L. 113–4, § 3, Mar. 7, 2013, 127 Stat. 56.)","seq_in_title":355,"parent_identifier":"/us/usc/t34/stI/ch121/schIII","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI","level":"subtitle","num":"Subtitle I—","heading":"Comprehensive Acts","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121","level":"chapter","num":"CHAPTER 121—","heading":"VIOLENT CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"VIOLENCE AGAINST WOMEN","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id2690c056-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291\"><num value=\"12291\">§ 12291.</num><heading> Definitions and grant provisions</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2690c057-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Definitions</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">In this subchapter:</chapeau><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2690c058-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Alaska Native village</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Alaska Native village” has the same meaning given such term in the Alaska Native Claims Settlement Act (<ref href=\"/us/usc/t43/s1601\">43 U.S.C. 1601</ref> et seq.).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2690e769-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Courts</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “courts” means any civil or criminal, tribal, and Alaska Native Village, Federal, State, local or territorial court having jurisdiction to address domestic violence, dating violence, sexual assault or stalking, including immigration, family, juvenile, and dependency courts, and the judicial officers serving in those courts, including judges, magistrate judges, commissioners, justices of the peace, or any other person with decisionmaking authority.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2690e76a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Child abuse and neglect</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “child abuse and neglect” means any recent act or failure to act on the part of a parent or caregiver with intent to cause death, serious physical or emotional harm, sexual abuse, or exploitation, or an act or failure to act which presents an imminent risk of serious harm to an unemancipated minor. This definition shall not be construed to mean that failure to leave an abusive relationship, in the absence of other action constituting abuse or neglect, is itself abuse or neglect.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2690e76b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Community-based organization</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “community-based organization” means a nonprofit, nongovernmental, or tribal organization that serves a specific geographic community that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2690e76c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/4/A\"><num value=\"A\">(A)</num><content> focuses primarily on domestic violence, dating violence, sexual assault, or stalking;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2690e76d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/4/B\"><num value=\"B\">(B)</num><content> has established a specialized culturally specific program that addresses domestic violence, dating violence, sexual assault, or stalking;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2690e76e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/4/C\"><num value=\"C\">(C)</num><content> has a primary focus on underserved populations (and includes representatives of these populations) and domestic violence, dating violence, sexual assault, or stalking; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2690e76f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/4/D\"><num value=\"D\">(D)</num><content> obtains expertise, or shows demonstrated capacity to work effectively, on domestic violence, dating violence, sexual assault, and stalking through collaboration.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2690e770-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Child maltreatment</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “child maltreatment” means the physical or psychological abuse or neglect of a child or youth, including sexual assault and abuse.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26910e81-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Culturally specific</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “culturally specific” means primarily directed toward racial and ethnic minority groups (as defined in section 1707(g) of the Public Health Service Act (<ref href=\"/us/usc/t42/s300u–6/g\">42 U.S.C. 300u–6(g)</ref>).<ref class=\"footnoteRef\" idref=\"fn002101\">1</ref><note type=\"footnote\" id=\"fn002101\"><num>1</num> So in original. The period probably should be preceded by another closing parenthesis.</note></p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26910e82-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Culturally specific services</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “culturally specific services” means community-based services that include culturally relevant and linguistically specific services and resources to culturally specific communities.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26910e83-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Domestic violence</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “domestic violence” includes felony or misdemeanor crimes of violence committed by a current or former spouse or intimate partner of the victim, by a person with whom the victim shares a child in common, by a person who is cohabitating with or has cohabitated with the victim as a spouse or intimate partner, by a person similarly situated to a spouse of the victim under the domestic or family violence laws of the jurisdiction receiving grant monies, or by any other person against an adult or youth victim who is protected from that person’s acts under the domestic or family violence laws of the jurisdiction.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26910e84-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> Dating partner</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “dating partner” refers to a person who is or has been in a social relationship of a romantic or intimate nature with the abuser, and where the existence of such a relationship shall be determined based on a consideration of—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26910e85-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/9/A\"><num value=\"A\">(A)</num><content> the length of the relationship;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26910e86-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/9/B\"><num value=\"B\">(B)</num><content> the type of relationship; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26910e87-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/9/C\"><num value=\"C\">(C)</num><content> the frequency of interaction between the persons involved in the relationship.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26910e88-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> Dating violence</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “dating violence” means violence committed by a person—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26910e89-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/10/A\"><num value=\"A\">(A)</num><content> who is or has been in a social relationship of a romantic or intimate nature with the victim; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26910e8a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/10/B\"><num value=\"B\">(B)</num><chapeau> where the existence of such a relationship shall be determined based on a consideration of the following factors:</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2691359b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/10/B/i\"><num value=\"i\">(i)</num><content> The length of the relationship.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2691359c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/10/B/ii\"><num value=\"ii\">(ii)</num><content> The type of relationship.</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2691359d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/10/B/iii\"><num value=\"iii\">(iii)</num><content> The frequency of interaction between the persons involved in the relationship.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691359e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/11\"><num value=\"11\" class=\"bold\">(11)</num><heading class=\"bold\"> Elder abuse</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “elder abuse” means any action against a person who is 50 years of age or older that constitutes the willful—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691359f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/11/A\"><num value=\"A\">(A)</num><content> infliction of injury, unreasonable confinement, intimidation, or cruel punishment with resulting physical harm, pain, or mental anguish; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id269135a0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/11/B\"><num value=\"B\">(B)</num><content> deprivation by a person, including a caregiver, of goods or services with intent to cause physical harm, mental anguish, or mental illness.