<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id269fb428-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491"><num value="12491">§ 12491.</num><heading> Housing protections for victims of domestic violence, dating violence, sexual assault, and stalking</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id269fb429-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a"><num value="a" class="bold">(a)</num><heading class="bold"> Definitions</heading><chapeau style="-uslm-lc:I11" class="indent0">In this subpart:</chapeau><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id269fb42a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> Affiliated individual</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “affiliated individual” means, with respect to an individual—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id269fb42b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/1/A"><num value="A">(A)</num><content> a spouse, parent, brother, sister, or child of that individual, or an individual to whom that individual stands in loco parentis; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id269fb42c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/1/B"><num value="B">(B)</num><content> any individual, tenant, or lawful occupant living in the household of that individual.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id269fb42d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Appropriate agency</heading><content><p style="-uslm-lc:I12" class="indent1">The term “appropriate agency” means, with respect to a covered housing program, the Executive department (as defined in <ref href="/us/usc/t5/s101">section 101 of title 5</ref>) that carries out the covered housing program.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id269fb42e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Covered housing program</heading><chapeau style="-uslm-lc:I12" class="indent1">The term “covered housing program” means—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id269fb42f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/3/A"><num value="A">(A)</num><content> the program under <ref href="/us/usc/t12/s1701q">section 1701q of title 12</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id269fb430-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/3/B"><num value="B">(B)</num><content> the program under section 811 of the Cranston-Gonzalez National Affordable Housing Act (<ref href="/us/usc/t42/s8013">42 U.S.C. 8013</ref>);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id269fb431-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/3/C"><num value="C">(C)</num><content> the program under subtitle D of title VIII of the Cranston-Gonzalez National Affordable Housing Act (<ref href="/us/usc/t42/s12901">42 U.S.C. 12901</ref> et seq.);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id269fb432-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/3/D"><num value="D">(D)</num><content> the program under subtitle A of title IV of the McKinney-Vento Homeless Assistance Act (<ref href="/us/usc/t42/s11360">42 U.S.C. 11360</ref> et seq.);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id269fb433-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/3/E"><num value="E">(E)</num><content> the program under subtitle A of title II of the Cranston-Gonzalez National Affordable Housing Act (<ref href="/us/usc/t42/s12741">42 U.S.C. 12741</ref> et seq.);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id269fb434-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/3/F"><num value="F">(F)</num><content> the program under paragraph (3) of section 1715<i>l</i>(d) of title 12 that bears interest at a rate determined under the proviso under paragraph (5) of such section 1715<i>l</i>(d);</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id269fb435-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/3/G"><num value="G">(G)</num><content> the program under <ref href="/us/usc/t12/s1715z–1">section 1715z–1 of title 12</ref>;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id269fdb46-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/3/H"><num value="H">(H)</num><content> the programs under sections 1437d and 1437f of title 42;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id269fdb47-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/3/I"><num value="I">(I)</num><content> rural housing assistance provided under sections 1484, 1485, 1486, 1490m, and 1490p–2 of title 42; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id269fdb48-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/a/3/J"><num value="J">(J)</num><content> the low income housing tax credit program under <ref href="/us/usc/t26/s42">section 42 of title 26</ref>.</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id269fdb49-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b"><num value="b" class="bold">(b)</num><heading class="bold"> Prohibited basis for denial or termination of assistance or eviction</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id269fdb4a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">An applicant for or tenant of housing assisted under a covered housing program may not be denied admission to, denied assistance under, terminated from participation in, or evicted from the housing on the basis that the applicant or tenant is or has been a victim of domestic violence, dating violence, sexual assault, or stalking, if the applicant or tenant otherwise qualifies for admission, assistance, participation, or occupancy.</p>
</content>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id269fdb4b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Construction of lease terms</heading><chapeau style="-uslm-lc:I12" class="indent1">An incident of actual or threatened domestic violence, dating violence, sexual assault, or stalking shall not be construed as—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id269fdb4c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/2/A"><num value="A">(A)</num><content> a serious or repeated violation of a lease for housing assisted under a covered housing program by the victim or threatened victim of such incident; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id269fdb4d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/2/B"><num value="B">(B)</num><content> good cause for terminating the assistance, tenancy, or occupancy rights to housing assisted under a covered housing program of the victim or threatened victim of such incident.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id269fdb4e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3"><num value="3" class="bold">(3)</num><heading class="bold"> Termination on the basis of criminal activity</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id269fdb4f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3/A"><num value="A" class="bold">(A)</num><heading class="bold"> Denial of assistance, tenancy, and occupancy rights prohibited</heading><content><p style="-uslm-lc:I13" class="indent2">No person may deny assistance, tenancy, or occupancy rights to housing assisted under a covered housing program to a tenant solely on the basis of criminal activity directly relating to domestic violence, dating violence, sexual assault, or stalking that is engaged in by a member of the household of the tenant or any guest or other person under the control of the tenant, if the tenant or an affiliated individual of the tenant is the victim or threatened victim of such domestic violence, dating violence, sexual assault, or stalking.</p>
