<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id154cd149-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s12101"><num value="12101">§ 12101.</num><heading> Definitions</heading>
<chapeau style="-uslm-lc:I11" class="indent0">Unless otherwise provided, for purposes of this part—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id154cd14a-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s12101/1"><num value="1">(1)</num><chapeau> the term “indeterminate sentencing” means a system by which—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id154cd14b-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s12101/1/A"><num value="A">(A)</num><content> the court may impose a sentence of a range defined by statute; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id154cd14c-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s12101/1/B"><num value="B">(B)</num><content> an administrative agency, generally the parole board, or the court, controls release within the statutory range;</content>
</subparagraph>

<paragraph style="-uslm-lc:I12" class="indent1" id="id154cd14d-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s12101/2"><num value="2">(2)</num><content> the term “part 1 violent crime” means murder and nonnegligent manslaughter, forcible rape, robbery, and aggravated assault as reported to the Federal Bureau of Investigation for purposes of the Uniform Crime Reports; and</content>

<paragraph style="-uslm-lc:I12" class="indent1" id="id154cd14e-8160-11e9-8f35-c624b526f388" identifier="/us/usc/t34/s12101/3"><num value="3">(3)</num><content> the term “State” means a State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, American Samoa, Guam, and the Northern Mariana Islands.</content>
