<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id26809342-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313"><num value="11313">§ 11313.</num><heading> Grants for local delinquency prevention programs</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26809343-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/a"><num value="a" class="bold">(a)</num><heading class="bold"> Purpose</heading><content><p style="-uslm-lc:I11" class="indent0">The purpose of this section is to enable local communities to address the unmet needs of at-risk or delinquent youth, including through a continuum of delinquency prevention programs for juveniles who have had contact with the juvenile justice system or who are likely to have contact with the juvenile justice system.</p>
</content>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26809344-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/b"><num value="b" class="bold">(b)</num><heading class="bold"> Program authorized</heading><chapeau style="-uslm-lc:I11" class="indent0">The Administrator shall—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id26809345-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/b/1"><num value="1">(1)</num><content> for each fiscal year for which less than $25,000,000 is appropriated under section 506,<ref class="footnoteRef" idref="fn002076">1</ref><note type="footnote" id="fn002076"><num>1</num> See References in Text note below.</note> award grants to not fewer than 3 State entities, but not more than 5 State entities, that apply under subsection (c) and meet the requirements of subsection (d); or</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26809346-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/b/2"><num value="2">(2)</num><content> for each fiscal year for which $25,000,000 or more is appropriated under section 506,<sup>1</sup> award grants to not fewer than 5 State entities that apply under subsection (c) and meet the requirements of subsection (d).</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26809347-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/c"><num value="c" class="bold">(c)</num><heading class="bold"> State application</heading><chapeau style="-uslm-lc:I11" class="indent0">To be eligible to receive a grant under this section, a State entity shall submit an application to the Administrator that includes the following:</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id26809348-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/c/1"><num value="1">(1)</num><chapeau> An assurance the State entity will use—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26809349-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/c/1/A"><num value="A">(A)</num><chapeau> not more than 10 percent of such grant, in the aggregate—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2680934a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/c/1/A/i"><num value="i">(i)</num><content> for the costs incurred by the State entity to carry out this section, except that not more than 3 percent of such grant may be used for such costs; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2680934b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/c/1/A/ii"><num value="ii">(ii)</num><content> to provide technical assistance to eligible entities receiving a subgrant under subsection (e) in carrying out delinquency prevention programs under the subgrant; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2680ba5c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/c/1/B"><num value="B">(B)</num><content> the remainder of such grant to award subgrants to eligible entities under subsection (e).</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2680ba5d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/c/2"><num value="2">(2)</num><content> An assurance that such grant will supplement, and not supplant, State and local efforts to prevent juvenile delinquency.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2680ba5e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/c/3"><num value="3">(3)</num><content> An assurance the State entity will evaluate the capacity of eligible entities receiving a subgrant under subsection (e) to fulfill the requirements under such subsection.</content>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2680ba5f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/c/4"><num value="4">(4)</num><content> An assurance that such application was prepared after consultation with, and participation by, the State advisory group, units of local government, community-based organizations, and organizations that carry out programs, projects, or activities to prevent juvenile delinquency in the local juvenile justice system served by the State entity.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2680ba60-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/d"><num value="d" class="bold">(d)</num><heading class="bold"> Approval of State applications</heading><chapeau style="-uslm-lc:I11" class="indent0">In awarding grants under this section for a fiscal year, the Administrator may not award a grant to a State entity for a fiscal year unless—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id2680ba61-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/d/1"><num value="1">(1)</num><subparagraph style="-uslm-lc:I12" class="indent1" id="id2680ba62-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/d/1/A"><num value="A">(A)</num><content> the State that will be served by the State entity submitted a plan under <ref href="/us/usc/t34/s11133">section 11133 of this title</ref> for such fiscal year; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I12" class="indent1" id="id2680ba63-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/d/1/B"><num value="B">(B)</num><content> such plan is approved by the Administrator for such fiscal year; or</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id2680ba64-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/d/2"><num value="2">(2)</num><content> after finding good cause for a waiver, the Administrator waives the plan required under subparagraph (A) for such State for such fiscal year.