L. 110–315, title IX, § 952, Aug. 14, 2008, 122 Stat. 3470.)","seq_in_title":211,"parent_identifier":"/us/usc/t34/stI/ch101/schXXXV","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI","level":"subtitle","num":"Subtitle I—","heading":"Comprehensive Acts","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch101","level":"chapter","num":"CHAPTER 101—","heading":"JUSTICE SYSTEM IMPROVEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch101/schXXXV","level":"subchapter","num":"SUBCHAPTER XXXV—","heading":"LOAN REPAYMENT FOR PROSECUTORS AND PUBLIC DEFENDERS","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id26590ef4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671\"><num value=\"10671\">§ 10671.</num><heading> Grant authorization</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26590ef5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Purpose</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The purpose of this section is to encourage qualified individuals to enter and continue employment as prosecutors and public defenders.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26590ef6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this section:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26590ef7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Prosecutor</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “prosecutor” means a full-time employee of a State or unit of local government who—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26590ef8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/1/A\"><num value=\"A\">(A)</num><content> is continually licensed to practice law; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26590ef9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/1/B\"><num value=\"B\">(B)</num><content> prosecutes criminal or juvenile delinquency cases at the State or unit of local government level (including supervision, education, or training of other persons prosecuting such cases).</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26590efa-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Public defender</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “public defender” means an attorney who—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26590efb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/2/A\"><num value=\"A\">(A)</num><content> is continually licensed to practice law; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2659360c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/2/B\"><num value=\"B\">(B)</num><chapeau> is—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2659360d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/2/B/i\"><num value=\"i\">(i)</num><content> a full-time employee of a State or unit of local government who provides legal representation to indigent persons in criminal or juvenile delinquency cases (including supervision, education, or training of other persons providing such representation);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2659360e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/2/B/ii\"><num value=\"ii\">(ii)</num><content> a full-time employee of a nonprofit organization operating under a contract with a State or unit of local government, who devotes substantially all of the employee’s full-time employment to providing legal representation to indigent persons in criminal or juvenile delinquency cases (including supervision, education, or training of other persons providing such representation); or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2659360f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/2/B/iii\"><num value=\"iii\">(iii)</num><content> employed as a full-time Federal defender attorney in a defender organization established pursuant to subsection (g) of <ref href=\"/us/usc/t18/s3006A\">section 3006A of title 18</ref> that provides legal representation to indigent persons in criminal or juvenile delinquency cases.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26593610-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Student loan</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26593611-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Except as provided in subparagraph (B), the term “student loan” means—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26593612-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/3/A/i\"><num value=\"i\">(i)</num><content> a loan made, insured, or guaranteed under part B of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1071\">20 U.S.C. 1071</ref> et seq.);</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26593613-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/3/A/ii\"><num value=\"ii\">(ii)</num><content> a loan made under part D or E of title IV of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1087a\">20 U.S.C. 1087a</ref> et seq. and 1087aa et seq.); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26593614-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/3/A/iii\"><num value=\"iii\">(iii)</num><content> a loan made under section 428C or 455(g) of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1078–3\">20 U.S.C. 1078–3</ref> and 1087e(g)).</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26593615-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Exclusion of parent PLUS loans</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The term “student loan” does not include any of the following loans:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26593616-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/3/B/i\"><num value=\"i\">(i)</num><content> A loan made to the parents of a dependent student under section 428B of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1078–2\">20 U.S.C. 1078–2</ref>).</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26593617-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/3/B/ii\"><num value=\"ii\">(ii)</num><content> A Federal Direct PLUS Loan made to the parents of a dependent student.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26593618-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/b/3/B/iii\"><num value=\"iii\">(iii)</num><content> A loan made under section 428C or 455(g) of the Higher Education Act of 1965 (<ref href=\"/us/usc/t20/s1078–3\">20 U.S.C. 1078–3</ref> and 1087e(g)) to the extent that such loan was used to repay a loan described in clause (i) or (ii).</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26595c29-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Program authorized</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General shall establish a program by which the Department of Justice shall assume the obligation to repay a student loan, by direct payments on behalf of a borrower to the holder of such loan, in accordance with subsection (d), for any borrower who—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26595c2a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/c/1\"><num value=\"1\">(1)</num><content> is employed as a prosecutor or public defender; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26595c2b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/c/2\"><num value=\"2\">(2)</num><content> is not in default on a loan for which the borrower seeks forgiveness.