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269135a1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/12\"><num value=\"12\" class=\"bold\">(12)</num><heading class=\"bold\"> Homeless</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “homeless” has the meaning provided in <ref href=\"/us/usc/t34/s12473/6\">section 12473(6) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269135a2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/13\"><num value=\"13\" class=\"bold\">(13)</num><heading class=\"bold\"> Indian</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Indian” means a member of an Indian tribe.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269135a3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/14\"><num value=\"14\" class=\"bold\">(14)</num><heading class=\"bold\"> Indian country</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Indian country” has the same meaning given such term in <ref href=\"/us/usc/t18/s1151\">section 1151 of title 18</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269135a4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/15\"><num value=\"15\" class=\"bold\">(15)</num><heading class=\"bold\"> Indian housing</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Indian housing” means housing assistance described in the Native American Housing Assistance and Self-Determination Act of 1996 (<ref href=\"/us/usc/t25/s4101\">25 U.S.C. 4101</ref> et seq., as amended).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269135a5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/16\"><num value=\"16\" class=\"bold\">(16)</num><heading class=\"bold\"> Indian tribe</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Indian tribe” means a tribe, band, pueblo, nation, or other organized group or community of Indians, including any Alaska Native village or regional or village corporation (as defined in, or established pursuant to, the Alaska Native Claims Settlement Act (<ref href=\"/us/usc/t43/s1601\">43 U.S.C. 1601</ref> et seq.)), that is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269135a6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/17\"><num value=\"17\" class=\"bold\">(17)</num><heading class=\"bold\"> Indian law enforcement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “Indian law enforcement” means the departments or individuals under the direction of the Indian tribe that maintain public order.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269135a7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/18\"><num value=\"18\" class=\"bold\">(18)</num><heading class=\"bold\"> Law enforcement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “law enforcement” means a public agency charged with policing functions, including any of its component bureaus (such as governmental victim services programs or Village Public Safety Officers), including those referred to in <ref href=\"/us/usc/t25/s2802\">section 2802 of title 25</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26915cb8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/19\"><num value=\"19\" class=\"bold\">(19)</num><heading class=\"bold\"> Legal assistance</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “legal assistance” includes assistance to adult and youth victims of domestic violence, dating violence, sexual assault, and stalking in—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26915cb9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/19/A\"><num value=\"A\">(A)</num><content> family, tribal, territorial, immigration, employment, administrative agency, housing matters, campus administrative or protection or stay away order proceedings, and other similar matters; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26915cba-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/19/B\"><num value=\"B\">(B)</num><content> criminal justice investigations, prosecutions and post-trial matters (including sentencing, parole, and probation) that impact the victim’s safety and privacy.</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">Intake or referral, by itself, does not constitute legal assistance.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26915cbb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/20\"><num value=\"20\" class=\"bold\">(20)</num><heading class=\"bold\"> Personally identifying information or personal information</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “personally identifying information” or “personal information” means individually identifying information for or about an individual including information likely to disclose the location of a victim of domestic violence, dating violence, sexual assault, or stalking, regardless of whether the information is encoded, encrypted, hashed, or otherwise protected, including—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26915cbc-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/20/A\"><num value=\"A\">(A)</num><content> a first and last name;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26915cbd-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/20/B\"><num value=\"B\">(B)</num><content> a home or other physical address;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26915cbe-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/20/C\"><num value=\"C\">(C)</num><content> contact information (including a postal, e-mail or Internet protocol address, or telephone or facsimile number);</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26915cbf-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/20/D\"><num value=\"D\">(D)</num><content> a social security number, driver license number, passport number, or student identification number; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26915cc0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/20/E\"><num value=\"E\">(E)</num><content> any other information, including date of birth, racial or ethnic background, or religious affiliation, that would serve to identify any individual.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26915cc1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/21\"><num value=\"21\" class=\"bold\">(21)</num><heading class=\"bold\"> Population specific organization</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “population specific organization” means a nonprofit, nongovernmental organization that primarily serves members of a specific underserved population and has demonstrated experience and expertise providing targeted services to members of that specific underserved population.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269183d2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/22\"><num value=\"22\" class=\"bold\">(22)</num><heading class=\"bold\"> Population specific services</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “population specific services” means victim-centered services that address the safety, health, economic, legal, housing, workplace, immigration, confidentiality, or other needs of victims of domestic violence, dating violence, sexual assault, or stalking, and that are designed primarily for and are targeted to a specific underserved population.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269183d3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/23\"><num value=\"23\" class=\"bold\">(23)</num><heading class=\"bold\"> Prosecution</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “prosecution” means any public agency charged with direct responsibility for prosecuting criminal offenders, including such agency’s component bureaus (such as governmental victim assistance programs).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269183d4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/24\"><num value=\"24\" class=\"bold\">(24)</num><heading class=\"bold\"> Protection order or restraining order</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “protection order” or “restraining order” includes—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id269183d5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/24/A\"><num value=\"A\">(A)</num><content> any injunction, restraining order, or any other order issued by a civil or criminal court for the purpose of preventing violent or threatening acts or harassment against, sexual violence or contact or communication with or physical proximity to, another person, including any temporary or final orders issued by civil or criminal courts whether obtained by filing an independent action or as a pendente lite order in another proceeding so long as any civil order was issued in response to a complaint, petition, or motion filed by or on behalf of a person seeking protection; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id269183d6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/24/B\"><num value=\"B\">(B)</num><content> any support, child custody or visitation provisions, orders, remedies, or relief issued as part of a protection order, restraining order, or stay away injunction pursuant to State, tribal, territorial, or local law authorizing the issuance of protection orders, restraining orders, or injunctions for the protection of victims of domestic violence, dating violence, sexual assault, or stalking.