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id2680ba65-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e"><num value="e" class="bold">(e)</num><heading class="bold"> Subgrant program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2680ba66-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1"><num value="1" class="bold">(1)</num><heading class="bold"> Program authorized</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2680ba67-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I13" class="indent2">Each State entity receiving a grant under this section shall award subgrants to eligible entities in accordance with this subsection.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2680ba68-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/B"><num value="B" class="bold">(B)</num><heading class="bold"> Priority</heading><chapeau style="-uslm-lc:I13" class="indent2">In awarding subgrants under this subsection, the State shall give priority to eligible entities that demonstrate ability in—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2680e179-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/B/i"><num value="i">(i)</num><content> plans for service and agency coordination and collaboration including the collocation of services;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2680e17a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/B/ii"><num value="ii">(ii)</num><content> innovative ways to involve the private nonprofit and business sector in delinquency prevention activities;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2680e17b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/B/iii"><num value="iii">(iii)</num><content> developing data-driven prevention plans, employing evidence-based prevention strategies, and conducting program evaluations to determine impact and effectiveness;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2680e17c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/B/iv"><num value="iv">(iv)</num><content> identifying under the plan submitted under paragraph (5) potential savings and efficiencies associated with successful implementation of such plan; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id2680e17d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/B/v"><num value="v">(v)</num><content> describing how such savings and efficiencies may be used to carry out delinquency prevention programs and be reinvested in the continuing implementation of such programs after the end of the subgrant period.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2680e17e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/C"><num value="C" class="bold">(C)</num><heading class="bold"> Subgrant program period and diversity of projects</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id2680e17f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/C/i"><num value="i" class="bold">(i)</num><heading class="bold"> Program period</heading><chapeau style="-uslm-lc:I14" class="indent3">A subgrant awarded to an eligible entity by a State entity under this section shall be for a period of not more than 5 years, of which the eligible entity—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id2680e180-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/C/i/I"><num value="I">(I)</num><content> may use not more than 18 months for completing the plan submitted by the eligible entity under paragraph (5); and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id2680e181-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/C/i/II"><num value="II">(II)</num><content> shall use the remainder of the subgrant period, after planning <ref class="footnoteRef" idref="fn002077">2</ref><note type="footnote" id="fn002077"><num>2</num> So in original. Probably should be preceded by “the”.</note> period described in subclause (I), for the implementation of such plan.</content>
</subclause>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id2680e182-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/1/C/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Diversity of projects</heading><content><p style="-uslm-lc:I14" class="indent3">In awarding subgrants under this subsection, a State entity shall ensure, to the extent practicable and applicable, that such subgrants are distributed throughout different areas, including urban, suburban, and rural areas.</p>
</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2680e183-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/2"><num value="2" class="bold">(2)</num><heading class="bold"> Local application</heading><chapeau style="-uslm-lc:I12" class="indent1">An eligible entity that desires a subgrant under this subsection shall submit an application to the State entity in the State of the eligible entity, at such time and in such manner as determined by the State entity, and that includes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26810894-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/2/A"><num value="A">(A)</num><chapeau> a description of—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26810895-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/2/A/i"><num value="i">(i)</num><content> the local policy board and local partners the eligible entity will engage in the development of the plan described in paragraph (5);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26810896-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/2/A/ii"><num value="ii">(ii)</num><content> the unmet needs of at-risk or delinquent youth in the community;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26810897-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/2/A/iii"><num value="iii">(iii)</num><content> available resources in the community to meet the unmet needs identified in the needs assessment described in paragraph (5)(A); <ref class="footnoteRef" idref="fn002078">3</ref><note type="footnote" id="fn002078"><num>3</num> So in original. Probably should be followed by “and”.