L. 113–4, title VI, § 602(2), Mar. 7, 2013, 127 Stat. 109.)","seq_in_title":365,"parent_identifier":"/us/usc/t34/stI/ch121/schIII/ptB/spt4","ancestors":[{"identifier":"/us/usc/t34","level":"title","num":"Title 34—","heading":"CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI","level":"subtitle","num":"Subtitle I—","heading":"Comprehensive Acts","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121","level":"chapter","num":"CHAPTER 121—","heading":"VIOLENT CRIME CONTROL AND LAW ENFORCEMENT","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121/schIII","level":"subchapter","num":"SUBCHAPTER III—","heading":"VIOLENCE AGAINST WOMEN","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121/schIII/ptB","level":"part","num":"Part B—","heading":"Safe Homes for Women","status":null,"is_section":false},{"identifier":"/us/usc/t34/stI/ch121/schIII/ptB/spt4","level":"subpart","num":"subpart 4—","heading":"transitional housing assistance grants for victims of domestic violence, dating violence, sexual assault, or stalking","status":null,"is_section":false}],"xml":"<section xmlns=\"http://xml.house.gov/schemas/uslm/1.0\" xmlns:xsi=\"http://www.w3.org/2001/XMLSchema-instance\" xmlns:dc=\"http://purl.org/dc/elements/1.1/\" xmlns:dcterms=\"http://purl.org/dc/terms/\" style=\"-uslm-lc:I80\" id=\"id26975039-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351\"><num value=\"12351\">§ 12351.</num><heading> Transitional housing assistance grants for victims of domestic violence, dating violence, sexual assault, or stalking</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2697503a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">The Attorney General, acting in consultation with the Director of the Violence Against Women Office of the Department of Justice, the Department of Housing and Urban Development, and the Department of Health and Human Services, shall award grants under this section to States, units of local government, Indian tribes, and other organizations, including domestic violence and sexual assault victim service providers, domestic violence and sexual assault coalitions, other nonprofit, nongovernmental organizations, or community-based and culturally specific organizations, that have a documented history of effective work concerning domestic violence, dating violence, sexual assault, or stalking (referred to in this section as the “recipient”) to carry out programs to provide assistance to minors, adults, and their dependents—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2697503b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/a/1\"><num value=\"1\">(1)</num><content> who are homeless, or in need of transitional housing or other housing assistance, as a result of a situation of domestic violence, dating violence, sexual assault, or stalking; and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2697503c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/a/2\"><num value=\"2\">(2)</num><content> for whom emergency shelter services or other crisis intervention services are unavailable or insufficient.</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2697503d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Grants</heading><chapeau style=\"-uslm-lc:I11\" class=\"indent0\">Grants awarded under this section may be used for programs that provide—</chapeau><paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2697503e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/b/1\"><num value=\"1\">(1)</num><content> transitional housing, including funding for the operating expenses of newly developed or existing transitional housing.<ref class=\"footnoteRef\" idref=\"fn002106\">1</ref><note type=\"footnote\" id=\"fn002106\"><num>1</num> So in original. The period probably should be a semicolon.</note></content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id2697503f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/b/2\"><num value=\"2\">(2)</num><content> short-term housing assistance, including rental or utilities payments assistance and assistance with related expenses such as payment of security deposits and other costs incidental to relocation to transitional housing for persons described in subsection (a); and</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26975040-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/b/3\"><num value=\"3\">(3)</num><chapeau> support services designed to enable a minor, an adult, or a dependent of such minor or adult, who is fleeing a situation of domestic violence, dating violence, sexual assault, or stalking to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26977751-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/b/3/A\"><num value=\"A\">(A)</num><content> locate and secure permanent housing;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26977752-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/b/3/B\"><num value=\"B\">(B)</num><content> secure employment, including obtaining employment counseling, occupational training, job retention counseling, and counseling concerning re-entry in to <ref class=\"footnoteRef\" idref=\"fn002107\">2</ref><note type=\"footnote\" id=\"fn002107\"><num>2</num> So in original. Probably should be “into”.</note> the workforce; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26977753-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/b/3/C\"><num value=\"C\">(C)</num><content> integrate into a community by providing that minor, adult, or dependent with services, such as transportation, counseling, child care services, case management, and other assistance. Participation in the support services shall be voluntary. Receipt of the benefits of the housing assistance described in paragraph (2) shall not be conditioned upon the participation of the youth, adults, or their dependents in any or all of the support services offered them.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26977754-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Duration</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26977755-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/c/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Except as provided in paragraph (2), a minor, an adult, or a dependent, who receives assistance under this section shall receive that assistance for not more than 24 months.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26977756-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/c/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Waiver</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">The recipient of a grant under this section may waive the restriction under paragraph (1) for not more than an additional 6 month period with respect to any minor, adult, or dependent, who—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26977757-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/c/2/A\"><num value=\"A\">(A)</num><content> has made a good-faith effort to acquire permanent housing; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26977758-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/c/2/B\"><num value=\"B\">(B)</num><content> has been unable to acquire permanent housing.