<section xmlns="http://xml.house.gov/schemas/uslm/1.0" xmlns:xsi="http://www.w3.org/2001/XMLSchema-instance" xmlns:dc="http://purl.org/dc/elements/1.1/" xmlns:dcterms="http://purl.org/dc/terms/" style="-uslm-lc:I80" id="id26a929f5-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623"><num value="12623">§ 12623.</num><heading> Standards and best practices for use of non-invasive and non-permanent tracking devices</heading><subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26a929f6-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a"><num value="a" class="bold">(a)</num><heading class="bold"> Establishment</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a929f7-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Not later than 180 days after <date date="2018-03-23">March 23, 2018</date>, the Attorney General, in consultation with the Secretary of Health and Human Services and leading research, advocacy, self-advocacy, and service organizations, shall establish standards and best practices relating to the use of non-invasive and non-permanent tracking technology, where a guardian or parent has determined that a non-invasive and non-permanent tracking device is the least restrictive alternative, to locate individuals as described in subsection (a)(2) of <ref href="/us/usc/t34/s12621">section 12621 of this title</ref>, as added by this Act.</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a929f8-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2"><num value="2" class="bold">(2)</num><heading class="bold"> Requirements</heading><chapeau style="-uslm-lc:I12" class="indent1">In establishing the standards and best practices required under paragraph (1), the Attorney General shall—</chapeau><subparagraph style="-uslm-lc:I13" class="indent2" id="id26a929f9-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/A"><num value="A">(A)</num><chapeau> determine—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26a929fa-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/A/i"><num value="i">(i)</num><content> the criteria used to determine which individuals would benefit from the use of a tracking device;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a929fb-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/A/ii"><num value="ii">(ii)</num><content> the criteria used to determine who should have direct access to the tracking system; and</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a929fc-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/A/iii"><num value="iii">(iii)</num><content> which non-invasive and non-permanent types of tracking devices can be used in compliance with the standards and best practices; and</content>
</clause>
</subparagraph>
<subparagraph style="-uslm-lc:I13" class="indent2" id="id26a929fd-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/B"><num value="B">(B)</num><chapeau> establish standards and best practices the Attorney General determines are necessary to the administration of a tracking system, including procedures to—</chapeau><clause style="-uslm-lc:I14" class="indent3" id="id26a9510e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/B/i"><num value="i">(i)</num><chapeau> safeguard the privacy of the data used by the tracking device such that—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id26a9510f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/B/i/I"><num value="I">(I)</num><content> access to the data is restricted to law enforcement and health agencies determined necessary by the Attorney General; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id26a95110-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/B/i/II"><num value="II">(II)</num><content> collection, use, and retention of the data is solely for the purpose of preventing injury to or death of the individual wearing the tracking device;</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a95111-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/B/ii"><num value="ii">(ii)</num><content> establish criteria to determine whether use of the tracking device is the least restrictive alternative in order to prevent risk of injury or death before issuing the tracking device, including the previous consideration of less restrictive alternatives;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a95112-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/B/iii"><num value="iii">(iii)</num><content> provide training for law enforcement agencies to recognize signs of abuse during interactions with applicants for tracking devices;</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a95113-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/B/iv"><num value="iv">(iv)</num><content> protect the civil rights and liberties of the individuals who use tracking devices, including their rights under the Fourth Amendment to the Constitution of the United States and title VII of the Civil Rights Act of 1964 (<ref href="/us/usc/t42/s2000e">42 U.S.C. 2000e</ref> et seq.);</content>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a95114-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/B/v"><num value="v">(v)</num><chapeau> establish a complaint and investigation process to address—</chapeau><subclause style="-uslm-lc:I16" class="indent4" id="id26a95115-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/B/v/I"><num value="I">(I)</num><content> incidents of noncompliance by recipients of grants under subsection (a)(2) of <ref href="/us/usc/t34/s12621">section 12621 of this title</ref>, as added by this Act, with the best practices established by the Attorney General or other applicable law; and</content>
</subclause>
<subclause style="-uslm-lc:I16" class="indent4" id="id26a95116-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/B/v/II"><num value="II">(II)</num><content> use of a tracking device over the objection of an individual; and</content>
</subclause>
</clause>
<clause style="-uslm-lc:I14" class="indent3" id="id26a95117-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/2/B/vi"><num value="vi">(vi)</num><content> determine the role that State agencies should have in the administration of a tracking system.</content>

</subparagraph>
</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a95118-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/a/3"><num value="3" class="bold">(3)</num><heading class="bold"> Effective date</heading><content><p style="-uslm-lc:I12" class="indent1">The standards and best practices established pursuant to paragraph (1) shall take effect 90 days after publication of such standards and practices by the Attorney General.</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26a95119-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/b"><num value="b" class="bold">(b)</num><heading class="bold"> Required compliance</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a9511a-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/b/1"><num value="1" class="bold">(1)</num><heading class="bold"> In general</heading><content><p style="-uslm-lc:I12" class="indent1">Each entity that receives a grant under subsection (a)(2) of <ref href="/us/usc/t34/s12621">section 12621 of this title</ref>, as added by this Act, shall comply with any standards and best practices relating to the use of tracking devices established by the Attorney General in accordance with subsection (a).</p>

<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a9511b-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/b/2"><num value="2" class="bold">(2)</num><heading class="bold"> Determination of compliance</heading><content><p style="-uslm-lc:I12" class="indent1">The Attorney General, in consultation with the Secretary of Health and Human Services, shall determine whether an entity that receives a grant under subsection (a)(2) of <ref href="/us/usc/t34/s12621">section 12621 of this title</ref>, as added by this Act, acts in compliance with the standards and best practices described in paragraph (1).</p>

</subsection>
<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26a9782c-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/c"><num value="c" class="bold">(c)</num><heading class="bold"> Applicability of standards and best practices</heading><content><p style="-uslm-lc:I11" class="indent0">The standards and best practices established by the Attorney General under subsection (a) shall apply only to the grant programs authorized under subsection (a)(2) of <ref href="/us/usc/t34/s12621">section 12621 of this title</ref>, as added by this Act.</p>

<subsection style="-uslm-lc:I19" class="indent2 firstIndent-2" id="id26a9782d-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/d"><num value="d" class="bold">(d)</num><heading class="bold"> Limitations on program</heading><paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a9782e-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/d/1"><num value="1" class="bold">(1)</num><heading class="bold"> Data storage</heading><content><p style="-uslm-lc:I12" class="indent1">Any tracking data provided by tracking devices issued under this program may not be used by a Federal entity to create a database.</p>

</paragraph>
<paragraph style="-uslm-lc:I79" class="indent3 firstIndent-2" id="id26a9782f-0f21-11eb-9212-a1a9175aa019" identifier="/us/usc/t34/s12623/d/2"><num value="2" class="bold">(2)</num><heading class="bold"> Voluntary participation</heading><content><p style="-uslm-lc:I12" class="indent1">Nothing in this Act may be construed to require that a parent or guardian use a tracking device to monitor the location of a child or adult under that parent or guardian’s supervision if the parent or guardian does not believe that the use of such device is necessary or in the interest of the child or adult under supervision.</p>