</note></content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26810898-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/2/A/iv"><num value="iv">(iv)</num><content> potential costs to the community if the unmet needs are not addressed;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26810899-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/2/B"><num value="B">(B)</num><content> a specific time period for the planning and subsequent implementation of its continuum of local delinquency prevention programs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2681089a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/2/C"><num value="C">(C)</num><content> the steps the eligible entity will take to implement the plan under subparagraph (A); and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id2681089b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/2/D"><num value="D">(D)</num><content> a plan to continue the grant activity with non-Federal funds, if proven successful according to the performance evaluation process under paragraph (5)(D), after the grant period.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2681089c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/3"><num value="3" class="bold">(3)</num><heading class="bold"> Matching requirement</heading><content><p style="-uslm-lc:I12" class="indent1">An eligible entity desiring a subgrant under this subsection shall agree to provide a 50 percent match of the amount of the subgrant that may include the value of in-kind contributions.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id2681089d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/4"><num value="4" class="bold">(4)</num><heading class="bold"> Subgrant review</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id2681089e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/4/A"><num value="A" class="bold">(A)</num><heading class="bold"> Review</heading><chapeau style="-uslm-lc:I13" class="indent2">Not later than the end of the second year of a subgrant period for a subgrant awarded to an eligible entity under this subsection and before awarding the remaining amount of the subgrant to the eligible entity, the State entity shall—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id2681089f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/4/A/i"><num value="i">(i)</num><content> ensure that the eligible entity has completed the plan submitted under paragraph (2) and that the plan meets the requirements of such paragraph; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id268108a0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/4/A/ii"><num value="ii">(ii)</num><content> verify that the eligible entity will begin the implementation of its plan upon receiving the next installment of its subgrant award.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26812fb1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/4/B"><num value="B" class="bold">(B)</num><heading class="bold"> Termination</heading><content><p style="-uslm-lc:I13" class="indent2">If the State entity finds through the review conducted under subparagraph (A) that the eligible entity has not met the requirements of clause (i) of such subparagraph, the State entity shall reallocate the amount remaining on the subgrant of the eligible entity to other eligible entities receiving a subgrant under this subsection or award the amount to an eligible entity during the next subgrant competition under this subsection.</p>
</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26812fb2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5"><num value="5" class="bold">(5)</num><heading class="bold"> Local uses of funds</heading><chapeau style="-uslm-lc:I12" class="indent1">An eligible entity that receives a subgrant under this subsection shall use the funds to implement a plan to carry out delinquency prevention programs in the community served by the eligible entity in a coordinated manner with other delinquency prevention programs or entities serving such community, which includes—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26812fb3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/A"><num value="A">(A)</num><chapeau> an analysis of the unmet needs of at-risk or delinquent youth in the community—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26812fb4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/A/i"><num value="i">(i)</num><chapeau> which shall include—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id26812fb5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/A/i/I"><num value="I">(I)</num><content> the available resources in the community to meet the unmet needs; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id26812fb6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/A/i/II"><num value="II">(II)</num><content> factors present in the community that may contribute to delinquency, such as homelessness, food insecurity, teen pregnancy, youth unemployment, family instability, lack of educational opportunity; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26812fb7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/A/ii"><num value="ii">(ii)</num><chapeau> may include an estimate—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id26812fb8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/A/ii/I"><num value="I">(I)</num><content> for the most recent year for which reliable data is available, the amount expended by the community and other entities for delinquency adjudication for juveniles and the incarceration of adult offenders for offenses committed in such community; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id26812fb9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/A/ii/II"><num value="II">(II)</num><content> of potential savings and efficiencies that may be achieved through the implementation of the plan;</content>
