L. 103–322, title III, § 30801, Sept. 13, 1994, 108 Stat. 1857.)","seq_in_title":328,"parent_identifier":"/us/usc/t34/stI/ch121/schII/ptD","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI","level":"subtitle","num":"Subtitle I—","heading":"Comprehensive Acts","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121","level":"chapter","num":"CHAPTER 121—","heading":"VIOLENT CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121/schII","level":"subchapter","num":"SUBCHAPTER II—","heading":"CRIME PREVENTION","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121/schII/ptD","level":"part","num":"Part D—","heading":"Police Recruitment","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id268c7a50-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171\"><num value=\"12171\">§ 12171.</num><heading> Grant authority</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id268c7a51-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Grants</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id268c7a52-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General may make grants to qualified community organizations to assist in meeting the costs of qualified programs which are designed to recruit and retain applicants to police departments.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id268c7a53-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Consultation with the Ounce of Prevention Council</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General may consult with the Ounce of Prevention Council in making grants under paragraph (1).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id268ca164-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Qualified community organizations</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">An organization is a qualified community organization which is eligible to receive a grant under subsection (a) if the organization—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268ca165-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/b/1\"><num value=\"1\">(1)</num><content> is a nonprofit organization; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268ca166-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/b/2\"><num value=\"2\">(2)</num><chapeau> has training and experience in—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id268ca167-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/b/2/A\"><num value=\"A\">(A)</num><content> working with a police department and with teachers, counselors, and similar personnel,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id268ca168-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/b/2/B\"><num value=\"B\">(B)</num><content> providing services to the community in which the organization is located,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id268ca169-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/b/2/C\"><num value=\"C\">(C)</num><content> developing and managing services and techniques to recruit individuals to become members of a police department and to assist such individuals in meeting the membership requirements of police departments,</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id268ca16a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/b/2/D\"><num value=\"D\">(D)</num><content> developing and managing services and techniques to assist in the retention of applicants to police departments, and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id268ca16b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/b/2/E\"><num value=\"E\">(E)</num><content> developing other programs that contribute to the community.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id268ca16c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Qualified programs</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">A program is a qualified program for which a grant may be made under subsection (a) if the program is designed to recruit and train individuals from underrepresented neighborhoods and localities and if—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268ca16d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/c/1\"><num value=\"1\">(1)</num><content> the overall design of the program is to recruit and retain applicants to a police department;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268ca16e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/c/2\"><num value=\"2\">(2)</num><content> the program provides recruiting services which include tutorial programs to enable individuals to meet police force academic requirements and to pass entrance examinations;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268ca16f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/c/3\"><num value=\"3\">(3)</num><content> the program provides counseling to applicants to police departments who may encounter problems throughout the application process; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268ca170-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/c/4\"><num value=\"4\">(4)</num><content> the program provides retention services to assist in retaining individuals to stay in the application process of a police department.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id268ca171-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Applications</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">To qualify for a grant under subsection (a), a qualified organization shall submit an application to the Attorney General in such form as the Attorney General may prescribe. Such application shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268cc882-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/d/1\"><num value=\"1\">(1)</num><chapeau> include documentation from the applicant showing—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id268cc883-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/d/1/A\"><num value=\"A\">(A)</num><content> the need for the grant;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id268cc884-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/d/1/B\"><num value=\"B\">(B)</num><content> the intended use of grant funds;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id268cc885-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/d/1/C\"><num value=\"C\">(C)</num><content> expected results from the use of grant funds; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id268cc886-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/d/1/D\"><num value=\"D\">(D)</num><content> demographic characteristics of the population to be served, including age, disability, race, ethnicity, and languages used; and</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268cc887-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/d/2\"><num value=\"2\">(2)</num><content> contain assurances satisfactory to the Attorney General that the program for which a grant is made will meet the applicable requirements of the program guidelines prescribed by the Attorney General under subsection (i).</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id268cc888-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Action by Attorney General</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Not later than 60 days after the date that an application for a grant under subsection (a) is received, the Attorney General shall consult with the police department which will be involved with the applicant and shall—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268cc889-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/e/1\"><num value=\"1\">(1)</num><content> approve the application and disburse the grant funds applied for; or</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268cc88a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/e/2\"><num value=\"2\">(2)</num><content> disapprove the application and inform the applicant that the application is not approved and provide the applicant with the reasons for the disapproval.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id268cc88b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Grant disbursement</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General shall disburse funds under a grant under subsection (a) in accordance with regulations of the Attorney General which shall ensure—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268cc88c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/f/1\"><num value=\"1\">(1)</num><content> priority is given to applications for areas and organizations with the greatest showing of need;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268cc88d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/f/2\"><num value=\"2\">(2)</num><content> that grant funds are equitably distributed on a geographic basis; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268cc88e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/f/3\"><num value=\"3\">(3)</num><content> the needs of underserved populations are recognized and addressed.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id268cc88f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Grant period</heading><content><p style=\"-uslm-lc:I11\" class=\"indent0\">A grant under subsection (a) shall be made for a period not longer than 3 years.</p>\n</content>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id268cc890-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/h\"><num value=\"h\" class=\"bold\">(h)</num><heading class=\"bold\"> Grantee reporting</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id268cc891-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/h/1\"><num value=\"1\">(1)</num><content> For each year of a grant period for a grant under subsection (a), the recipient of the grant shall file a performance report with the Attorney General explaining the activities carried out with the funds received and assessing the effectiveness of such activities in meeting the purpose of the recipient’s qualified program.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id268cefa2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/h/2\"><num value=\"2\">(2)</num><content> If there was more than one recipient of a grant, each recipient shall file such report.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id268cefa3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/h/3\"><num value=\"3\">(3)</num><content> The Attorney General shall suspend the funding of a grant, pending compliance, if the recipient of the grant does not file the report required by this subsection or uses the grant for a purpose not authorized by this section.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id268cefa4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Guidelines</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General shall, by regulation, prescribe guidelines on content and results for programs receiving a grant under subsection (a). Such guidelines shall be designed to establish programs which will be effective in training individuals to enter instructional programs for police departments and shall include requirements for—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268cefa5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/i/1\"><num value=\"1\">(1)</num><content> individuals providing recruiting services;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268cefa6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/i/2\"><num value=\"2\">(2)</num><content> individuals providing tutorials and other academic assistance programs;</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268cefa7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/i/3\"><num value=\"3\">(3)</num><content> individuals providing retention services; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id268cefa8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12171/i/4\"><num value=\"4\">(4)</num><content> the content and duration of recruitment, retention, and counseling programs and the means and devices used to publicize such programs.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id268cefa9-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/103/322/tIII/s30801\">Pub.