</content>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id269fdb50-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3/B"><num value="B" class="bold">(B)</num><heading class="bold"> Bifurcation</heading><clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id269fdb51-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3/B/i"><num value="i" class="bold">(i)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I14" class="indent3">Notwithstanding subparagraph (A), a public housing agency or owner or manager of housing assisted under a covered housing program may bifurcate a lease for the housing in order to evict, remove, or terminate assistance to any individual who is a tenant or lawful occupant of the housing and who engages in criminal activity directly relating to domestic violence, dating violence, sexual assault, or stalking against an affiliated individual or other individual, without evicting, removing, terminating assistance to, or otherwise penalizing a victim of such criminal activity who is also a tenant or lawful occupant of the housing.</p>
</content>
</clause>
<clause style="-uslm-lc:I77" class="indent5 firstIndent-2" id="id26a00262-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3/B/ii"><num value="ii" class="bold">(ii)</num><heading class="bold"> Effect of eviction on other tenants</heading><content><p style="-uslm-lc:I14" class="indent3">If public housing agency or owner or manager of housing assisted under a covered housing program evicts, removes, or terminates assistance to an individual under clause (i), and the individual is the sole tenant eligible to receive assistance under a covered housing program, the public housing agency or owner or manager of housing assisted under the covered housing program shall provide any remaining tenant or resident an opportunity to establish eligibility for the covered housing program. If a tenant or resident described in the preceding sentence cannot establish eligibility, the public housing agency or owner or manager of the housing shall provide the tenant or resident a reasonable time, as determined by the appropriate agency, to find new housing or to establish eligibility for housing under another covered housing program.</p>
</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26a00263-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3/C"><num value="C" class="bold">(C)</num><heading class="bold"> Rules of construction</heading><chapeau style="-uslm-lc:I13" class="indent2">Nothing in subparagraph (A) shall be construed—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26a00264-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3/C/i"><num value="i">(i)</num><chapeau> to limit the authority of a public housing agency or owner or manager of housing assisted under a covered housing program, when notified of a court order, to comply with a court order with respect to—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id26a00265-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3/C/i/I"><num value="I">(I)</num><content> the rights of access to or control of property, including civil protection orders issued to protect a victim of domestic violence, dating violence, sexual assault, or stalking; or</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id26a00266-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3/C/i/II"><num value="II">(II)</num><content> the distribution or possession of property among members of a household in a case;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a00267-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3/C/ii"><num value="ii">(ii)</num><content> to limit any otherwise available authority of a public housing agency or owner or manager of housing assisted under a covered housing program to evict or terminate assistance to a tenant for any violation of a lease not premised on the act of violence in question against the tenant or an affiliated person of the tenant, if the public housing agency or owner or manager does not subject an individual who is or has been a victim of domestic violence, dating violence, or stalking to a more demanding standard than other tenants in determining whether to evict or terminate;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a02978-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3/C/iii"><num value="iii">(iii)</num><content> to limit the authority to terminate assistance to a tenant or evict a tenant from housing assisted under a covered housing program if a public housing agency or owner or manager of the housing can demonstrate that an actual and imminent threat to other tenants or individuals employed at or providing service to the property would be present if the assistance is not terminated or the tenant is not evicted; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a02979-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/b/3/C/iv"><num value="iv">(iv)</num><content> to supersede any provision of any Federal, State, or local law that provides greater protection than this section for victims of domestic violence, dating violence, sexual assault, or stalking.</content>

</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26a0297a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c"><num value="c" class="bold">(c)</num><heading class="bold"> Documentation</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a0297b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/1"><num value="1" class="bold">(1)</num><heading class="bold"> Request for documentation</heading><content><p style="-uslm-lc:I12" class="indent1">If an applicant for, or tenant of, housing assisted under a covered housing program represents to a public housing agency or owner or manager of the housing that the individual is entitled to protection under subsection (b), the public housing agency or owner or manager may request, in writing, that the applicant or tenant submit to the public housing agency or owner or manager a form of documentation described in paragraph (3).