reapply for only one additional three-year funding cycle and the Attorney General may approve such applications.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2658e7d9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/e"><num value="e" class="bold">(e)</num><heading class="bold"> Performance accountability; reports and evaluations</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2658e7da-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10664/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Reports</heading><content><p style="-uslm-lc:I12" class="indent1">Successful applicants shall submit to the Attorney General a report on the activities carried out under the grant at the end of each fiscal year.</p>
