L. 110–199, title I, § 104(a), Apr. 9, 2008, 122 Stat. 669.)","seq_in_title":302,"parent_identifier":"/us/usc/t34/stI/ch121/schI/ptA","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI","level":"subtitle","num":"Subtitle I—","heading":"Comprehensive Acts","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121","level":"chapter","num":"CHAPTER 121—","heading":"VIOLENT CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121/schI","level":"subchapter","num":"SUBCHAPTER I—","heading":"PRISONS","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121/schI/ptA","level":"part","num":"Part A—","heading":"Violent Offender Incarceration and Truth-in-Sentencing Incentive Grants","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id26859d14-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12102\"><num value=\"12102\">§ 12102.</num><heading> Authorization of grants</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26859d15-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12102/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General shall provide Violent Offender Incarceration grants under <ref href=\"/us/usc/t34/s12103\">section 12103 of this title</ref> and Truth-in-Sentencing Incentive grants under <ref href=\"/us/usc/t34/s12104\">section 12104 of this title</ref> to eligible States—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26859d16-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12102/a/1\"><num value=\"1\">(1)</num><content> to build or expand correctional facilities to increase the bed capacity for the confinement of persons convicted of a part 1 violent crime or adjudicated delinquent for an act which if committed by an adult, would be a part 1 violent crime;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26859d17-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12102/a/2\"><num value=\"2\">(2)</num><content> to build or expand temporary or permanent correctional facilities, including facilities on military bases, prison barges, and boot camps, for the confinement of convicted nonviolent offenders and criminal aliens, for the purpose of freeing suitable existing prison space for the confinement of persons convicted of a part 1 violent crime;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26859d18-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12102/a/3\"><num value=\"3\">(3)</num><content> to build or expand jails; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26859d19-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12102/a/4\"><num value=\"4\">(4)</num><content> to carry out any activity referred to in <ref href=\"/us/usc/t34/s10631/b\">section 10631(b) of this title</ref>.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26859d1a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12102/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Regional compacts</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26859d1b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12102/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Subject to paragraph (2), States may enter into regional compacts to carry out this part. Such compacts shall be treated as States under this part.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26859d1c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12102/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Requirement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">To be recognized as a regional compact for eligibility for a grant under section 12103 or 12104 of this title, each member State must be eligible individually.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26859d1d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12102/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Limitation on receipt of funds</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">No State may receive a grant under this part both individually and as part of a compact.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26859d1e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12102/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Applicability</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">Notwithstanding the eligibility requirements of <ref href=\"/us/usc/t34/s12104\">section 12104 of this title</ref>, a State that certifies to the Attorney General that, as of <date date=\"1996-04-26\">April 26, 1996</date>, such State has enacted legislation in reliance on this part, as enacted on <date date=\"1994-09-13\">September 13, 1994</date>, and would in fact qualify under those provisions, shall be eligible to receive a grant for fiscal year 1996 as though such State qualifies under <ref href=\"/us/usc/t34/s12104\">section 12104 of this title</ref>.</p>\n</content>\n</subsection>\n<sourceCredit id=\"id2685c42f-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/103/322/tII/s20102\">Pub.