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269183d7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/25\"><num value=\"25\" class=\"bold\">(25)</num><heading class=\"bold\"> Rape crisis center</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “rape crisis center” means a nonprofit, nongovernmental, or tribal organization, or governmental entity in a State other than a Territory that provides intervention and related assistance, as specified in <ref href=\"/us/usc/t34/s12511/b/2/C\">section 12511(b)(2)(C) of this title</ref>, to victims of sexual assault without regard to their age. In the case of a governmental entity, the entity may not be part of the criminal justice system (such as a law enforcement agency) and must be able to offer a comparable level of confidentiality as a nonprofit entity that provides similar victim services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691aae8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/26\"><num value=\"26\" class=\"bold\">(26)</num><heading class=\"bold\"> Rural area and rural community</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “rural area” and “rural community” mean—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691aae9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/26/A\"><num value=\"A\">(A)</num><content> any area or community, respectively, no part of which is within an area designated as a standard metropolitan statistical area by the Office of Management and Budget;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691aaea-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/26/B\"><num value=\"B\">(B)</num><chapeau> any area or community, respectively, that is—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2691aaeb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/26/B/i\"><num value=\"i\">(i)</num><content> within an area designated as a metropolitan statistical area or considered as part of a metropolitan statistical area; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2691aaec-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/26/B/ii\"><num value=\"ii\">(ii)</num><content> located in a rural census tract; or</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691aaed-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/26/C\"><num value=\"C\">(C)</num><content> any federally recognized Indian tribe.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691aaee-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/27\"><num value=\"27\" class=\"bold\">(27)</num><heading class=\"bold\"> Rural State</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “rural State” means a State that has a population density of 57 or fewer persons per square mile or a State in which the largest county has fewer than 250,000 people, based on the most recent decennial census.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691aaef-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/28\"><num value=\"28\" class=\"bold\">(28)</num><heading class=\"bold\"> Sex trafficking</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “sex trafficking” means any conduct proscribed by <ref href=\"/us/usc/t18/s1591\">section 1591 of title 18</ref>, whether or not the conduct occurs in interstate or foreign commerce or within the special maritime and territorial jurisdiction of the United States.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691aaf0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/29\"><num value=\"29\" class=\"bold\">(29)</num><heading class=\"bold\"> Sexual assault</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “sexual assault” means any nonconsensual sexual act proscribed by Federal, tribal, or State law, including when the victim lacks capacity to consent.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691aaf1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/30\"><num value=\"30\" class=\"bold\">(30)</num><heading class=\"bold\"> Stalking</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “stalking” means engaging in a course of conduct directed at a specific person that would cause a reasonable person to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691aaf2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/30/A\"><num value=\"A\">(A)</num><content> fear for his or her safety or the safety of others; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691aaf3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/30/B\"><num value=\"B\">(B)</num><content> suffer substantial emotional distress.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691aaf4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/31\"><num value=\"31\" class=\"bold\">(31)</num><heading class=\"bold\"> State</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State” means each of the several States and the District of Columbia, and except as otherwise provided, the Commonwealth of Puerto Rico, Guam, American Samoa, the Virgin Islands, and the Northern Mariana Islands.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691d205-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/32\"><num value=\"32\" class=\"bold\">(32)</num><heading class=\"bold\"> State domestic violence coalition</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State domestic violence coalition” means a program determined by the Administration for Children and Families under sections 10402 and 10411 of title 42.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691d206-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/33\"><num value=\"33\" class=\"bold\">(33)</num><heading class=\"bold\"> State sexual assault coalition</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “State sexual assault coalition” means a program determined by the Center for Injury Prevention and Control of the Centers for Disease Control and Prevention under the Public Health Service Act (<ref href=\"/us/usc/t42/s280b\">42 U.S.C. 280b</ref> et seq.).</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691d207-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/34\"><num value=\"34\" class=\"bold\">(34)</num><heading class=\"bold\"> Territorial domestic violence or sexual assault coalition</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “territorial domestic violence or sexual assault coalition” means a program addressing domestic or sexual violence that is—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691d208-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/34/A\"><num value=\"A\">(A)</num><content> an established nonprofit, nongovernmental territorial coalition addressing domestic violence or sexual assault within the territory; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691d209-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/34/B\"><num value=\"B\">(B)</num><content> a nongovernmental organization with a demonstrated history of addressing domestic violence or sexual assault within the territory that proposes to incorporate as a nonprofit, nongovernmental territorial coalition.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691d20a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/35\"><num value=\"35\" class=\"bold\">(35)</num><heading class=\"bold\"> Tribal coalition</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “tribal coalition” means an established nonprofit, nongovernmental Indian organization, Alaska Native organization, or a Native Hawaiian organization that—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691d20b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/35/A\"><num value=\"A\">(A)</num><content> provides education, support, and technical assistance to member Indian service providers in a manner that enables those member providers to establish and maintain culturally appropriate services, including shelter and rape crisis services, designed to assist Indian women and the dependents of those women who are victims of domestic violence, dating violence, sexual assault, and stalking; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691d20c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/35/B\"><num value=\"B\">(B)</num><chapeau> is comprised of board and general members that are representative of—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2691d20d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/35/B/i\"><num value=\"i\">(i)</num><content> the member service providers described in subparagraph (A); and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2691d20e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/35/B/ii\"><num value=\"ii\">(ii)</num><content> the tribal communities in which the services are being provided.