</subclause>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26812fba-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/B"><num value="B">(B)</num><content> a minimum 3-year comprehensive strategy to address the unmet needs and an estimate of the amount or percentage of non-Federal funds that are available to carry out the strategy;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id268156cb-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/C"><num value="C">(C)</num><content> a description of how delinquency prevention programs under the plan will be coordinated;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id268156cc-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/D"><num value="D">(D)</num><content> a description of the performance evaluation process of the delinquency prevention programs to be implemented under the plan, which shall include performance measures to assess efforts to address the unmet needs of youth in the community analyzed under subparagraph (A);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id268156cd-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/E"><num value="E">(E)</num><content> the evidence or promising evaluation on which such delinquency prevention programs are based; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id268156ce-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s11313/e/5/F"><num value="F">(F)</num><content> if such delinquency prevention programs are proven successful according to the performance evaluation process under subparagraph (D), a strategy to continue such programs after the subgrant period with non-Federal funds, including a description of how any estimated savings or efficiencies created by the implementation of the plan may be used to continue such programs.</content>
</subparagraph>

</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Selection of Grant Recipients.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Awards</inline>.—</heading><content>The Attorney General shall award grants for Youth Violence Reduction Demonstration Projects on a competitive basis.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Amount of awards</inline>.—</heading><content>No single grant award made under subsection (a) shall exceed $15,000,000 per fiscal year.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">Application</inline>.—</heading><chapeau>An application for a grant under paragraph (1) shall be submitted to the Attorney General in such a form, and containing such information and assurances, as the Attorney General may require, and at a minimum shall propose—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> a program strategy targeting areas with the highest incidence of youth violence and homicides;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> outcome measures and specific objective indicia of performance to assess the effectiveness of the program; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> a plan for evaluation by an independent third party.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Distribution</inline>.—</heading><chapeau>In making grants under this section, the Attorney General shall ensure the following:</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> No less than 1 recipient is a city with a population exceeding 1,000,000 and an increase of at least 30 percent in the aggregated juvenile and young adult homicide victimization rate during calendar year 2005 as compared to calendar year 2004.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> No less than one recipient is a nonmetropolitan county or group of counties with per capita arrest rates of juveniles and young adults for serious violent offenses that exceed the national average for nonmetropolitan counties by at least 5 percent.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><heading> <inline class="small-caps">Criteria</inline>.—</heading><chapeau>In making grants under this section, the Attorney General shall give preference to entities operating programs that meet the following criteria:</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><chapeau> A program focusing on—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> reducing youth violence and homicides, with an emphasis on juvenile and young adult probationers and other juveniles and young adults who have had or are likely to have contact with the juvenile justice system;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> fostering positive relationships between program participants and supportive adults in the community; and</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> accessing comprehensive supports for program participants through coordinated community referral networks, including job opportunities, educational programs, counseling services, substance abuse programs, recreational opportunities, and other services.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> A program goal of almost daily contacts with and supervision of participating juveniles and young adults through small caseloads and a coordinated team approach among case managers drawn from the community, probation officers, and police officers.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> The use of existing structures, local government agencies, and nonprofit organizations to operate the program.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> Inclusion in program staff of individuals who live or have lived in the community in which the program operates; have personal experiences or cultural competency that build credibility in relationships with program participants; and will serve as a case manager, intermediary, and mentor.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><content> Fieldwork and neighborhood outreach in communities where the young violent offenders live, including support of the program from local public and private organizations and community members.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="F">“(F)</num><content> Imposition of graduated probation sanctions to deter violent and criminal behavior.</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="G">“(G)</num><content> A record of program operation and effectiveness evaluation over a period of at least five years prior to the date of enactment of this Act [<date date="2006-01-05">Jan. 5, 2006</date>].</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="H">“(H)</num><content> A program structure that can serve as a model for other communities in addressing the problem of youth violence and juvenile and young adult recidivism.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">Authorized Activities</inline>.—</heading><chapeau>Amounts paid to an eligible entity under a grant award may be used for the following activities:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> Designing and enhancing program activities.