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26977759-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/d\"><num value=\"d\" class=\"bold\">(d)</num><heading class=\"bold\"> Application</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2697775a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/d/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Each eligible entity desiring a grant under this section shall submit an application to the Attorney General at such time, in such manner, and accompanied by such information as the Attorney General may reasonably require.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2697775b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/d/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contents</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each application submitted pursuant to paragraph (1) shall—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2697775c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/d/2/A\"><num value=\"A\">(A)</num><content> describe the activities for which assistance under this section is sought;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2697775d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/d/2/B\"><num value=\"B\">(B)</num><content> provide assurances that any supportive services offered to participants in programs developed under subsection (b)(3) are voluntary and that refusal to receive such services shall not be grounds for termination from the program or eviction from the victim’s housing; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26979e6e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/d/2/C\"><num value=\"C\">(C)</num><content> provide such additional assurances as the Attorney General determines to be essential to ensure compliance with the requirements of this section.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26979e6f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/d/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Application</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Nothing in this subsection shall be construed to require—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26979e70-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/d/3/A\"><num value=\"A\">(A)</num><content> victims to participate in the criminal justice system in order to receive services; or</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26979e71-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/d/3/B\"><num value=\"B\">(B)</num><content> domestic violence advocates to breach client confidentiality.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26979e72-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e\"><num value=\"e\" class=\"bold\">(e)</num><heading class=\"bold\"> Report to the Attorney General</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26979e73-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">A recipient of a grant under this section shall annually prepare and submit to the Attorney General a report describing—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26979e74-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e/1/A\"><num value=\"A\">(A)</num><content> the number of minors, adults, and dependents assisted under this section; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26979e75-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e/1/B\"><num value=\"B\">(B)</num><content> the types of housing assistance and support services provided under this section.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26979e76-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Contents</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Each report prepared and submitted pursuant to paragraph (1) shall include information regarding—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26979e77-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e/2/A\"><num value=\"A\">(A)</num><content> the purpose and amount of housing assistance provided to each minor, adult, or dependent, assisted under this section and the reason for that assistance;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26979e78-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e/2/B\"><num value=\"B\">(B)</num><content> the number of months each minor, adult, or dependent, received assistance under this section;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26979e79-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e/2/C\"><num value=\"C\">(C)</num><chapeau> the number of minors, adults, and dependents who—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26979e7a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e/2/C/i\"><num value=\"i\">(i)</num><content> were eligible to receive assistance under this section; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id26979e7b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e/2/C/ii\"><num value=\"ii\">(ii)</num><content> were not provided with assistance under this section solely due to a lack of available housing;</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26979e7c-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e/2/D\"><num value=\"D\">(D)</num><content> the type of support services provided to each minor, adult, or dependent, assisted under this section; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26979e7d-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/e/2/E\"><num value=\"E\">(E)</num><content> the client population served and the number of individuals requesting services that the transitional housing program is unable to serve as a result of a lack of resources.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26979e7e-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/f\"><num value=\"f\" class=\"bold\">(f)</num><heading class=\"bold\"> Report to Congress</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26979e7f-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/f/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Reporting requirement</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">The Attorney General, with the Director of the Violence Against Women Office, shall prepare and submit to the Committee on the Judiciary of the House of Representatives and the Committee on the Judiciary of the Senate a report that contains a compilation of the information contained in the report submitted under subsection (e) of this section not later than 1 month after the end of each even-numbered fiscal year.