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691f91f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/36\"><num value=\"36\" class=\"bold\">(36)</num><heading class=\"bold\"> Tribal government</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “tribal government” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691f920-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/36/A\"><num value=\"A\">(A)</num><content> the governing body of an Indian tribe; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691f921-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/36/B\"><num value=\"B\">(B)</num><content> a tribe, band, pueblo, nation, or other organized group or community of Indians, including any Alaska Native village or regional or village corporation (as defined in, or established pursuant to, the Alaska Native Claims Settlement Act (<ref href=\"/us/usc/t43/s1601\">43 U.S.C. 1601</ref> et seq.)), that is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691f922-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/37\"><num value=\"37\" class=\"bold\">(37)</num><heading class=\"bold\"> Tribal nonprofit organization</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “tribal nonprofit organization” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691f923-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/37/A\"><num value=\"A\">(A)</num><content> a victim services provider that has as its primary purpose to assist Native victims of domestic violence, dating violence, sexual assault, or stalking; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691f924-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/37/B\"><num value=\"B\">(B)</num><content> staff and leadership of the organization must include persons with a demonstrated history of assisting American Indian or Alaska Native victims of domestic violence, dating violence, sexual assault, or stalking.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691f925-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/38\"><num value=\"38\" class=\"bold\">(38)</num><heading class=\"bold\"> Tribal organization</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The term “tribal organization” means—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691f926-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/38/A\"><num value=\"A\">(A)</num><content> the governing body of any Indian tribe;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691f927-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/38/B\"><num value=\"B\">(B)</num><content> any legally established organization of Indians which is controlled, sanctioned, or chartered by such governing body of a tribe or tribes to be served, or which is democratically elected by the adult members of the Indian community to be served by such organization and which includes the maximum participation of Indians in all phases of its activities; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2691f928-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/38/C\"><num value=\"C\">(C)</num><content> any tribal nonprofit organization.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2691f929-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/39\"><num value=\"39\" class=\"bold\">(39)</num><heading class=\"bold\"> Underserved populations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “underserved populations” means populations who face barriers in accessing and using victim services, and includes populations underserved because of geographic location, religion, sexual orientation, gender identity, underserved racial and ethnic populations, populations underserved because of special needs (such as language barriers, disabilities, alienage status, or age), and any other population determined to be underserved by the Attorney General or by the Secretary of Health and Human Services, as appropriate.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692203a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/40\"><num value=\"40\" class=\"bold\">(40)</num><heading class=\"bold\"> Unit of local government</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “unit of local government” means any city, county, township, town, borough, parish, village, or other general purpose political subdivision of a State.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692203b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/41\"><num value=\"41\" class=\"bold\">(41)</num><heading class=\"bold\"> Victim advocate</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “victim advocate” means a person, whether paid or serving as a volunteer, who provides services to victims of domestic violence, sexual assault, stalking, or dating violence under the auspices or supervision of a victim services program.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692203c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/42\"><num value=\"42\" class=\"bold\">(42)</num><heading class=\"bold\"> Victim assistant</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “victim assistant” means a person, whether paid or serving as a volunteer, who provides services to victims of domestic violence, sexual assault, stalking, or dating violence under the auspices or supervision of a court or a law enforcement or prosecution agency.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692203d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/43\"><num value=\"43\" class=\"bold\">(43)</num><heading class=\"bold\"> Victim service provider</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “victim service provider” means a nonprofit, nongovernmental or tribal organization or rape crisis center, including a State or tribal coalition, that assists or advocates for domestic violence, dating violence, sexual assault, or stalking victims, including domestic violence shelters, faith-based organizations, and other organizations, with a documented history of effective work concerning domestic violence, dating violence, sexual assault, or stalking.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692203e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/44\"><num value=\"44\" class=\"bold\">(44)</num><heading class=\"bold\"> Victim services or services</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The terms “victim services” and “services” mean services provided to victims of domestic violence, dating violence, sexual assault, or stalking, including telephonic or web-based hotlines, legal advocacy, economic advocacy, emergency and transitional shelter, accompaniment and advocacy through medical, civil or criminal justice, immigration, and social support systems, crisis intervention, short-term individual and group support services, information and referrals, culturally specific services, population specific services, and other related supportive services.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692203f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/a/45\"><num value=\"45\" class=\"bold\">(45)</num><heading class=\"bold\"> Youth</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The term “youth” means a person who is 11 to 24 years old.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26924750-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Grant conditions</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26924751-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Match</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">No matching funds shall be required for any grant or subgrant made under this Act for—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26924752-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/1/A\"><num value=\"A\">(A)</num><content> any tribe, territory, or victim service provider; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26924753-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/1/B\"><num value=\"B\">(B)</num><chapeau> any other entity, including a State, that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26924754-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/1/B/i\"><num value=\"i\">(i)</num><content> petitions for a waiver of any match condition imposed by the Attorney General or the Secretaries of Health and Human Services or Housing and Urban Development; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26924755-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/1/B/ii\"><num value=\"ii\">(ii)</num><content> whose petition for waiver is determined by the Attorney General or the Secretaries of Health and Human Services or Housing and Urban Development to have adequately demonstrated the financial need of the petitioning entity.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26924756-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Nondisclosure of confidential or private information</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26924757-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">In order to ensure the safety of adult, youth, and child victims of domestic violence, dating violence, sexual assault, or stalking, and their families, grantees and subgrantees under this subchapter shall protect the confidentiality and privacy of persons receiving services.