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> Employing and training personnel.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> Purchasing or leasing equipment.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> Providing services and training to program participants and their families.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> Supporting related law enforcement and probation activities, including personnel costs.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> Establishing and maintaining a system of program records.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> Acquiring, constructing, expanding, renovating, or operating facilities to support the program.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="8">“(8)</num><content> Evaluating program effectiveness.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="9">“(9)</num><content> Undertaking other activities determined by the Attorney General as consistent with the purposes and requirements of the demonstration program.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Evaluation and Reports.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Independent evaluation</inline>.—</heading><chapeau>The Attorney General may use up to $500,000 of funds appropriated annually under this such section to—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> prepare and implement a design for interim and overall evaluations of performance and progress of the funded demonstration projects;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> provide training and technical assistance to grant recipients; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> disseminate broadly the information generated and lessons learned from the operation of the demonstration projects.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Reports to congress</inline>.—</heading><chapeau>Not later than 120 days after the last day of each fiscal year for which 1 or more demonstration grants are awarded, the Attorney General shall submit to Congress a report which shall include—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> a summary of the activities carried out with such grants;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> an assessment by the Attorney General of the program carried out; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> such other information as the Attorney General considers appropriate.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Federal Share.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>The Federal share of a grant awarded under this Act [see Short Title of 2006 Act note set out under <ref href="/us/usc/t34/s10101">section 10101 of this title</ref>] shall not exceed 90 percent of the total program costs.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Non-federal share</inline>.—</heading><content>The non-Federal share of such cost may be provided in cash or in-kind.</content>
</paragraph>

<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Definitions</inline>.—</heading><chapeau>In this section:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Unit of local government</inline>.—</heading><content>The term ‘unit of local government’ means a county, township, city, or political subdivision of a county, township, or city, that is a unit of local government as determined by the Secretary of Commerce for general statistical purposes.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Juvenile</inline>.—</heading><content>The term ‘juvenile’ means an individual who is 17 years of age or younger.</content>

</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> promote a safe, healthy environment for youth under the supervision of law enforcement personnel where mutual trust and respect can be built;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> develop life enhancing character and leadership skills in young people;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> increase school attendance by providing alternatives to suspensions and expulsions;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><content> reduce the juvenile crime rate in participating designated communities and the number of police calls involving juveniles during nonschool hours;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="F">“(F)</num><content> provide youths with alternatives to drugs, alcohol, tobacco, and gang activity;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="G">“(G)</num><content> create positive communications and interaction between youth and law enforcement personnel; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="H">“(H)</num><content> prepare youth for the workplace.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> The Police Athletic/Activities League, during its 90-year history as a national organization, has proven to be a positive force in the communities it serves.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> The Police Athletic/Activities League is a network of 1,700 facilities serving over 3,000 communities. There are 350 PAL chapters throughout the United States, the Virgin Islands, and the Commonwealth of Puerto Rico, serving 2,000,000 youth, ages 5 to 18, nationwide.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> Based on PAL chapter demographics, approximately 85 percent of the youths who benefit from PAL programs live in inner cities and urban areas.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> PAL chapters are locally operated, volunteer-driven organizations. Although most PAL chapters are sponsored by a law enforcement agency, PAL chapters rarely receive direct funding from law enforcement agencies and are dependent in large part on support from the private sector, such as individuals, business leaders, corporations, and foundations. PAL chapters have been exceptionally successful in balancing public funds with private sector donations and maximizing community involvement.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> Today’s youth face far greater risks than did their parents and grandparents. Law enforcement statistics demonstrate that youth between the ages of 12 and 18 are at risk of committing violent acts and being victims of violent acts between the hours of 3 p.m. and 8 p.m.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> Greater numbers of students are dropping out of school and failing in school, even though the consequences of academic failure are more dire in 2005 than ever before.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="8">“(8)</num><content> Many distressed areas in the United States are still underserved by PAL chapters.</content>