</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a0297c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/2"><num value="2" class="bold">(2)</num><heading class="bold"> Failure to provide certification</heading><subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26a0297d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/2/A"><num value="A" class="bold">(A)</num><heading class="bold"> In general</heading><chapeau style="-uslm-lc:I13" class="indent2">If an applicant or tenant does not provide the documentation requested under paragraph (1) within 14 business days after the tenant receives a request in writing for such certification from a public housing agency or owner or manager of housing assisted under a covered housing program, nothing in this subpart may be construed to limit the authority of the public housing agency or owner or manager to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26a0297e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/2/A/i"><num value="i">(i)</num><content> deny admission by the applicant or tenant to the covered program;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a0297f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/2/A/ii"><num value="ii">(ii)</num><content> deny assistance under the covered program to the applicant or tenant;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a02980-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/2/A/iii"><num value="iii">(iii)</num><content> terminate the participation of the applicant or tenant in the covered program; or</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a02981-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/2/A/iv"><num value="iv">(iv)</num><content> evict the applicant, the tenant, or a lawful occupant that commits violations of a lease.</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I18" class="indent4 firstIndent-2" id="id26a05092-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/2/B"><num value="B" class="bold">(B)</num><heading class="bold"> Extension</heading><content><p style="-uslm-lc:I13" class="indent2">A public housing agency or owner or manager of housing may extend the 14-day deadline under subparagraph (A) at its discretion.</p>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a05093-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3"><num value="3" class="bold">(3)</num><heading class="bold"> Form of documentation</heading><chapeau style="-uslm-lc:I12" class="indent1">A form of documentation described in this paragraph is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26a05094-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3/A"><num value="A">(A)</num><chapeau> a certification form approved by the appropriate agency that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26a05095-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3/A/i"><num value="i">(i)</num><content> states that an applicant or tenant is a victim of domestic violence, dating violence, sexual assault, or stalking;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a05096-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3/A/ii"><num value="ii">(ii)</num><content> states that the incident of domestic violence, dating violence, sexual assault, or stalking that is the ground for protection under subsection (b) meets the requirements under subsection (b); and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a05097-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3/A/iii"><num value="iii">(iii)</num><content> includes the name of the individual who committed the domestic violence, dating violence, sexual assault, or stalking, if the name is known and safe to provide;</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26a05098-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3/B"><num value="B">(B)</num><chapeau> a document that—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26a05099-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3/B/i"><num value="i">(i)</num><chapeau> is signed by—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id26a0509a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3/B/i/I"><num value="I">(I)</num><content> an employee, agent, or volunteer of a victim service provider, an attorney, a medical professional, or a mental health professional from whom an applicant or tenant has sought assistance relating to domestic violence, dating violence, sexual assault, or stalking, or the effects of the abuse; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id26a0509b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3/B/i/II"><num value="II">(II)</num><content> the applicant or tenant; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a0509c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3/B/ii"><num value="ii">(ii)</num><content> states under penalty of perjury that the individual described in clause (i)(I) believes that the incident of domestic violence, dating violence, sexual assault, or stalking that is the ground for protection under subsection (b) meets the requirements under subsection (b);</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26a0509d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3/C"><num value="C">(C)</num><content> a record of a Federal, State, tribal, territorial, or local law enforcement agency, court, or administrative agency; or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26a0509e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/3/D"><num value="D">(D)</num><content> at the discretion of a public housing agency or owner or manager of housing assisted under a covered housing program, a statement or other evidence provided by an applicant or tenant.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a0509f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/4"><num value="4" class="bold">(4)</num><heading class="bold"> Confidentiality</heading><chapeau style="-uslm-lc:I12" class="indent1">Any information submitted to a public housing agency or owner or manager under this subsection, including the fact that an individual is a victim of domestic violence, dating violence, sexual assault, or stalking shall be maintained in confidence by the public housing agency or owner or manager and may not be entered into any shared database or disclosed to any other entity or individual, except to the extent that the disclosure is—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26a077b0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/4/A"><num value="A">(A)</num><content> requested or consented to by the individual in writing;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26a077b1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/4/B"><num value="B">(B)</num><content> required for use in an eviction proceeding under subsection (b); or</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26a077b2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/4/C"><num value="C">(C)</num><content> otherwise required by applicable law.</content>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a077b3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/5"><num value="5" class="bold">(5)</num><heading class="bold"> Documentation not required</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this subsection shall be construed to require a public housing agency or owner or manager of housing assisted under a covered housing program to request that an individual submit documentation of the status of the individual as a victim of domestic violence, dating violence, sexual assault, or stalking.