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26924758-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Nondisclosure</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Subject to subparagraphs (C) and (D), grantees and subgrantees shall not—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26924759-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/B/i\"><num value=\"i\">(i)</num><content> disclose, reveal, or release any personally identifying information or individual information collected in connection with services requested, utilized, or denied through grantees’ and subgrantees’ programs, regardless of whether the information has been encoded, encrypted, hashed, or otherwise protected; or</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2692475a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/B/ii\"><num value=\"ii\">(ii)</num><content> disclose, reveal, or release individual client information without the informed, written, reasonably time-limited consent of the person (or in the case of an unemancipated minor, the minor and the parent or guardian or in the case of legal incapacity, a court-appointed guardian) about whom information is sought, whether for this program or any other Federal, State, tribal, or territorial grant program, except that consent for release may not be given by the abuser of the minor, incapacitated person, or the abuser of the other parent of the minor.</content>\n</clause>\n\n<continuation style=\"-uslm-lc:I32\" class=\"indent2 firstIndent0\">If a minor or a person with a legally appointed guardian is permitted by law to receive services without the parent’s or guardian’s consent, the minor or person with a guardian may release information without additional consent.</continuation>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26926e6b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Release</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">If release of information described in subparagraph (B) is compelled by statutory or court mandate—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26926e6c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/C/i\"><num value=\"i\">(i)</num><content> grantees and subgrantees shall make reasonable attempts to provide notice to victims affected by the disclosure of information; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26926e6d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/C/ii\"><num value=\"ii\">(ii)</num><content> grantees and subgrantees shall take steps necessary to protect the privacy and safety of the persons affected by the release of the information.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26926e6e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Information sharing</heading><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26926e6f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/D/i\"><num value=\"i\">(i)</num><chapeau> Grantees and subgrantees may share—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26926e70-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/D/i/I\"><num value=\"I\">(I)</num><content> nonpersonally identifying data in the aggregate regarding services to their clients and nonpersonally identifying demographic information in order to comply with Federal, State, tribal, or territorial reporting, evaluation, or data collection requirements;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26926e71-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/D/i/II\"><num value=\"II\">(II)</num><content> court-generated information and law enforcement-generated information contained in secure, governmental registries for protection order enforcement purposes; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26926e72-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/D/i/III\"><num value=\"III\">(III)</num><content> law enforcement-generated and prosecution-generated information necessary for law enforcement and prosecution purposes.</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26926e73-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/D/ii\"><num value=\"ii\">(ii)</num><chapeau> In no circumstances may—</chapeau><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26926e74-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/D/ii/I\"><num value=\"I\">(I)</num><content> an adult, youth, or child victim of domestic violence, dating violence, sexual assault, or stalking be required to provide a consent to release his or her personally identifying information as a condition of eligibility for the services provided by the grantee or subgrantee;</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26926e75-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/D/ii/II\"><num value=\"II\">(II)</num><content> any personally identifying information be shared in order to comply with Federal, tribal, or State reporting, evaluation, or data collection requirements, whether for this program or any other Federal, tribal, or State grant program.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26929586-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/E\"><num value=\"E\" class=\"bold\">(E)</num><heading class=\"bold\"> Statutorily mandated reports of abuse or neglect</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Nothing in this section prohibits a grantee or subgrantee from reporting suspected abuse or neglect, as those terms are defined and specifically mandated by the State or tribe involved.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26929587-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/F\"><num value=\"F\" class=\"bold\">(F)</num><heading class=\"bold\"> Oversight</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Nothing in this paragraph shall prevent the Attorney General from disclosing grant activities authorized in this Act to the chairman and ranking members of the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate exercising Congressional oversight authority. All disclosures shall protect confidentiality and omit personally identifying information, including location information about individuals.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26929588-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/2/G\"><num value=\"G\" class=\"bold\">(G)</num><heading class=\"bold\"> Confidentiality assessment and assurances</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Grantees and subgrantees must document their compliance with the confidentiality and privacy provisions required under this section.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26929589-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Approved activities</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">In carrying out the activities under this subchapter, grantees and subgrantees may collaborate with or provide information to Federal, State, local, tribal, and territorial public officials and agencies to develop and implement policies and develop and promote State, local, or tribal legislation or model codes designed to reduce or eliminate domestic violence, dating violence, sexual assault, and stalking.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692958a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/4\"><num value=\"4\" class=\"bold\">(4)</num><heading class=\"bold\"> Non-supplantation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any Federal funds received under this subchapter shall be used to supplement, not supplant, non-Federal funds that would otherwise be available for activities under this subchapter.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692958b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/5\"><num value=\"5\" class=\"bold\">(5)</num><heading class=\"bold\"> Use of funds</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Funds authorized and appropriated under this subchapter may be used only for the specific purposes described in this subchapter and shall remain available until expended.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692958c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/6\"><num value=\"6\" class=\"bold\">(6)</num><heading class=\"bold\"> Reports</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">An entity receiving a grant under this subchapter shall submit to the disbursing agency a report detailing the activities undertaken with the grant funds, including and providing additional information as the agency shall require.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692958d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/7\"><num value=\"7\" class=\"bold\">(7)</num><heading class=\"bold\"> Evaluation</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Federal agencies disbursing funds under this subchapter shall set aside up to 3 percent of such funds in order to conduct—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2692bc9e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/7/A\"><num value=\"A\">(A)</num><content> evaluations of specific programs or projects funded by the disbursing agency under this subchapter or related research; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2692bc9f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/7/B\"><num value=\"B\">(B)</num><content> evaluations of promising practices or problems emerging in the field or related research, in order to inform the agency or agencies as to which programs or projects are likely to be effective or responsive to needs in the field.