</paragraph>
</section>
<section style="-uslm-lc:I580467"><num value="3">“SEC. 3.</num><heading> PURPOSE.</heading><chapeau style="-uslm-lc:I21" class="indent0">“The purpose of this Act is to provide adequate resources in the form of—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> assistance for the 342 established PAL chapters to increase of services to the communities they are serving;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> seed money for the establishment of 250 (50 per year over a 5-year period) additional local PAL chapters in public housing projects and other distressed areas, including distressed areas with a majority population of Native Americans, by not later than fiscal year 2010; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> support of an annual gathering of PAL chapters and designated youth leaders from such chapters to participate in a 3-day conference that addresses national and local issues impacting the youth of America and includes educational sessions to advance character and leadership skills.</content>

<section style="-uslm-lc:I580467"><num value="4">“SEC. 4.</num><heading> DEFINITIONS.</heading><chapeau style="-uslm-lc:I21" class="indent0">“In this Act:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Assistant attorney general</inline>.—</heading><content>The term ‘Assistant Attorney General’ means the Assistant Attorney General for the Office of Justice Programs of the Department of Justice.</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Distressed area</inline>.—</heading><content>The term ‘distressed area’ means an urban, suburban, or rural area with a high percentage of high-risk youth, as defined in section 509A of the Public Health Service Act (<ref href="/us/usc/t42/s290aa–8/f">42 U.S.C. 290aa–8(f)</ref>) [transferred to <ref href="/us/usc/t42/s290bb–23/g">42 U.S.C. 290bb–23(g)</ref> and repealed by <ref href="/us/pl/114/255/dB/tIX/s9017">Pub. L. 114–255, div. B, title IX, § 9017</ref>, <date date="2016-12-13">Dec. 13, 2016</date>, <ref href="/us/stat/130/1248">130 Stat. 1248</ref>].</content>

<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><heading> <inline class="small-caps">PAL chapter</inline>.—</heading><content>The term ‘PAL chapter’ means a chapter of a Police or Sheriff’s Athletic/Activities League.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><heading> <inline class="small-caps">Police Athletic/activities league</inline>.—</heading><content>The term ‘Police Athletic/Activities League’ means the private, nonprofit, national representative organization for 320 Police or Sheriff’s Athletic/Activities Leagues throughout the United States (including the Virgin Islands and the Commonwealth of Puerto Rico).</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><heading> <inline class="small-caps">Public housing; project</inline>.—</heading><content>The terms ‘public housing’ and ‘project’ have the meanings given those terms in section 3(b) of the United States Housing Act of 1937 (<ref href="/us/usc/t42/s1437a/b">42 U.S.C. 1437a(b)</ref>).</content>
</paragraph>
</section>
<section style="-uslm-lc:I580467"><num value="5">“SEC. 5.</num><heading> GRANTS AUTHORIZED.</heading><subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>Subject to appropriations, for each of fiscal years 2006 through 2010, the Assistant Attorney General shall award a grant to the Police Athletic/Activities League for the purpose of establishing PAL chapters to serve public housing projects and other distressed areas, and expanding existing PAL chapters to serve additional youths.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Application.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Submission</inline>.—</heading><chapeau>In order to be eligible to receive a grant under this section, the Police Athletic/Activities League shall submit to the Assistant Attorney General an application, which shall include—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> a long-term strategy to establish 250 additional PAL chapters and detailed summary of those areas in which new PAL chapters will be established, or in which existing chapters will be expanded to serve additional youths, during the next fiscal year;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> a plan to ensure that there are a total of not fewer than 500 PAL chapters in operation before <date date="2010-01-01">January 1, 2010</date>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> a certification that there will be appropriate coordination with those communities where new PAL chapters will be located; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> an explanation of the manner in which new PAL chapters will operate without additional, direct Federal financial assistance once assistance under this Act is discontinued.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Review</inline>.—</heading><content>The Assistant Attorney General shall review and take action on an application submitted under paragraph (1) not later than 120 days after the date of such submission.</content>
</paragraph>
</subsection>
</section>