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26595c2c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Terms of agreement</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26595c2d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">To be eligible to receive repayment benefits under subsection (c), a borrower shall enter into a written agreement that specifies that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26595c2e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/1/A\"><num value=\"A\">(A)</num><content> the borrower will remain employed as a prosecutor or public defender for a required period of service of not less than three years, unless involuntarily separated from that employment;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26595c2f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/1/B\"><num value=\"B\">(B)</num><content> if the borrower is involuntarily separated from employment on account of misconduct, or voluntarily separates from employment, before the end of the period specified in the agreement, the borrower will repay the Attorney General the amount of any benefits received by such employee under this section;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26595c30-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/1/C\"><num value=\"C\">(C)</num><content> if the borrower is required to repay an amount to the Attorney General under subparagraph (B) and fails to repay such amount, a sum equal to that amount shall be recoverable by the Federal Government from the employee (or such employee’s estate, if applicable) by such methods as are provided by law for the recovery of amounts owed to the Federal Government;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26595c31-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/1/D\"><num value=\"D\">(D)</num><content> the Attorney General may waive, in whole or in part, a right of recovery under this subsection if it is shown that recovery would be against equity and good conscience or against the public interest; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26595c32-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/1/E\"><num value=\"E\">(E)</num><content> the Attorney General shall make student loan payments under this section for the period of the agreement, subject to the availability of appropriations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26595c33-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Repayments</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26595c34-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Any amount repaid by, or recovered from, an individual or the estate of an individual under this subsection shall be credited to the appropriation account from which the amount involved was originally paid.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26598345-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Merger</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Any amount credited under subparagraph (A) shall be merged with other sums in such account and shall be available for the same purposes and period, and subject to the same limitations, if any, as the sums with which the amount was merged.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26598346-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Limitations</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26598347-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Student loan payment amount</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Student loan repayments made by the Attorney General under this section shall be made subject to such terms, limitations, or conditions as may be mutually agreed upon by the borrower and the Attorney General in an agreement under paragraph (1), except that the amount paid by the Attorney General under this section shall not exceed—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26598348-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/3/A/i\"><num value=\"i\">(i)</num><content> $10,000 for any borrower in any calendar year; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26598349-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/3/A/ii\"><num value=\"ii\">(ii)</num><content> an aggregate total of $60,000 in the case of any borrower.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id2659834a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/d/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Beginning of payments</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Nothing in this section shall authorize the Attorney General to pay any amount to reimburse a borrower for any repayments made by such borrower prior to the date on which the Attorney General entered into an agreement with the borrower under this subsection.</p>\n</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2659834b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Additional agreements</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2659834c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">On completion of the required period of service under an agreement under subsection (d), the borrower and the Attorney General may, subject to paragraph (2), enter into an additional agreement in accordance with subsection (d).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2659834d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Term</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An agreement entered into under paragraph (1) may require the borrower to remain employed as a prosecutor or public defender for less than three years.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2659834e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Award basis; priority</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2659834f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Award basis</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Subject to paragraph (2), the Attorney General shall provide repayment benefits under this section—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26598350-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/f/1/A\"><num value=\"A\">(A)</num><content> giving priority to borrowers who have the least ability to repay their loans, except that the Attorney General shall determine a fair allocation of repayment benefits among prosecutors and public defenders, and among employing entities nationwide; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26598351-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/f/1/B\"><num value=\"B\">(B)</num><content> subject to the availability of appropriations.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2659aa62-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Priority</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General shall give priority in providing repayment benefits under this section in any fiscal year to a borrower who—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2659aa63-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/f/2/A\"><num value=\"A\">(A)</num><content> received repayment benefits under this section during the preceding fiscal year; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2659aa64-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/f/2/B\"><num value=\"B\">(B)</num><content> has completed less than three years of the first required period of service specified for the borrower in an agreement entered into under subsection (d).</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2659aa65-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Regulations</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General is authorized to issue such regulations as may be necessary to carry out the provisions of this section.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2659aa66-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Report by Inspector General</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Not later than three years after <date date=\"2008-08-14\">August 14, 2008</date>, the Inspector General of the Department of Justice shall submit to Congress a report on—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2659aa67-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s10671/h/1\"><num value=\"1\">(1)</num><content> the cost of the program authorized under this section;