</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I17\" class=\"indent1 firstIndent0\">Final reports of such evaluations shall be made available to the public via the agency’s website.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692bca0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/8\"><num value=\"8\" class=\"bold\">(8)</num><heading class=\"bold\"> Nonexclusivity</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Nothing in this subchapter shall be construed to prohibit male victims of domestic violence, dating violence, sexual assault, and stalking from receiving benefits and services under this subchapter.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692bca1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/9\"><num value=\"9\" class=\"bold\">(9)</num><heading class=\"bold\"> Prohibition on tort litigation</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Funds appropriated for the grant program under this subchapter may not be used to fund civil representation in a lawsuit based on a tort claim. This paragraph should not be construed as a prohibition on providing assistance to obtain restitution in a protection order or criminal case.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692bca2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/10\"><num value=\"10\" class=\"bold\">(10)</num><heading class=\"bold\"> Prohibition on lobbying</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any funds appropriated for the grant program shall be subject to the prohibition in <ref href=\"/us/usc/t18/s1913\">section 1913 of title 18</ref>, relating to lobbying with appropriated moneys.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692bca3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/11\"><num value=\"11\" class=\"bold\">(11)</num><heading class=\"bold\"> Technical assistance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Of the total amounts appropriated under this subchapter, not less than 3 percent and up to 8 percent, unless otherwise noted, shall be available for providing training and technical assistance relating to the purposes of this subchapter to improve the capacity of the grantees, subgrantees, and other entities. If there is a demonstrated history that the Office on Violence Against Women has previously set aside amounts greater than 8 percent for technical assistance and training relating to grant programs authorized under this subchapter, the Office has the authority to continue setting aside amounts greater than 8 percent.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692bca4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/12\"><num value=\"12\" class=\"bold\">(12)</num><heading class=\"bold\"> Delivery of legal assistance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Any grantee or subgrantee providing legal assistance with funds awarded under this subchapter shall comply with the eligibility requirements in <ref href=\"/us/usc/t34/s20121/d\">section 20121(d) of this title</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692e2b5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/13\"><num value=\"13\" class=\"bold\">(13)</num><heading class=\"bold\"> Civil rights</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id2692e2b6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/13/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Nondiscrimination</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">No person in the United States shall, on the basis of actual or perceived race, color, religion, national origin, sex, gender identity (as defined in paragraph 249(c)(4) of title 18), sexual orientation, or disability, be excluded from participation in, be denied the benefits of, or be subjected to discrimination under any program or activity funded in whole or in part with funds made available under the Violence Against Women Act of 1994 (title IV of <ref href=\"/us/pl/103/322\">Public Law 103–322</ref>; <ref href=\"/us/stat/108/1902\">108 Stat. 1902</ref>), the Violence Against Women Act of 2000 (division B of <ref href=\"/us/pl/106/386\">Public Law 106–386</ref>; <ref href=\"/us/stat/114/1491\">114 Stat. 1491</ref>), the Violence Against Women and Department of Justice Reauthorization Act of 2005 (title IX of <ref href=\"/us/pl/109/162\">Public Law 109–162</ref>; <ref href=\"/us/stat/119/3080\">119 Stat. 3080</ref>),<ref class=\"footnoteRef\" idref=\"fn002102\">2</ref><note type=\"footnote\" id=\"fn002102\"><num>2</num> See References in Text note below.</note> the Violence Against Women Reauthorization Act of 2013, and any other program or activity funded in whole or in part with funds appropriated for grants, cooperative agreements, and other assistance administered by the Office on Violence Against Women.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id2692e2b7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/13/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">If sex segregation or sex-specific programming is necessary to the essential operation of a program, nothing in this paragraph shall prevent any such program or activity from consideration of an individual’s sex. In such circumstances, grantees may meet the requirements of this paragraph by providing comparable services to individuals who cannot be provided with the sex-segregated or sex-specific programming.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id2692e2b8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/13/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Discrimination</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The authority of the Attorney General and the Office of Justice Programs to enforce this paragraph shall be the same as it is under <ref href=\"/us/usc/t34/s10228\">section 10228 of this title</ref>.<sup>2</sup></p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id2692e2b9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/13/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Construction</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Nothing contained in this paragraph shall be construed, interpreted, or applied to supplant, displace, preempt, or otherwise diminish the responsibilities and liabilities under other State or Federal civil rights law, whether statutory or common.</p>\n</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2692e2ba-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/14\"><num value=\"14\" class=\"bold\">(14)</num><heading class=\"bold\"> Clarification of victim services and legal assistance</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Victim services and legal assistance under this subchapter also include services and assistance to victims of domestic violence, dating violence, sexual assault, or stalking who are also victims of severe forms of trafficking in persons as defined by <ref href=\"/us/usc/t22/s7102\">section 7102 of title 22</ref>.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269309cb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/15\"><num value=\"15\" class=\"bold\">(15)</num><heading class=\"bold\"> Conferral</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id269309cc-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/15/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The Office on Violence Against Women shall establish a biennial conferral process with State and tribal coalitions and technical assistance providers who receive funding through grants administered by the Office on Violence Against Women and authorized by this Act, and other key stakeholders.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id269309cd-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/15/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Areas covered</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">The areas of conferral under this paragraph shall include—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id269309ce-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/15/B/i\"><num value=\"i\">(i)</num><content> the administration of grants;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id269309cf-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/15/B/ii\"><num value=\"ii\">(ii)</num><content> unmet needs;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id269309d0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/15/B/iii\"><num value=\"iii\">(iii)</num><content> promising practices in the field; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id269309d1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/15/B/iv\"><num value=\"iv\">(iv)</num><content> emerging trends.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id269309d2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/15/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Initial conferral</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The first conferral shall be initiated not later than 6 months after <date date=\"2013-03-07\">March 7, 2013</date>.