<section style="-uslm-lc:I580467"><num value="6">“SEC. 6.</num><heading> USE OF FUNDS.</heading><subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Assistance for new and expanded chapters</inline>.—</heading><content>Amounts made available under a grant awarded under this Act shall be used by the Police Athletic/Activities League to provide funding for the establishment of PAL chapters serving public housing projects and other distressed areas, or the expansion of existing PAL chapters.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Program requirements</inline>.—</heading><chapeau>Each new or expanded PAL chapter assisted under paragraph (1) shall carry out not less than two programs during nonschool hours, of which—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><chapeau> not less than one program shall provide—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> mentoring assistance;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> academic assistance;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> recreational and athletic activities;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iv">“(iv)</num><content> technology training; or</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="v">“(v)</num><content> character development and leadership training; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><chapeau> any remaining programs shall provide—</chapeau><clause style="-uslm-lc:I24" class="indent3"><num value="i">“(i)</num><content> drug, alcohol, and gang prevention activities;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="ii">“(ii)</num><content> health and nutrition counseling;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iii">“(iii)</num><content> cultural and social programs;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="iv">“(iv)</num><content> conflict resolution training, anger management, and peer pressure training;</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="v">“(v)</num><content> job skill preparation activities; or</content>
</clause>
<clause style="-uslm-lc:I24" class="indent3"><num value="vi">“(vi)</num><content> Youth Police Athletic/Activities League Conferences or Youth Forums.</content>
</clause>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Additional Requirements</inline>.—</heading><chapeau>In carrying out the programs under subsection (a), a PAL chapter shall, to the maximum extent practicable—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> use volunteers from businesses, academic communities, social organizations, and law enforcement organizations to serve as mentors or to assist in other ways;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> ensure that youth in the local community participate in designing the after-school activities;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> develop creative methods of conducting outreach to youth in the community;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> request donations of computer equipment and other materials and equipment; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> work with State and local park and recreation agencies so that activities funded with amounts made available under a grant under this Act will not duplicate activities funded from other sources in the community served.</content>
</paragraph>
</subsection>
</section>
<section style="-uslm-lc:I580467"><num value="7">“SEC. 7.</num><heading> REPORTS.</heading><subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">Report to Assistant Attorney General</inline>.—</heading><content>For each fiscal year for which a grant is awarded under this Act, the Police Athletic/Activities League shall submit to the Assistant Attorney General a report on the use of amounts made available under the grant.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Report to Congress</inline>.—</heading><content>Not later than May 1 of each fiscal year for which amounts are made available to carry out this Act, the Assistant Attorney General shall submit to the Committees on the Judiciary of the Senate and the House of Representatives a report that details the progress made under this Act in establishing and expanding PAL chapters in public housing projects and other distressed areas, and the effectiveness of the PAL programs in reducing drug abuse, school dropouts, and juvenile crime.</content>
</subsection>

<section style="-uslm-lc:I580467"><num value="8">“SEC. 8.</num><heading> AUTHORIZATION OF APPROPRIATIONS.</heading><subsection style="-uslm-lc:I21" class="indent0"><num value="a">“(a)</num><heading> <inline class="small-caps">In General</inline>.—</heading><content>There are authorized to be appropriated to carry out this Act $16,000,000 for each of fiscal years 2006 through 2010.</content>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Funding for Program Administration</inline>.—</heading><chapeau>Of the amount made available to carry out this Act in each fiscal year—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> not less than 2 percent shall be used for research and evaluation of the grant program under this Act;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> not less than 1 percent shall be used for technical assistance related to the use of amounts made available under grants awarded under this Act; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> not less than 1 percent shall be used for the management and administration of the grant program under this Act, except that the total amount made available under this paragraph for administration of that program shall not exceed 6 percent.”</content>

<subsection style="-uslm-lc:I21" class="indent0"><num value="b">“(b)</num><heading> <inline class="small-caps">Findings</inline>.—</heading><chapeau>Congress makes the following findings:</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> There is an increasing epidemic of juvenile crime throughout the United States.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> It is well documented that the majority of juvenile crimes take place during after-school hours.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> Knowledge of technology is becoming increasingly necessary for children in school and out of school.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="4">“(4)</num><content> The Boys and Girls Clubs of America have 2,700 clubs throughout all 50 States, serving over 3,000,000 boys and girls primarily from at-risk communities.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="5">“(5)</num><content> The Boys and Girls Clubs of America have the physical structures in place for immediate implementation of an after-school technology program.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="6">“(6)</num><content> Building technology centers and providing integrated content and full-time staffing at those centers in the Boys and Girls Clubs of America nationwide will help foster education, job training, and an alternative to crime for at-risk youth.