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a077b4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/6"><num value="6" class="bold">(6)</num><heading class="bold"> Compliance not sufficient to constitute evidence of unreasonable act</heading><content><p style="-uslm-lc:I12" class="indent1">Compliance with subsection (b) by a public housing agency or owner or manager of housing assisted under a covered housing program based on documentation received under this subsection, shall not be sufficient to constitute evidence of an unreasonable act or omission by the public housing agency or owner or manager or an employee or agent of the public housing agency or owner or manager. Nothing in this paragraph shall be construed to limit the liability of a public housing agency or owner or manager of housing assisted under a covered housing program for failure to comply with subsection (b).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a077b5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/7"><num value="7" class="bold">(7)</num><heading class="bold"> Response to conflicting certification</heading><content><p style="-uslm-lc:I12" class="indent1">If a public housing agency or owner or manager of housing assisted under a covered housing program receives documentation under this subsection that contains conflicting information, the public housing agency or owner or manager may require an applicant or tenant to submit third-party documentation, as described in subparagraph (B), (C), or (D) of paragraph (3).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a077b6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/c/8"><num value="8" class="bold">(8)</num><heading class="bold"> Preemption</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this subsection shall be construed to supersede any provision of any Federal, State, or local law that provides greater protection than this subsection for victims of domestic violence, dating violence, sexual assault, or stalking.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26a077b7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/d"><num value="d" class="bold">(d)</num><heading class="bold"> Notification</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a077b8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Development</heading><content><p style="-uslm-lc:I12" class="indent1">The Secretary of Housing and Urban Development shall develop a notice of the rights of individuals under this section, including the right to confidentiality and the limits thereof.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a09ec9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Provision</heading><chapeau style="-uslm-lc:I12" class="indent1">Each public housing agency or owner or manager of housing assisted under a covered housing program shall provide the notice developed under paragraph (1), together with the form described in subsection (c)(3)(A), to an applicant for or tenants of housing assisted under a covered housing program—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26a09eca-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/d/2/A"><num value="A">(A)</num><content> at the time the applicant is denied residency in a dwelling unit assisted under the covered housing program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26a09ecb-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/d/2/B"><num value="B">(B)</num><content> at the time the individual is admitted to a dwelling unit assisted under the covered housing program;</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26a09ecc-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/d/2/C"><num value="C">(C)</num><content> with any notification of eviction or notification of termination of assistance; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26a09ecd-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/d/2/D"><num value="D">(D)</num><content> in multiple languages, consistent with guidance issued by the Secretary of Housing and Urban Development in accordance with Executive Order 13166 (<ref href="/us/usc/t42/s2000d–1">42 U.S.C. 2000d–1</ref> note; relating to access to services for persons with limited English proficiency).</content>
</subparagraph>
</paragraph>
</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26a09ece-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/e"><num value="e" class="bold">(e)</num><heading class="bold"> Emergency transfers</heading><chapeau style="-uslm-lc:I11" class="indent0">Each appropriate agency shall adopt a model emergency transfer plan for use by public housing agencies and owners or managers of housing assisted under covered housing programs that—</chapeau><paragraph style="-uslm-lc:I12" class="indent1" id="id26a09ecf-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/e/1"><num value="1">(1)</num><chapeau> allows tenants who are victims of domestic violence, dating violence, sexual assault, or stalking to transfer to another available and safe dwelling unit assisted under a covered housing program if—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26a09ed0-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/e/1/A"><num value="A">(A)</num><content> the tenant expressly requests the transfer; and</content>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26a09ed1-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/e/1/B"><num value="B">(B)</num><clause style="-uslm-lc:I13" class="indent2" id="id26a09ed2-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/e/1/B/i"><num value="i">(i)</num><content> the tenant reasonably believes that the tenant is threatened with imminent harm from further violence if the tenant remains within the same dwelling unit assisted under a covered housing program; or</content>
</clause>
<clause style="-uslm-lc:I13" class="indent2" id="id26a09ed3-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/e/1/B/ii"><num value="ii">(ii)</num><content> in the case of a tenant who is a victim of sexual assault, the sexual assault occurred on the premises during the 90 day period preceding the request for transfer; and</content>
</clause>
</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I12" class="indent1" id="id26a09ed4-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/e/2"><num value="2">(2)</num><content> incorporates reasonable confidentiality measures to ensure that the public housing agency or owner or manager does not disclose the location of the dwelling unit of a tenant to a person that commits an act of domestic violence, dating violence, sexual assault, or stalking against the tenant.</content>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26a0c5e5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/f"><num value="f" class="bold">(f)</num><heading class="bold"> Policies and procedures for emergency transfer</heading><content><p style="-uslm-lc:I11" class="indent0">The Secretary of Housing and Urban Development shall establish policies and procedures under which a victim requesting an emergency transfer under subsection (e) may receive, subject to the availability of tenant protection vouchers, assistance under section 1437f(<i>o</i>) of title 42.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26a0c5e6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12491/g"><num value="g" class="bold">(g)</num><heading class="bold"> Implementation</heading><content><p style="-uslm-lc:I11" class="indent0">The appropriate agency with respect to each covered housing program shall implement this section, as this section applies to the covered housing program.</p>
