<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id265a1fbc-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701"><num value="10701">§ 10701.</num><heading> Description</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id265a1fbd-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a"><num value="a" class="bold">(a)</num><heading class="bold"> Grants authorized</heading><chapeau style="-uslm-lc:I11" class="indent0">From amounts made available to carry out this subchapter, the Attorney General may make grants to States, units of local government, and Indian tribes, for use by the State, unit of local government, or Indian tribe to provide services primarily relating to opioid abuse, including for any one or more of the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id265a1fbe-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/1"><num value="1">(1)</num><chapeau> Developing, implementing, or expanding a treatment alternative to incarceration program, which may include—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id265a1fbf-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/1/A"><num value="A">(A)</num><content> prebooking or postbooking components, which may include the activities described in subchapter XXIX or XXXIII of this chapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id265a1fc0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/1/B"><num value="B">(B)</num><content> training for criminal justice agency personnel on substance use disorders and co-occurring mental illness and substance use disorders;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id265a1fc1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/1/C"><num value="C">(C)</num><content> a mental health court, including the activities described in subchapter XXI of this chapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id265a1fc2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/1/D"><num value="D">(D)</num><content> a drug court, including the activities described in subchapter XXX of this chapter;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id265a1fc3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/1/E"><num value="E">(E)</num><content> a veterans treatment court program, including the activities described in subsection (i) of <ref href="/us/usc/t34/s10651">section 10651 of this title</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id265a1fc4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/1/F"><num value="F">(F)</num><content> a focus on parents whose incarceration could result in their children entering the child welfare system; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id265a1fc5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/1/G"><num value="G">(G)</num><content> a community-based substance use diversion program sponsored by a law enforcement agency.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id265a1fc6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/2"><num value="2">(2)</num><content> In the case of a State, facilitating or enhancing planning and collaboration between State criminal justice agencies and State substance abuse agencies in order to more efficiently and effectively carry out activities or services described in any paragraph of this subsection that address problems related to opioid abuse.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id265a46d7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/3"><num value="3">(3)</num><content> Providing training and resources for first responders on carrying and administering an opioid overdose reversal drug or device approved or cleared by the Food and Drug Administration, and purchasing such a drug or device for first responders who have received such training to so carry and administer.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id265a46d8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/4"><num value="4">(4)</num><content> Locating or investigating illicit activities related to the unlawful distribution of opioids.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id265a46d9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/5"><num value="5">(5)</num><content> Developing, implementing, or expanding a medication-assisted treatment program used or operated by a criminal justice agency, which may include training criminal justice agency personnel on medication-assisted treatment, and carrying out the activities described in subchapter XVIII of this chapter.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id265a46da-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/6"><num value="6">(6)</num><content> In the case of a State, developing, implementing, or expanding a prescription drug monitoring program to collect and analyze data related to the prescribing of schedules II, III, and IV controlled substances through a centralized database administered by an authorized State agency, which includes tracking the dispensation of such substances, and providing for interoperability and data sharing with each other such program in each other State, and with any interstate entity that shares information between such programs.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id265a46db-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/7"><num value="7">(7)</num><content> Developing, implementing, or expanding a program to prevent and address opioid abuse by juveniles.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id265a46dc-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/8"><num value="8">(8)</num><content> Developing, implementing, or expanding a program (which may include demonstration projects) to utilize technology that provides a secure container for prescription drugs that would prevent or deter individuals, particularly adolescents, from gaining access to opioid medications that are lawfully prescribed for other individuals.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id265a46dd-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/9"><num value="9">(9)</num><content> Developing, implementing, or expanding a prescription drug take-back program.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id265a46de-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/a/10"><num value="10">(10)</num><content> Developing, implementing, or expanding an integrated and comprehensive opioid abuse response program.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id265a46df-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/b"><num value="b" class="bold">(b)</num><heading class="bold"> Contracts and subawards</heading><chapeau style="-uslm-lc:I11" class="indent0">A State, unit of local government, or Indian tribe may, in using a grant under this subchapter for purposes authorized by subsection (a), use all or a portion of that grant to contract with, or make one or more subawards to, one or more—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id265a6df0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/b/1"><num value="1">(1)</num><content> local or regional organizations that are private and nonprofit, including faith-based organizations;</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id265a6df1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/b/2"><num value="2">(2)</num><content> units of local government; or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id265a6df2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/b/3"><num value="3">(3)</num><content> tribal organizations.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id265a6df3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/c"><num value="c" class="bold">(c)</num><heading class="bold"> Program assessment component; waiver</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id265a6df4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Program assessment component</heading><content><p style="-uslm-lc:I12" class="indent1">Each program funded under this subchapter shall contain a program assessment component, developed pursuant to guidelines established by the Attorney General, in coordination with the National Institute of Justice.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id265a6df5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Waiver</heading><content><p style="-uslm-lc:I12" class="indent1">The Attorney General may waive the requirement of paragraph (1) with respect to a program if, in the opinion of the Attorney General, the program is not of sufficient size to justify a full program assessment.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id265a6df6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/d"><num value="d" class="bold">(d)</num><heading class="bold"> Administrative costs</heading><content><p style="-uslm-lc:I11" class="indent0">Not more than 10 percent of a grant made under this subchapter may be used for costs incurred to administer such grant.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id265a6df7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s10701/e"><num value="e" class="bold">(e)</num><heading class="bold"> Period</heading><content><p style="-uslm-lc:I11" class="indent0">The period of a grant made under this subchapter may not be longer than 4 years, except that renewals and extensions beyond that period may be granted at the discretion of the Attorney General.</p>