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="7">“(7)</num><content> Partnerships between the public sector and the private sector are an effective way of providing after-school technology programs in the Boys and Girls Clubs of America.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="8">“(8)</num><content> PowerUp: Bridging the Digital Divide is an entity comprised of more than a dozen nonprofit organizations, major corporations, and Federal agencies that have joined together to launch a major new initiative to help ensure that America’s underserved young people acquire the skills, experiences, and resources they need to succeed in the digital age.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="9">“(9)</num><content> Bringing PowerUp into the Boys and Girls Clubs of America will be an effective way to ensure that our youth have a safe, crime-free environment in which to learn the technological skills they need to close the divide between young people who have access to computer-based information and technology-related skills and those who do not.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="c">“(c)</num><heading> <inline class="small-caps">After-School Technology Grants to the Boys and Girls Clubs of America.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Purposes</inline>.—</heading><chapeau>The Attorney General shall make grants to the Boys and Girls Clubs of America for the purpose of funding effective after-school technology programs, such as PowerUp, in order to provide—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> constructive technology-focused activities that are part of a comprehensive program to provide access to technology and technology training to youth during after-school hours, weekends, and school vacations;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> supervised activities in safe environments for youth; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> full-time staffing with teachers, tutors, and other qualified personnel.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Subawards</inline>.—</heading><content>The Boys and Girls Clubs of America shall make subawards to local boys and girls clubs authorizing expenditures associated with providing technology programs such as PowerUp, including the hiring of teachers and other personnel, procurement of goods and services, including computer equipment, or such other purposes as are approved by the Attorney General.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="d">“(d)</num><heading> <inline class="small-caps">Applications.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">Eligibility</inline>.—</heading><content>In order to be eligible to receive a grant under this section, an applicant for a subaward (specified in subsection (c)(2)) shall submit an application to the Boys and Girls Clubs of America, in such form and containing such information as the Attorney General may reasonably require.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Application requirements</inline>.—</heading><chapeau>Each application submitted in accordance with paragraph (1) shall include—</chapeau><subparagraph style="-uslm-lc:I23" class="indent2"><num value="A">“(A)</num><content> a request for a subgrant to be used for the purposes of this section;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="B">“(B)</num><content> a description of the communities to be served by the grant, including the nature of juvenile crime, violence, and drug use in the communities;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="C">“(C)</num><content> written assurances that Federal funds received under this section will be used to supplement and not supplant, non-Federal funds that would otherwise be available for activities funded under this section;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="D">“(D)</num><content> written assurances that all activities funded under this section will be supervised by qualified adults;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="E">“(E)</num><content> a plan for assuring that program activities will take place in a secure environment that is free of crime and drugs;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="F">“(F)</num><content> a plan outlining the utilization of content-based programs such as PowerUp, and the provision of trained adult personnel to supervise the after-school technology training; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I23" class="indent2"><num value="G">“(G)</num><content> any additional statistical or financial information that the Boys and Girls Clubs of America may reasonably require.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="e">“(e)</num><heading> <inline class="small-caps">Grant Awards</inline>.—</heading><chapeau>In awarding subgrants under this section, the Boys and Girls Clubs of America shall consider—</chapeau><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><content> the ability of the applicant to provide the intended services;</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><content> the history and establishment of the applicant in providing youth activities; and</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="3">“(3)</num><content> the extent to which services will be provided in crime-prone areas and technologically underserved populations, and efforts to achieve an equitable geographic distribution of the grant awards.</content>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I21" class="indent0"><num value="f">“(f)</num><heading> <inline class="small-caps">Authorization of Appropriations.—</inline></heading><paragraph style="-uslm-lc:I22" class="indent1"><num value="1">“(1)</num><heading> <inline class="small-caps">In general</inline>.—</heading><content>There is authorized to be appropriated $20,000,000 for each of the fiscal years 2001 through 2006 to carry out this section.</content>
</paragraph>
<paragraph style="-uslm-lc:I22" class="indent1"><num value="2">“(2)</num><heading> <inline class="small-caps">Source of funds</inline>.—</heading><content>Funds to carry out this section may be derived from the Violent Crime Reduction Trust Fund.</content>