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id269309d3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/15/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Report</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Not later than 90 days after the conclusion of each conferral period, the Office on Violence Against Women shall publish a comprehensive report that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id269309d4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/15/D/i\"><num value=\"i\">(i)</num><content> summarizes the issues presented during conferral and what, if any, policies it intends to implement to address those issues;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id269309d5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/15/D/ii\"><num value=\"ii\">(ii)</num><content> is made available to the public on the Office on Violence Against Women’s website and submitted to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives.</content>\n</clause>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id269309d6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16\"><num value=\"16\" class=\"bold\">(16)</num><heading class=\"bold\"> Accountability</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">All grants awarded by the Attorney General under this Act shall be subject to the following accountability provisions:</chapeau><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id269330e7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> Audit requirement</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id269330e8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/A/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Beginning in the first fiscal year beginning after the date of the enactment of this Act,<sup>2</sup> and in each fiscal year thereafter, the Inspector General of the Department of Justice shall conduct audits of recipients of grants under this Act to prevent waste, fraud, and abuse of funds by grantees. The Inspector General shall determine the appropriate number of grantees to be audited each year.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id269330e9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/A/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Definition</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">In this paragraph, the term “unresolved audit finding” means a finding in the final audit report of the Inspector General of the Department of Justice that the audited grantee has utilized grant funds for an unauthorized expenditure or otherwise unallowable cost that is not closed or resolved within 12 months from the date when the final audit report is issued.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id269330ea-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/A/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Mandatory exclusion</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">A recipient of grant funds under this Act that is found to have an unresolved audit finding shall not be eligible to receive grant funds under this Act during the following 2 fiscal years.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id269330eb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/A/iv\"><num value=\"iv\" class=\"bold\">(iv)</num><heading class=\"bold\"> Priority</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">In awarding grants under this Act, the Attorney General shall give priority to eligible entities that did not have an unresolved audit finding during the 3 fiscal years prior to submitting an application for a grant under this Act.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id269330ec-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/A/v\"><num value=\"v\" class=\"bold\">(v)</num><heading class=\"bold\"> Reimbursement</heading><chapeau style=\"-uslm-lc:I14\" class=\"indent3\">If an entity is awarded grant funds under this Act during the 2-fiscal-year period in which the entity is barred from receiving grants under paragraph (2), the Attorney General shall—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id269330ed-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/A/v/I\"><num value=\"I\">(I)</num><content> deposit an amount equal to the grant funds that were improperly awarded to the grantee into the General Fund of the Treasury; and</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id269330ee-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/A/v/II\"><num value=\"II\">(II)</num><content> seek to recoup the costs of the repayment to the fund from the grant recipient that was erroneously awarded grant funds.</content>\n</subclause>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id269357ff-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Nonprofit organization requirements</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id26935800-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/B/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Definition</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">For purposes of this paragraph and the grant programs described in this Act, the term “nonprofit organization” means an organization that is described in <ref href=\"/us/usc/t26/s501/c/3\">section 501(c)(3) of title 26</ref> and is exempt from taxation under section 501(a) of such title.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id26935801-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/B/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Prohibition</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Attorney General may not award a grant under any grant program described in this Act to a nonprofit organization that holds money in offshore accounts for the purpose of avoiding paying the tax described in <ref href=\"/us/usc/t26/s511/a\">section 511(a) of title 26</ref>.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id26935802-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/B/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Disclosure</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Each nonprofit organization that is awarded a grant under a grant program described in this Act and uses the procedures prescribed in regulations to create a rebuttable presumption of reasonableness for the compensation of its officers, directors, trustees and key employees, shall disclose to the Attorney General, in the application for the grant, the process for determining such compensation, including the independent persons involved in reviewing and approving such compensation, the comparability data used, and contemporaneous substantiation of the deliberation and decision. Upon request, the Attorney General shall make the information disclosed under this subsection available for public inspection.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26935803-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Conference expenditures</heading><clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id26935804-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/C/i\"><num value=\"i\" class=\"bold\">(i)</num><heading class=\"bold\"> Limitation</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">No amounts authorized to be appropriated to the Department of Justice under this Act may be used by the Attorney General, or by any individual or organization awarded discretionary funds through a cooperative agreement under this Act, to host or support any expenditure for conferences that uses more than $20,000 in Department funds, unless the Deputy Attorney General or such Assistant Attorney Generals, Directors, or principal deputies as the Deputy Attorney General may designate, provides prior written authorization that the funds may be expended to host a conference.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id26935805-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/C/ii\"><num value=\"ii\" class=\"bold\">(ii)</num><heading class=\"bold\"> Written approval</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">Written approval under clause (i) shall include a written estimate of all costs associated with the conference, including the cost of all food and beverages, audiovisual equipment, honoraria for speakers, and any entertainment.</p>\n</content>\n</clause>\n<clause style=\"-uslm-lc:I77\" class=\"indent5 firstIndent-2\" id=\"id26937f16-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/C/iii\"><num value=\"iii\" class=\"bold\">(iii)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I14\" class=\"indent3\">The Deputy Attorney General shall submit an annual report to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives on all approved conference expenditures referenced in this paragraph.