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2697c590-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/f/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Availability of report</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">In order to coordinate efforts to assist the victims of domestic violence, the Attorney General, in coordination with the Director of the Violence Against Women Office, shall transmit a copy of the report submitted under paragraph (1) to—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2697c591-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/f/2/A\"><num value=\"A\">(A)</num><content> the Office of Community Planning and Development at the United States Department of Housing and Urban Development; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2697c592-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/f/2/B\"><num value=\"B\">(B)</num><content> the Office of Women’s Health at the United States Department of Health and Human Services.</content>\n</subparagraph>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id2697c593-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g\"><num value=\"g\" class=\"bold\">(g)</num><heading class=\"bold\"> Authorization of appropriations</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2697c594-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">There are authorized to be appropriated to carry out this section $35,000,000 for each of fiscal years 2014 through 2018.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2697c595-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Limitations</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">Of the amount made available to carry out this section in any fiscal year, up to 5 percent may be used by the Attorney General for evaluation, monitoring, technical assistance, salaries and administrative expenses.</p>\n</content>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id2697c596-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3\"><num value=\"3\" class=\"bold\">(3)</num><heading class=\"bold\"> Minimum amount</heading><subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id2697c597-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/A\"><num value=\"A\" class=\"bold\">(A)</num><heading class=\"bold\"> In general</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">Except as provided in subparagraph (B), unless all qualified applications submitted by any States, units of local government, Indian tribes, or organizations within a State for a grant under this section have been funded, that State, together with the grantees within the State (other than Indian tribes), shall be allocated in each fiscal year, not less than 0.75 percent of the total amount appropriated in the fiscal year for grants pursuant to this section.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id2697c598-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/B\"><num value=\"B\" class=\"bold\">(B)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I13\" class=\"indent2\">The United States Virgin Islands, American Samoa, Guam, and the Northern Mariana Islands shall each be allocated not less than 0.25 percent of the total amount appropriated in the fiscal year for grants pursuant to this section.</p>\n</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id2697c599-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/C\"><num value=\"C\" class=\"bold\">(C)</num><heading class=\"bold\"> Underserved populations</heading><clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2697c59a-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/C/i\"><num value=\"i\">(i)</num><heading> <inline class=\"small-caps\">Indian tribes.—</inline></heading><subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2697c59b-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/C/i/I\"><num value=\"I\">(I)</num><heading> <inline class=\"small-caps\">In general</inline>.—</heading><content>Not less than 10 percent of the total amount available under this section for each fiscal year shall be available for grants under the program authorized by <ref href=\"/us/usc/t34/s10452\">section 10452 of this title</ref>.</content>\n</subclause>\n<subclause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2697ecac-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/C/i/II\"><num value=\"II\">(II)</num><heading> <inline class=\"small-caps\">Applicability of part</inline>.—</heading><content> <ref class=\"footnoteRef\" idref=\"fn002108\">3</ref><note type=\"footnote\" id=\"fn002108\"><num>3</num> So in original. Probably should be “section.—”.</note> The requirements of this section shall not apply to funds allocated for the program described in subclause (I).</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id2697ecad-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/C/ii\"><num value=\"ii\">(ii)</num><content> Priority shall be given to projects developed under subsection (b) that primarily serve underserved populations.</content>\n</clause>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I18\" class=\"indent4 firstIndent-2\" id=\"id2697ecae-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/D\"><num value=\"D\" class=\"bold\">(D)</num><heading class=\"bold\"> Qualified application defined</heading><chapeau style=\"-uslm-lc:I13\" class=\"indent2\">In this paragraph, the term “qualified application” means an application that—</chapeau><clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2697ecaf-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/D/i\"><num value=\"i\">(i)</num><content> has been submitted by an eligible applicant;</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2697ecb0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/D/ii\"><num value=\"ii\">(ii)</num><chapeau> does not propose any activities that may compromise victim safety, including—</chapeau><subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id2697ecb1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/D/ii/I\"><num value=\"I\">(I)</num><content> background checks of victims; or</content>\n</subclause>\n<subclause style=\"-uslm-lc:I16\" class=\"indent4\" id=\"id2697ecb2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/D/ii/II\"><num value=\"II\">(II)</num><content> clinical evaluations to determine eligibility for services;</content>\n</subclause>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2697ecb3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/D/iii\"><num value=\"iii\">(iii)</num><content> reflects an understanding of the dynamics of domestic violence, dating violence, sexual assault, or stalking; and</content>\n</clause>\n<clause style=\"-uslm-lc:I14\" class=\"indent3\" id=\"id2697ecb4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12351/g/3/D/iv\"><num value=\"iv\">(iv)</num><content> does not propose prohibited activities, including mandatory services for victims.</content>\n</clause>\n</subparagraph>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id2697ecb5-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/103/322/tIV/s40299\">Pub.
