value=\"12593\">§ 12593.</num><heading> Federal Bureau of Investigation</heading><subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26a755ab-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/a\"><num value=\"a\" class=\"bold\">(a)</num><heading class=\"bold\"> Proficiency testing requirements</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26a755ac-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/a/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Generally</heading><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26a755ad-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/a/1/A\"><num value=\"A\">(A)</num><content> Personnel at the Federal Bureau of Investigation who perform DNA analyses shall undergo semiannual external proficiency testing by a DNA proficiency testing program meeting the standards issued under <ref href=\"/us/usc/t34/s12591\">section 12591 of this title</ref>.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26a755ae-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/a/1/B\"><num value=\"B\">(B)</num><content> Within 1 year after <date date=\"1994-09-13\">September 13, 1994</date>, the Director of the Federal Bureau of Investigation shall arrange for periodic blind external tests to determine the proficiency of DNA analysis performed at the Federal Bureau of Investigation laboratory.</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26a77cbf-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/a/1/C\"><num value=\"C\">(C)</num><content> In this paragraph, “blind external test” means a test that is presented to the laboratory through a second agency and appears to the analysts to involve routine evidence.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26a77cc0-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/a/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Report</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">For 5 years after <date date=\"1994-09-13\">September 13, 1994</date>, the Director of the Federal Bureau of Investigation shall submit to the Committees on the Judiciary of the House and Senate an annual report on the results of each of the tests described in paragraph (1).</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26a77cc1-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/b\"><num value=\"b\" class=\"bold\">(b)</num><heading class=\"bold\"> Privacy protection standards</heading><paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26a77cc2-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/b/1\"><num value=\"1\" class=\"bold\">(1)</num><heading class=\"bold\"> Generally</heading><chapeau style=\"-uslm-lc:I12\" class=\"indent1\">Except as provided in paragraph (2), the results of DNA tests performed for a Federal law enforcement agency for law enforcement purposes may be disclosed only—</chapeau><subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26a77cc3-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/b/1/A\"><num value=\"A\">(A)</num><content> to criminal justice agencies for law enforcement identification purposes;</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26a77cc4-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/b/1/B\"><num value=\"B\">(B)</num><content> in judicial proceedings, if otherwise admissible pursuant to applicable statues <ref class=\"footnoteRef\" idref=\"fn002136\">1</ref><note type=\"footnote\" id=\"fn002136\"><num>1</num> So in original. Probably should be “statutes”.</note> or rules; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I13\" class=\"indent2\" id=\"id26a77cc5-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/b/1/C\"><num value=\"C\">(C)</num><content> for criminal defense purposes, to a defendant, who shall have access to samples and analyses performed in connection with the case in which such defendant is charged.</content>\n</subparagraph>\n</paragraph>\n<paragraph style=\"-uslm-lc:I79\" class=\"indent3 firstIndent-2\" id=\"id26a77cc6-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/b/2\"><num value=\"2\" class=\"bold\">(2)</num><heading class=\"bold\"> Exception</heading><content><p style=\"-uslm-lc:I12\" class=\"indent1\">If personally identifiable information is removed, test results may be disclosed for a population statistics database, for identification research and protocol development purposes, or for quality control purposes.</p>\n</content>\n</paragraph>\n</subsection>\n<subsection style=\"-uslm-lc:I19\" class=\"indent2 firstIndent-2\" id=\"id26a77cc7-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/c\"><num value=\"c\" class=\"bold\">(c)</num><heading class=\"bold\"> Criminal penalty</heading><paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id26a77cc8-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/c/1\"><num value=\"1\">(1)</num><chapeau> A person who—</chapeau><subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26a77cc9-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/c/1/A\"><num value=\"A\">(A)</num><content> by virtue of employment or official position, has possession of, or access to, individually identifiable DNA information indexed in a database created or maintained by any Federal law enforcement agency; and</content>\n</subparagraph>\n<subparagraph style=\"-uslm-lc:I12\" class=\"indent1\" id=\"id26a77cca-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/c/1/B\"><num value=\"B\">(B)</num><content> knowingly discloses such information in any manner to any person or agency not authorized to receive it,</content>\n</subparagraph>\n\n<continuation style=\"-uslm-lc:I10\" class=\"indent0 firstIndent0\">shall be fined not more than $100,000.</continuation>\n</paragraph>\n<paragraph style=\"-uslm-lc:I11\" class=\"indent0\" id=\"id26a77ccb-0f21-11eb-9212-a1a9175aa019\" identifier=\"/us/usc/t34/s12593/c/2\"><num value=\"2\">(2)</num><content> A person who, without authorization, knowingly obtains DNA samples or individually identifiable DNA information indexed in a database created or maintained by any Federal law enforcement agency shall be fined not more than $250,000, or imprisoned for a period of not more than one year, or both.</content>\n</paragraph>\n</subsection>\n<sourceCredit id=\"id26a77ccc-0f21-11eb-9212-a1a9175aa019\">(<ref href=\"/us/pl/103/322/tXXI/s210305\">Pub.