</p>\n</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id26937f17-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Annual certification</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">Beginning in the first fiscal year beginning after the date of the enactment of this Act,<sup>2</sup> the Attorney General shall submit, to the Committee on the Judiciary and the Committee on Appropriations of the Senate and the Committee on the Judiciary and the Committee on Appropriations of the House of Representatives, an annual certification that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26937f18-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/D/i\"><num value=\"i\">(i)</num><content> all audits issued by the Office of the Inspector General under paragraph (1) have been completed and reviewed by the appropriate Assistant Attorney General or Director;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26937f19-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/D/ii\"><num value=\"ii\">(ii)</num><content> all mandatory exclusions required under subparagraph (A)(iii) have been issued;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26937f1a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/D/iii\"><num value=\"iii\">(iii)</num><content> all reimbursements required under subparagraph (A)(v) have been made; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26937f1b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12291/b/16/D/iv\"><num value=\"iv\">(iv)</num><content> includes a list of any grant recipients excluded under subparagraph (A) from the previous year.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id26937f1c-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/103/322/tIV/s40002\">Pub. L. 109–162, title II, § 201</ref>, <date date=\"2006-01-05\">Jan. 5, 2006</date>, <ref href=\"/us/stat/119/2993\">119 Stat. 2993</ref>, provided that: <quotedContent origin=\"/us/pl/109/162/tII/s201\">\n<inline>“Congress finds the following:</inline>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"1\">“(1)</num><content> Nearly ⅓ of American women report physical or sexual abuse by a husband or boyfriend at some point in their lives.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"2\">“(2)</num><content> According to the National Crime Victimization Survey, 248,000 Americans 12 years of age and older were raped or sexually assaulted in 2002.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"3\">“(3)</num><chapeau> Rape and sexual assault in the United States is estimated to cost $127,000,000,000 per year, including—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> lost productivity;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> medical and mental health care;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> police and fire services;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> social services;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"E\">“(E)</num><content> loss of and damage to property; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"F\">“(F)</num><content> reduced quality of life.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"4\">“(4)</num><content> Nonreporting of sexual assault in rural areas is a particular problem because of the high rate of nonstranger sexual assault.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> Geographic isolation often compounds the problems facing sexual assault victims. The lack of anonymity and accessible support services can limit opportunities for justice for victims.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><content> Domestic elder abuse is primarily family abuse. The National Elder Abuse Incidence Study found that the perpetrator was a family member in 90 percent of cases.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><chapeau> Barriers for older victims leaving abusive relationships include—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> the inability to support themselves;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> poor health that increases their dependence on the abuser;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"C\">“(C)</num><content> fear of being placed in a nursing home; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"D\">“(D)</num><content> ineffective responses by domestic abuse programs and law enforcement.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><content> Disabled women comprise another vulnerable population with unmet needs. Women with disabilities are more likely to be the victims of abuse and violence than women without disabilities because of their increased physical, economic, social, or psychological dependence on others.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"9\">“(9)</num><content> Many women with disabilities also fail to report the abuse, since they are dependent on their abusers and fear being abandoned or institutionalized.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"10\">“(10)</num><chapeau> Of the 598 battered women’s programs surveyed—</chapeau><subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"A\">“(A)</num><content> only 35 percent of these programs offered disability awareness training for their staff; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I23\" class=\"indent2\"><num value=\"B\">“(B)</num><content> only 16 percent dedicated a staff member to provide services to women with disabilities.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"11\">“(11)</num><content> Problems of domestic violence are exacerbated for immigrants when spouses control the immigration status of their family members, and abusers use threats of refusal to file immigration papers and threats to deport spouses and children as powerful tools to prevent battered immigrant women from seeking help, trapping battered immigrant women in violent homes because of fear of deportation.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"12\">“(12)</num><content> Battered immigrant women who attempt to flee abusive relationships may not have access to bilingual shelters or bilingual professionals, and face restrictions on public or financial assistance. They may also lack assistance of a certified interpreter in court, when reporting complaints to the police or a 9–1–1 operator, or even in acquiring information about their rights and the legal system.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"13\">“(13)</num><content> More than 500 men and women call the National Domestic Violence Hotline every day to get immediate, informed, and confidential assistance to help deal with family violence.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"14\">“(14)</num><content> The National Domestic Violence Hotline service is available, toll-free, 24 hours a day and 7 days a week, with bilingual staff, access to translators in 150 languages, and a TTY line for the hearing-impaired.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"15\">“(15)</num><content> With access to over 5,000 shelters and service providers across the United States, Puerto Rico, and the United States Virgin Islands, the National Domestic Violence Hotline provides crisis intervention and immediately connects callers with sources of help in their local community.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"16\">“(16)</num><content> Approximately 60 percent of the callers indicate that calling the Hotline is their first attempt to address a domestic violence situation and that they have not called the police or any other support services.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"17\">“(17)</num><content> Between 2000 and 2003, there was a 27 percent increase in call volume at the National Domestic Violence Hotline.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"18\">“(18)</num><content> Improving technology infrastructure at the National Domestic Violence Hotline and training advocates, volunteers, and other staff on upgraded technology will drastically increase the Hotline’s ability to answer more calls quickly and effectively.”</content>\n</paragraph>\n</quotedContent>\n</p>\n<p><ref href=\"/us/pl/109/162/tIII/s301\">Pub. They often do not have access to money, transportation, or shelter services. They must overcome issues such as distrust of adults, lack of knowledge about available resources, or pressure from peers and parents.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"5\">“(5)</num><content> A needs assessment on teen relationship abuse for the State of California, funded by the California Department of Health Services, identified a desire for confidentiality and confusion about the law as 2 of the most significant barriers to young victims of domestic and dating violence seeking help.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"6\">“(6)</num><content> Only one State specifically allows for minors to petition the court for protection orders.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"7\">“(7)</num><content> Many youth are involved in dating relationships, and these relationships can include the same kind of domestic violence and dating violence seen in the adult population. In fact, more than 40 percent of all incidents of domestic violence involve people who are not married.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"8\">“(8)</num><content> 40 percent of girls ages 14 to 17 report knowing someone their age who has been hit or beaten by a boyfriend, and 13 percent of college women report being stalked.</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I22\" class=\"indent1\"><num value=\"9\">“(9)</num><content> Of college women who said they had been the victims of rape or attempted rape, 12.8 percent of completed rapes, 35 percent of attempted rapes, and 22.9 percent of threatened rapes took place on a date.
